Le don de gamètes et d’embryons est en principe autorisé à la fois par la Loi sur les soins de santé et par le projet de Loi sur la santé reproductive et les droits en matière de procréation.
Cependant, la Loi sur les soins de santé ne prévoit aucune disposition spécifique en la matière. Elle ne contient qu’une disposition générale selon laquelle les gamètes des donneurs ou les embryons peuvent être utilisés à des fins de PMA.
Le projet de loi sur la santé reproductive et les droits en matière de procréation est plus précis. Il consacre un chapitre distinct au don de gamètes, et en définit les conditions et les procédures.
7. Des mesures de compensation sont-elles prévues pour de tels dons ?

DL-RHRR : Non. Conformément à l’article 20 du DR-RHRR, « le don de gamète n’est pas remboursé. Un donneur recevra une compensation pour le temps passé et les autres frais engendrés par le don (par exemple, le transport, l’absence au travail, etc.) ».

Un donneur de gamètes doit être un homme ou une femme capable, âgé(e) de 18 ans au moins et ne présentant aucune des maladies définies par la loi.
La fusion du sperme ou de l’ovule de parents génétiques dans le cadre de techniques de procréation médicalement assistée est interdite.
Un gamète ne peut être prélevé sur un homme décédé que si ce dernier a rédigé une directive anticipée spécifiant qu’il acceptait que ses gamètes soient utilisés après sa mort pour une insémination artificielle homologue ou une fécondation in vitro de l’ovule de son épouse, avec laquelle il s’est marié conformément aux règles définies par la législation de Géorgie. En revanche, il est interdit de prélever un ovule ou un ovaire sur une femme décédée pour une procédure de procréation médicalement assistée.

Selon le projet de Loi sur la santé reproductive et les droits en matière de procréation, un couple ou une femme célibataire a le droit de choisir un donneur en fonction de son âge, de son apparence physique, de son origine ethnique et de son état de santé. Cependant, les informations sur l’identité d’un donneur de sperme restent confidentielles.
10. Des mesures particulières sont-elles prises pour prévenir le risque de consanguinité ?

Les deux principes suivants ont été ajoutés au projet de Loi (DL-RHRR) pour éviter la consanguinité :
- Les gamètes d’une même personne ne peuvent pas être utilisés plus de trois fois (trois utilisations aboutissant à la naissance d’un enfant) ;
- Un registre commun des donneurs de gamètes sera mis en place, qui rassemblera des données sur les personnes participant à des procédures de procréation médicalement assistée avec don de gamètes.

En vertu de l'article 3a, paragraphe 2, de la loi sur la protection de l'embryon, un diagnostic génétique préimplantatoire est exceptionnellement autorisé lorsque les prédispositions génétiques de la femme sur laquelle l'ovule a été prélevé, ou celles de l'homme produisant le spermatozoïde, ou les deux, suggèrent que leur progéniture sera très probablement atteinte d'une maladie génétique grave ou qu'elle présentera une anomalie très probablement à l'origine d'une mortinaissance ou d'une fausse-couche. En ce qui concerne les autres exigences relatives à un diagnostic génétique préimplantatoire, il est fait référence à l'article 3a, paragraphes 2 et 3, de la loi sur la protection de l'embryon (Embryo Protection Act). Dans ces cas, l'exécution de la PMA dépend du résultat du diagnostic génétique préimplantatoire.
c. Autres
Conformément à l'article 6, paragraphe 2, de la loi sur la réglementation des tissus et des cellules, l'utilisation de spermatozoïdes pour la fécondation hétérologue, en tant que technique de procréation médicalement assistée, exige que le donneur de sperme soit jugé médicalement apte au don de sperme, eu égard à son âge, à son état de santé et à ses antécédents médicaux, et que l'utilisation du sperme donné ne présente pas de risques pour la santé d'autrui. Les donneurs de sperme sont sélectionnés selon les critères et les tests de laboratoire définis à l'annexe 4, numéros 2 et 3, du règlement sur les tissus et les cellules de la loi sur la transplantation. L'annexe 4 a transposé en droit national les critères de sélection et les tests de laboratoire pour les donneurs de cellules reproductrices définis à l'annexe III de la directive 2006/17/CE du 8 février 2006 relative à certaines exigences techniques concernant le don, l'obtention et le contrôle de tissus et de cellules d'origine humaine. À cette fin, les échantillons de sérum ou de plasma des donneurs doivent notamment être testés et s'avérer négatifs pour le VIH 1 et 2, le VHC, le VHB et la syphilis. En outre, les échantillons d'urine des donneurs de sperme doivent être testés et déclarés négatifs pour la chlamydia par la technique d'amplification de l'acide nucléique (NAT).

Norvège - Aspects juridiques

Comme cela est inscrit dans le code de la santé publique, aucun paiement, quelle qu'en soit la forme, ne peut être alloué à celui qui se prête au prélèvement d'éléments de son corps ou à la collecte de ses produits.
Cependant les frais afférents au prélèvement ou à la collecte sont intégralement pris en charge par l'établissement de santé chargé d'effectuer le prélèvement ou la collecte. Les donneuses d’ovocyte bénéficient de l’exonération du ticket modérateur pendant 6 mois pour l’ensemble des soins et traitements afférents au don.

Le recrutement des donneurs tient compte de l'âge, de l'état de santé, des antécédents personnels et familiaux, des résultats des tests sanitaires, des caractéristiques spermatiques ou du bilan gynécologique (notamment évaluation de la fonction ovarienne).
Un entretien psychologique est effectué.
Une étude complète et documentée de l'arbre généalogique du donneur de gamètes est réalisée pour identifier les facteurs de risque de transmission à l'enfant d'une anomalie génétique. Toute suspicion d'anomalie incite à compléter le bilan. Un caryotype est réalisé.
Les limites d’âge fixées par l’arrêté de bonnes pratiques en PMA sont de 18 à 45 ans pour les donneurs et 18 à 37 ans pour les donneuses.
Depuis la loi n°2021-1017 du 2 août 2021 relative à la bioéthique, le donneur devra consentir expressément et au préalable à la communication de ses données non identifiantes (âge, état général, caractéristiques physiques, situation familiales et professionnelle, pays de naissance, motivation du don) et à son identité à la personne issue de son don (sur demande de cette dernière). En cas de refus, les personnes souhaitant donner ne peuvent procéder au don.
9. Existe-t-il des critères non médicaux spécifiques pour la sélection des gamètes/de l’embryon devant être utilisé(s) pour une procédure de PMA? Oui. Un appariement sur critères phénotypiques (caractéristiques physiques, groupe sanguin) entre le couple receveur et le(s) donneur(s)est possible. Il est facultatif et proposé aux demandeurs.
10. Des mesures particulières sont-elles prises pour prévenir le risque de consanguinité ? Oui. Le recours aux gamètes d'un même donneur ne peut conduire à la naissance de plus de dix enfants. Ce contrôle est exercé par l’Agence de la biomédecine.
11. Dans un couple homosexuel, un lien juridique est-il possible entre un enfant et le/la partenaire de son parent légal ? Oui.
Le/la partenaire du parent légal peut également adopter (adoption simple ou plénière) l’enfant de son/sa conjointe, de son/sa partenaire lié(e) par un pacte civil de solidarité ou de son/sa concubine. La loi n° 2022-219 du 21 février 2022 visant à réformer l'adoption a, en effet, ouvert l’adoption aux couples non mariés.
France - Aspects médicaux
2. Des critères spécifiques sont-ils retenus pour l’accès à la PMA ?
Depuis la loi n°2021-1017 du 2 août 2021 relative à la bioéthique, l'assistance médicale à la procréation n’est plus conditionnée à des critères médicaux. Les critères liés à l’infertilité pathologique médicalement constatée ou à la transmission d’une maladie d’une particulière gravité, qui conditionnaient l’accès à l’AMP, ont été supprimés. La recours à l’AMP est désormais conditionné à l’existence d’un projet parental (article L. 2141-2 du code de la santé publique).

Grèce - Réglementation ou pratique et accès à la PMA
Deux lois sont maintenant en vigueur en Grèce :
La Loi réglemente pour l’essentiel la question de l’établissement de la filiation de l’enfant à naître à la suite d’une procédure de procréation médicalement assistée (PMA). De plus, elle légalise l’insémination post-mortem et la maternité de substitution, sous certaines conditions spécifiées dans les articles pertinents.

La loi 3305 relative à la procréation médicalement assistée en Grèce a été adoptée en 2005. Cette loi, qui régit principalement le fonctionnement des unités de PMA, vient en complément de la précédente loi 3089, laquelle réglemente pour l’essentiel la question de l’établissement de la filiation de l’enfant à naître. Elle porte sur les méthodes de PMA, les conditions de demande, les questions de consentement éclairé, la cryoconservation des gamètes, le don de gamètes, la recherche sur les embryons, la maternité de substitution, la traçabilité, etc. La loi prévoit par ailleurs des sanctions administratives et pénales pour ceux qui n’en respecteraient pas les dispositions. Elle met également en place le mécanisme de contrôle compétent, à savoir L’autorité Nationale pour la PMA. Aux termes de cette loi, les méthodes de PMA sont appliquées de manière à garantir le respect de la liberté de l’individu et du droit au développement de la personnalité (un droit protégé par la Constitution grecque), ainsi que la satisfaction du désir d’enfant, conformément aux principes de la bioéthique. La loi dispose en outre que l’application de ces méthodes doit toujours tenir compte du bien-être de l’enfant à naître. |

Il n’y a pas de loi spécifique dans la République de Saint Marin. En cas d’infertilité, les couples hétérosexuels sont assurés d’être mis en contact avec les centres de références italiens pour accéder aux procédures de PMA. Toutes les réponses aux questions relatives à la PMA y compris l’éventuel don de gamètes, sont les mêmes que pour l’Italie.
Norvège - Don de sperme/d'ovocyte/d'embryon
6. Est-il possible, dans votre pays, de procéder à un don de sperme ? Oui / d’ovocyte ? Oui / c. d’embryon ? Non.
Les embryons donnés ne peuvent être utilisés qu'à des fins de recherche in vitro, et non pour la reproduction assistée.
L'utilisation simultanée d'un ovule et d'un sperme donnés n'est pas autorisée. Une exception a été faite pour les couples de lesbiennes afin qu'un ovocyte puisse être prélevé sur l'une des femmes, fécondé avec le sperme d'un donneur et que l'embryon résultant soit implanté dans l'utérus de l'autre femme du couple.
7. Des mesures de compensation sont-elles prévues pour de tels dons ? Oui. Les directives nationales fixent le montant maximal de l'indemnisation des donneurs. Outre les frais de déplacement documentés, les donneurs de sperme peuvent recevoir 750 NOK et les donneurs d'ovocytes 5300 NOK par don. Les montants ont été fixés afin de dédommager les donneurs pour le temps qu'ils consacrent au don et les éventuels désagréments qu'il entraîne.
8. Des critères spécifiques sont-ils définis pour effectuer un don de sperme ? Oui/ d’ovocyte ? Oui/ d’embryon ? Non.
Critères pour le don de sperme :
- bonne santé (à la fois physique et mentale) et sperme « normal »
- pas de maladie contagieuse connue (comme l'exigent les directives européennes sur la qualité et la sécurité des tissus et des cellules)
- pas de maladie héréditaire grave connue (sur la base des informations fournies par le donneur. Il ne sera réalisé aucune analyse chromosomique ou autres tests pour les maladies déterminées par un seul gène) ;
- doit être âgé de plus de 18 ans et, dans l’idéal, entre 25 et 45 ans
Critères pour le don d'ovocytes :
- - bonne santé (physique et mentale) et réserves ovocytaires "normales", statut hormonal et absence d'indication d'infertilité à l'échographie
- - aucune maladie héréditaire grave connue (sur la base des informations fournies par la donneuse. Aucune analyse chromosomique ni aucun test pour des troubles monogéniques ne seront effectués)
- - doit être âgée de 25 à 35 ans
Pour empêcher l’utilisation de sperme prélevé sur des donneurs malades et veiller à ce que les renseignements sur le donneur (nom, adresse) puissent être transmis à l’enfant lorsqu'il atteigne l'âge de 15 ans, le donneur doit avoir la citoyenneté norvégienne ou posséder un permis de résidence permanente.
Un entretien sera organisé avec le donneur pour s’assurer la décision du donneur a la maturité et la motivation altruiste nécessaires et de s'assurer que le donneur comprend les conséquences et est informé que les futurs enfants peuvent prendre contact. Le donneur doit donner son consentement écrit. Si le consentement est retiré, les spermatozoïdes/ovocytes non utilisés doivent être détruits.
Le don d’embryons est interdit.
L’évaluation des donneurs suit les procédures et critères établis par les Directives de l’UE sur les tissus et les cellules.
9. Existe-t-il des critères non médicaux spécifiques pour la sélection des gamètes/de l’embryon devant être utilisé(s) pour une procédure de PMA? Oui. La loi sur la biotechnologie exige que le médecin traitant choisisse un donneur approprié. Il est recommandé que le médecin choisisse un donneur qui a une ressemblance physique étroite avec les futurs parents. Les donneurs ne doivent pas être choisis en fonction d'autres critères.
10. Des mesures particulières sont-elles prises pour prévenir le risque de consanguinité ? Oui.
Un registre national des donneurs a été créé pour permettre aux enfants conçus en Norvège grâce à un don de sperme ou d'ovocytes de connaître l'identité du donneur lorsqu'ils atteignent l'âge de 15 ans (ou 18 ans pour ceux nés de gamètes donnés avant 2021),
Le sperme d'un donneur peut être utilisé par 6 familles au maximum, ceci est précisé dans le formulaire de consentement. Le nombre de cycles de don pour une donneuse d'ovocytes est limité à 3. Il n'y a pas de nombre maximum de familles.
11. Dans un couple homosexuel, un lien juridique est-il possible entre un enfant et le/la partenaire de son parent légal ? Oui. Des règles relatives au statut de parent de la deuxième mère (celle qui ne donne pas naissance à l’enfant) ont été établies.
Royaume-Uni - Don de sperme/d’ovocyte/d’embryon
6. Le don de spermatozoïdes/ovocytes/embryons est-il autorisé dans votre pays ? Oui
7. Des mesures de compensation sont-elles prévues pour le don de spermatozoïdes/ovocytes/embryons ? Oui.
L’HFEA autorise les centres de soins agréés au Royaume-Uni à verser une indemnité aux donneuses d’ovocytes à hauteur de 750 £ par cycle de don et jusqu’à 35 £ par visite au centre pour les donneurs de sperme. Des orientations en la matière sont fournies aux centres de soins dans le Code de pratique de l’HFEA (https://www.hfea.gov.uk/media/2793/2019-01-03-code-of-practice-9th-edition-v2.pdf) et dans les Directives générales de l’HFEA (http://ifqtesting.blob.core.windows.net/umbraco-website/1547/2017-04-03-general-direction-0001-version-4-final.pdf).
L’HFEA autorise également les avantages en nature, par exemple les conventions de partage d’ovocytes par lesquelles une femme ayant besoin d’une FIV accepte de partager des ovocytes avec une autre femme ayant besoin d’un don d’ovocytes en échange de la gratuité du traitement ou d’une diminution de son coût. Les cliniques se référeront aux lignes directrices professionnelles applicables en ce qui concerne les limites d’âge avant d’accepter des gamètes pour le traitement d’autres patients. Les gamètes destinés au traitement d’autres patients ne doivent pas être prélevés sur un donneur de moins de 18 ans. Un donneur ne doit pas être sélectionné en raison d’une anomalie génétique, chromosomique ou mitochondriale particulière qui, si elle était héritée par l’enfant né à la suite du don, entraînerait chez cet enfant :
a) un handicap physique ou mental grave,
b) une maladie grave,
c) toute autre affection grave.
L’utilisation de gamètes issus de donneurs dont il est établi qu’ils présentent une telle anomalie doit faire l’objet d’une évaluation tenant compte du bien-être de tout enfant à naître et doit recueillir l’approbation d’une commission d’éthique.
9. Existe-t-il des critères non médicaux spécifiques pour la sélection des gamètes/de l’embryon devant être utilisé(s) pour une procédure de PMA (par exemple, correspondance entre l’apparence physique du (des) donneur(s) et des futurs parents) ? Oui. Les centres n’ont aucune obligation d’assurer la compatibilité entre receveur et donneur sur le plan de l’origine ethnique. Lorsqu’un receveur potentiel est disposé à accepter un don d’un donneur d’une origine ethnique différente, le centre peut proposer le traitement sous réserve d’une évaluation du bien-être de l’enfant.
10. Des mesures particulières sont-elles prises pour prévenir le risque de consanguinité ? Oui. L’HFEA tient un registre des donneurs et des patients qui ont eu un enfant en faisant appel à un don de gamètes. Une personne née d’un don qui souhaite avoir des relations physiques intimes avec une autre personne née d’un don peut présenter, avec celle-ci, une demande conjointe à l’HFEA afin de déterminer si elles sont génétiquement liées. De même, les personnes qui souhaitent se marier ou conclure un partenariat civil peuvent soumettre une demande conjointe pour établir si elles sont génétiquement liées. Les dons d’un même donneur ne peuvent être utilisés que pour un maximum de 10 familles. Le donneur en question ne peut plus faire de dons une fois que cette limite est atteinte, notamment pour réduire le risque de consanguinité.
11. Dans un couple homosexuel, un lien juridique est-il possible entre un enfant et le/la partenaire de son parent légal ? Oui.
Les dispositions juridiques relatives aux conditions à remplir pour qu’une personne soit le parent légal d’un enfant figurent dans la Loi sur l’HFEA.
Lorsqu’une femme ayant conclu un partenariat civil demande à bénéficier d’un don de sperme ou à recevoir un embryon créé à partir d’un don de sperme, le partenaire civil de la femme sera considéré comme le parent légal de tout enfant né du traitement, sauf si, au moment du transfert d’embryon ou de gamètes ou de l’insémination :
a) une ordonnance de séparation était en vigueur ou
b) il est démontré que le partenaire n’avait pas donné son consentement au transfert d’embryon ou de gamètes ou à l’insémination.
Lorsqu’une femme en couple (mais pas en partenariat civil) avec une femme bénéficie d’un traitement au moyen d’un don de sperme, ou d’un embryon créé à partir d’un don de sperme, sa partenaire sera considérée comme l’autre parent légal de l’enfant éventuel si les conditions suivantes sont remplies au moment du transfert d’embryon ou de gamètes ou de l’insémination :
a) la femme et sa partenaire ont informé le centre par notification écrite et signée (exceptions en cas de maladie, de lésions ou de handicap physique) du consentement de la partenaire à être considérée comme le parent de tout enfant éventuel,
b) aucune des deux partenaires n’a retiré son consentement (ou envoyé une notification écrite annulant et remplaçant le consentement) avant l’insémination/le transfert, et
c) la patiente et sa partenaire ne sont pas en parenté proche (les degrés de parenté interdits étant définis à l’article 58(2), partie 2, de la Loi 2008 sur HFE).

Il n’y a pas encore de jurisprudence concernant la procréation médicalement assistée.
Malheureusement, le seul texte disponible en anglais est le projet de loi, légèrement différent de la version qui a été adoptée.
Croatie - Aspects financiers
3. Les procédures de PMA sont-elles prises en charge par le système de sécurité sociale ? Yes. L’infertilité est définie comme une maladie.
4. Cette prise en charge est-elle soumise à des critères particuliers (par exemple, infertilité, limite d’âge) ? Yes. Les procédures sont prises en charge pour les couples infertiles (l’infertilité est considérée comme une pathologie), pour les femmes jusqu’à 42 ans (âge naturel de procréation, estimé par le corps médical).
5. Le nombre de procédures de PMA prises en charge est-il limité (par exemple, uniquement trois tentatives de FIV) ? Le régime d’assurance santé prend en charge jusqu’à 4 procédures d’insémination intra-utérine (IIU) et jusqu’à 6 procédures de fécondation in vitro (FIV).

Slovénie - Don de sperme/d’ovocyte/d’embryon
6. Est-il possible, dans votre pays, de procéder à un don de sperme ? Oui d’ovocyte ? Oui c. d’embryon ? Non. Le don d’embryon, ainsi que les procédures de PMA avec double don de gamètes sont interdits (articles 13 et 7), sur la base du principe selon lequel l’enfant issu d’une procédure de PMA devrait avoir des liens génétiques avec l’un au moins de ses parents.
7. Des mesures de compensation sont-elles prévues pour de tels dons ? Non. Les rémunérations financières sont formellement interdites. Les dépenses engendrées par le don sont toutefois remboursées (article 10).
8. Des critères spécifiques sont-ils définis pour effectuer un don de sperme ? Oui d’ovocyte ? Oui d’embryon ? -
Une personne ne peut donner ses gamètes qu’à un seul centre (article 11).
Le donneur doit être majeur et en bonne santé physique et mentale (article 14).
Les gamètes d’un don ne peuvent pas être utilisés dans les cas où cela créerait un problème de consanguinité illicite (article 14).
9. Existe-t-il des critères non médicaux spécifiques pour la sélection des gamètes/de l’embryon devant être utilisé(s) pour une procédure de PMA? Non. Ces critères non médicaux ne figurent pas dans la loi, mais peuvent être pris en considération dans la pratique, si les circonstances le permettent.
10. Des mesures particulières sont-elles prises pour prévenir le risque de consanguinité ? Oui. Les gamètes provenant d’un don peuvent être utilisés jusqu’à la naissance d’enfants dans deux familles différentes (article 29).
11. Dans un couple homosexuel, un lien juridique est-il possible entre un enfant et le/la partenaire de son parent légal ? Pas de disposition juridique en la matière.
