6. Est-il possible, dans votre pays, de procéder à un don de sperme ? Oui / d’ovocyte ? Oui / c. d’embryon ? Oui
Le don de gamètes (sperme et ovocytes) et d’ovules fécondés (uniquement les ovules fécondés surnuméraires) n’est autorisé qu’avec le consentement du donneur.
7. Des mesures de compensation sont-elles prévues pour de tels dons ? Oui. Selon la Loi 3305/05 (article 8, paragraphe 1) « Toute rémunération ou indemnité pour un don de gamètes et d’ovule fécondé est interdite. Cependant, les frais médicaux, les soins ou les frais de laboratoire, les frais de déplacement et d’hébergement, ainsi que l’absence au travail, peuvent donner lieu à un dédommagement ».
L’Autorité nationale pour la PMA a adopté par la suite une décision (Décision n°36, Journal officiel 670 B’ 16.4.2008) qui prévoit une compensation pour les frais médicaux, les soins et les frais de laboratoire engagés avant et après le don. Les frais d’hébergement et de transport peuvent également faire l’objet d’une compensation. Ce montant ne doit pas dépasser 200 € pour un don de sperme et 600 € pour un don d’ovocyte. Une compensation pour absence au travail est également possible.
8. Des critères spécifiques sont-ils définis pour effectuer un don de sperme ? Oui / d’ovocyte ? Oui / d’embryon ? Oui
Les donneurs doivent avoir atteint l’âge de la majorité et être dotés de la pleine capacité juridique. Ils doivent être âgés de moins de 40 ans pour les dons de sperme et de moins de 35 ans pour les dons d’ovocytes. Sur autorisation de l’Autorité nationale pour la PMA, ces limites d’âge peuvent être étendues à 50 et 40 ans respectivement, dans le cas d’un don d’ovule fécondé ou s’il existe des motifs sérieux de le faire. Dans ce cas, des informations spécifiques doivent être fournies aux receveurs sur le risque accru de maladies génétiques, ainsi que sur la nécessité d’un examen prénatal.
Les donneurs sont soumis à des examens médicaux et de laboratoire spécifiques définis par l’Autorité nationale (eu égard aux évolutions scientifiques).
9. Existe-t-il des critères non médicaux spécifiques pour la sélection des gamètes/de l’embryon devant être utilisé(s) pour une procédure de PMA? Oui. Aux termes de la loi, la sélection du donneur relève de la responsabilité de l’unité de PMA. Au cours de cette sélection, d’autres critères tels que le groupe sanguin (Rhésus), ainsi que les caractéristiques phénotypiques, sont pris en considération. Les mêmes critères s’appliquent au don d’ovules fécondés.
10. Des mesures particulières sont-elles prises pour prévenir le risque de consanguinité ? Oui. Le nombre d’enfants issus des gamètes d’un même donneur ne doit pas être supérieur à 10 ; cette limite peut toutefois être dépassée en vue de la naissance d’un nouvel enfant dans un couple qui aurait déjà eu un enfant issu des gamètes de ce donneur. L’Autorité nationale peut définir le nombre exact d’enfants pouvant être issus des gamètes d’un même donneur, en fonction de la population de chaque région et d’autres conditions spécifiques.

11. Dans un couple homosexuel, un lien juridique est-il possible entre un enfant et le/la partenaire de son parent légal ? Non. La loi ne contient aucune disposition applicable aux couples homosexuels.
