En 2015, la Cour suprême de Hongrie (Kúria) a examiné une affaire de contestation de paternité après une procédure de PMA au motif que le conjoint n’avait pas donné son consentement à l’intervention de PMA.
Le couple marié s’était séparé peu après la naissance de l’enfant. L’homme et la femme avaient décidé d’un commun accord d’avoir un enfant par PMA. Le mari séparé contestait sa paternité car un test ADN excluait sa paternité biologique mais confirmait la maternité biologique de la mère. La Cour a accepté la requête de l’ex-mari demandant à ne pas être reconnu comme le père car ce dernier avait donné son consentement à la procréation médicalement assistée mais pas à l’intervention proprement dite ; le document de consentement n’indiquait pas que le sperme pouvait venir d’un autre donneur. La base du jugement n’a pas été le fait qu’il ne pouvait pas être le père biologique mais l’absence d’une déclaration de consentement légalement valide. (Affaire EBH2015 P.8.)

Les dons de spermatozoïdes et d'ovocytes sont autorisés. Le don d'embryon sera autorisé à partir du 1er janvier 2019 si un couple ou une femme célibataire donne son consentement écrit, s'ils ont des enfants, l'un d'eux est génétiquement lié à l'embryon et qu'ils sont informés des conséquences du don; que leurs enfants peuvent avoir des frères et sœurs génétiques dans une autre famille et auront le droit de connaître leur origine. Tout tiers donneur ne doit consentir spécifiquement au don d’embryon que s’il a fait un don avant que la loi ne soit modifiée, c’est-à-dire avant le 1er janvier 2019.

L’évaluation du donneur se porte sur différents critères. Il/elle doit être en bonne santé physique et mentale. Il/elle doit être conscient(e) des conséquences du don : il/elle n’a aucun pouvoir sur l’enfant conçu et ne doit pas éprouver de regrets ; il est préférable qu’il/elle ait un réseau de relations avec qui partager toute réflexion ; il/elle doit accepter la possibilité que l’enfant demande à connaître son identité et le/la contacte, le don n’étant pas anonyme en droit suédois. Le donneur doit être âgé de plus de 18 ans et l’appréciation de son degré de maturité se fait suivant les critères précédents. Le donneur/la donneuse doit donner son consentement écrit et a la possibilité de le retirer avant la fécondation de l’ovocyte.
Le donneur/la donneuse doit être vivant€ au moment de la fécondation.

Dans la récente publication Olika vägar till föräldraskap (SOU 2016:11), du 24 février 2016, une enquête publique a été lancée pour examiner différents moyens d’accroître les possibilités offertes aux personnes demeurant involontairement sans enfants, de devenir parents. Un changement à la législation entré en vigueur le 1er avril est l’accès à la PMA pour les femmes célibataires. L’enquête a proposé de ne plus exiger de lien génétique entre l’enfant et l’un des parents ; cela signifierait que le don d’embryon serait possible. L’enquête portait également sur l’opportunité d’autoriser la maternité de substitution à visée altruiste en Suède. Elle a conclu que ni la maternité de substitution à visée altruiste, ni la maternité de substitution dans un but lucratif ne devaient être autorisées et que la société devait également combattre ce type de pratiques. Le rapport final a été présenté à un grand nombre d’acteurs, d’organisations et d’autorités, qui rendront leurs commentaires pour le 23 juin 2016.
Dans une nouvelle enquête gouvernementale suivie par une proposition de loi du gouvernement le 15 mars 2018 intitulée « Modernare regler om assisterad befruktning och föräldraskap » (proposition 2017/18:155), qui est entrée en vigueur le 1 er janvier 2019, le législateur a rendu le don d'embryon possible. Un couple ou une femme célibataire peut donner des œufs fécondés s'ils ont déjà des enfants et si l'œuf est génétiquement lié à l'un d'entre eux (ou à la femelle célibataire). Les enfants issus d'un don d'embryons ont le droit de saisir leurs informations personnelles dans le registre spécial et de les conserver pendant 70 ans, afin que tous les frères et sœurs génétiques puissent être retrouvés sur demande.

Les embryons congelés, fertilisés résultant d’un don d’ovocyte d’une même donneuse, dont les dons ont conduits à plus de douze grossesses viables, peuvent continuer à être utilisés.

En décembre 2013, la loi sur les enfants a été amendée avec des règles sur la co-maternité. La co-maternité peut être établie quand la mère a fait l’objet d’un traitement de procréation médicalement assistée et a une épouse ou une partenaire qui a consenti au traitement.
Dans d’autre cas, les couples homosexuels ont les mêmes droits à l’adoption que les couples hétérosexuels, qui incluent aussi la possibilité d’adoption de l’enfant de son partenaire.

Les dons sont codés. L’autorité compétente tient un registre des dons de gamètes et d’embryons pour la PMA.

Si un enfant né sous PMA désire connaitre l’identité du donneur, il ou elle pourra avoir accès à l’information après ses 18 ans.
Lorsque la PMA a été proposée à une femme qui n’est pas mariée ou en couple comparable à un mariage hétérosexuel (après avril 2019 ; une femme qui n’est pas mariée, vivant en partenariat enregistré ou en relation comparable à celles-ci ; n’importe du fait si son partenaire est du sexe opposite ou pas) et que le donneur a donné son consentement à être inscrit en tant que père de l’enfant, la mère et l’enfant peuvent obtenir auprès du centre de PMA le code du donneur qui leur permettra de connaître l’identité de celui-ci en consultant le registre des dons. Conformément au Code de procédure judiciaire, les tribunaux n’ont pas accès aux données sensibles en matière de santé, à moins que la personne qui bénéficie du secret médical n’y donne son consentement ou en cas de décès de cette dernière, si des raisons impérieuses l’exigent. Font exception à cette règle les cas dans lesquels le procureur a engagé des poursuites pour une infraction passible d’une peine d’emprisonnement d’au moins six ans.

Comme indiqué ci-dessus, la question du MAP figure parmi les priorités politiques et publiques de Bosnie-Herzégovine. Cependant, aucune législation spécifique n'a encore été approuvée, en raison de l'opposition des partis conservateurs et de l'influence de l'église. Les principaux débats et controverses portent sur l’octroi des droits de la PMA aux femmes célibataires, ainsi que sur les questions liées à la procréation hétérologue (don de spermatozoïdes / ovocytes).

Sperme, ovocyte: la Loi sur les traitements de l’infertilité (laki hedelmöityshoidoista ; 1237/2006) exige que le donneur soit âgé d’au moins 18 ans. Dans la pratique, des limites d’âge à ne pas dépasser ont été définies par les centres de traitement et peuvent varier de l’un à l’autre. Le don de gamètes ne doit pas comporter de risque pour la santé du donneur et ce dernier ne doit pas présenter de maladie héréditaire grave ou de maladie transmissible susceptible de provoquer une pathologie grave chez la femme qui bénéficie du traitement de l’infertilité ou de l’enfant pouvant être issu de ce traitement. Un examen de santé du donneur permet de veiller au respect de ces critères. Le consentement éclairé est requis. Un donneur peut donner son consentement spécifique à l’utilisation du sperme pour des procédures de PMA concernant des femmes célibataires.
embryon: Seuls les embryons surnuméraires issus d’une procédure de PMA peuvent faire l’objet d’un don, avec le consentement éclairé des deux donneurs.
9. Existe-t-il des critères non médicaux spécifiques pour la sélection des gamètes/de l’embryon devant être utilisé(s) pour une procédure de PMA? Oui. En ce qui concerne l’utilisation de gamètes issus de dons, la section 5 de la Loi sur les traitements de l’infertilité (laki hedelmöityshoidoista ; 1237/2006) exige du médecin responsable qu’il sélectionne les gamètes d’un donneur dont l’apparence physique correspond à celle du parent de l’enfant à naître, sauf demande contraire du bénéficiaire du traitement.
10. Des mesures particulières sont-elles prises pour prévenir le risque de consanguinité ? Oui. Les gamètes d’un même donneur ne peuvent être utilisés pour permettre à plus de cinq receveurs bénéficiant d’une PMA de procréer.

Si les membres d’un couple homosexuel ont enregistré leur partenariat, l’un peut adopter les enfants de l’autre. Selon la nouvelle Loi sur la Maternité, qui est entrée en vigueur le 1er avril 2109, la maternité d’une partenaire dans un couple homosexuel femme peut être reconnue sur la base d’un consentement valide aux traitements de fertilité.
3. Les procédures de PMA sont-elles prises en charge par le système de sécurité sociale ? Oui. Les services publics de santé incluent les procédures de PMA. Conformément à la loi sur l’assurance santé (sairausvakuutuslaki ; 1224/2004), l’assurance santé prend en charge le coût des soins médicaux nécessaires lorsque l’infertilité est due à une pathologie. L’infertilité est également assimilée à une pathologie lorsque la grossesse ne débute pas dans un délai d’un an au sein d’une relation permanente. La prise en charge concerne également les hommes.
4. Cette prise en charge est-elle soumise à des critères particuliers (par exemple, infertilité, limite d’âge) ? Oui. Conformément aux recommandations de pratique du Comité consultatif socio-médical de l’institution d’assurance maladie de Finlande, les procédures de PMA sont accessibles aux femmes jusqu’à 40 ans dans le système public de santé. Les femmes de plus de 40 ans sont également traitées si le pronostic est bon. Les frais sont remboursés par le régime d’assurance maladie jusqu’à l’âge de 43 ans. Pour les femmes plus âgées, la couverture d’assurance maladie est examinée au cas par cas compte tenu des données médicales de la patiente en question.

La prise en charge des frais n’est pas limitée dans la loi. Le nombre de procédures de PMA est toutefois limité à trois dans la pratique de l’institution d’assurance sociale de Finlande, car selon les statistiques, les chances de réussite diminuent au-delà.
L’infertilité découlant d’une diminution du nombre de gamètes liée à l’âge n’est pas considérée comme une pathologie et ne bénéficie donc pas d’une prise en charge par l’assurance maladie dans le cadre des soins médicaux indispensables. Les procédures de PMA après stérilisation ne sont généralement pas couvertes. Les coûts éventuels supportés par un donneur ne sont pas pris en charge car ils ne sont pas liés au traitement de la pathologie du donneur.
Pour les demandeurs de plus de 43 ans, la prise en charge des procédures de PMA fait l’objet d’une décision au cas par cas. Une demande de remboursement des frais encourus pour les médicaments et la procédure elle-même doit être adressée à l’institution d’assurance sociale de Finlande. Elle doit être accompagnée d’une certificat médical établi par le médecin qui met en œuvre le traitement.

Les raisons médicales servent de critères pour l’accès à la PMA dans le système public de santé. Dans la pratique, les raisons de l’infertilité ne sont pas toujours connues et cela n’empêche pas les centres spécialisés du secteur public de donner accès au traitement, en particulier aux couples hétérosexuels (autrement dit, l’accès au traitement ne repose pas toujours sur un état pathologique diagnostiqué). Un autre motif invoqué pour refuser l’accès à la PMA aux couples de lesbiennes et aux femmes célibataires est le manque de gamètes disponibles issus de dons. Ces critères ne sont toutefois pas prévus dans la législation.
