La Donation n’est jamais à caractère lucratif ou commercial. Cependant, une compensation économique est possible pour compenser strictement les inconvénients physiques et les dépenses pour déplacement et de travail qui se dérivent de la donation. Cette compensation ne peut pas constituer une motivation économique. Les conditions doivent se fixer règlementairement.
8. Des critères spécifiques sont-ils définis pour effectuer un don de sperme ? d’ovocyte ? d’embryon ?
Les donnants de gamètes féminins et masculins doivent avoir plus de 18 ans et pas plus de 37 ans pour les féminins et 45 pour les masculins. De plus ; ils doivent être en bonne santé. Le nombre maximum autorisé des enfants nés de personnes de nationalité andorrane ou résidents à Andorre du même donnant de gamètes est limité à 1, à moins qu’il s’agisse du procès reproductif de la même réceptrice. Pour les étrangers non-résidents le nombre maximal ne peut être supérieur à 3.
