En général tous les hommes peuvent donner leur sperme et toutes les femmes peuvent donner leurs ovocytes, si cela n’implique pas de risque génétique ou infectieux grave. Les établissements en charge des tests, du traitement, de la préservation, de la conservation ou de la distribution des tissues et des cellules d’origine humaine ont la responsabilité d’assurer la qualité du sperme et des ovocytes. Le don d’embryon n’est possible que pour la recherche, pas à des fins de procréation assistée.
7. Des mesures de compensation sont-elles prévues pour de tels dons ? Non. La vente ou toute forme d’assistance à la vente d’ovocytes non fertilisés ou fertilisés ne sont pas autorisées. La compensation du donneur pour un don d’ovocyte est donc limitée aux dépenses effectives impliquées et aux inconvénients directement liés au don.

Un donneur de sperme ne peut avoir plus de douze descendants.
Dans les cas où le(la) donneur(se) (sperme ou ovocyte) a plus de douze descendants, il(elle) peut tout de même effectuer un don dans le cadre d’une procédure de PMA en vue de la naissance d’un frère ou d’une sœur, si une femme seule ou un membre du couple a déjà un enfant grâce à un don de ce(tte) même donneur(se).
Les embryons congelés, fertilisés résultant d’un don d’ovocyte d’une même donneuse, dont les dons ont conduits à plus de douze grossesses viables, peuvent continuer à être utilisés.

11. Dans un couple homosexuel, un lien juridique est-il possible entre un enfant et le/la partenaire de son parent légal ? Oui.
En décembre 2013, la loi sur les enfants a été amendée avec des règles sur la co-maternité. La co-maternité peut être établie quand la mère a fait l’objet d’un traitement de procréation médicalement assistée et a une épouse ou une partenaire qui a consenti au traitement.
Dans d’autre cas, les couples homosexuels ont les mêmes droits à l’adoption que les couples hétérosexuels, qui incluent aussi la possibilité d’adoption de l’enfant de son partenaire.
Les procédures de PMA sont-elles prises en charge par le système de sécurité sociale ?
Les coûts liés à l’ensemble des activités de laboratoire requises pour l’insémination d’ovules par FIV/ICSI ne sont pas facturés à la patiente si elle est âgée de moins de 43 ans, pour un maximum de 6 cycles par femme (Arrêté royal du 25 avril 2002, relatif à la fixation et à la liquidation du budget des moyens financiers des hôpitaux, art. 74 bis). La logique qui sous-tend cette réglementation est de considérer qu’à partir de 43 ans, il existe peu de chances que la PMA aboutisse.
Depuis 2008 (Arrêté royal du 6 octobre 2008 instaurant un remboursement forfaitaire pour les traitements de l’infertilité féminine), l’assurance-maladie invalidité octroie également un remboursement forfaitaire pour les spécialités pharmaceutiques prescrites par un gynécologue et délivrées dans un hôpital, qui sont utilisées dans le cadre d’une insémination intra-utérine ou d’une stimulation ovarienne. La femme doit être âgée de moins de 43 ans et le remboursement n’est possible que pour un maximum de 6 cycles/traitements menés à terme. Une partie des coûts reste à charge de la patiente.
En ce qui concerne les autres prestations dans le cadre d’une procréation médicalement assistée, elles sont partiellement couvertes par l’assurance maladie-invalidité (ex. transfert d’embryon après fécondation in vitro) : Une partie des coûts reste à charge de la patiente.
Cette prise en charge est-elle soumise à des critères particuliers ?
L'âge maximum de la femme fixé à 42 ans en raison des très faibles chances de succès au-delà.
Le nombre de procédures de PMA prises en charge est-il limité ?
La limite est fixée à quatre procédures de FIV, mais si une grossesse se produit, il est possible de bénéficier à nouveau de quatre procédures de FIV.

Le consentement écrit du donneur est nécessaire. Le don ne peut être réalisé que dans un hôpital dûment autorisé. Limite d’âge pour le don d’ovocyte : 30 ans (donneur), 45 ans (receveur).

10. Des mesures particulières sont-elles prises pour prévenir le risque de consanguinité ? Oui. Le sperme d’un donneur ou les ovocytes d’une donneuse ne pourront être utilisés que par trois couples. Un donneur ne pourra faire un don que dans un seul centre.
11. Dans un couple homosexuel, un lien juridique est-il possible entre un enfant et le/la partenaire de son parent légal ? Oui. La partenaire de la mère légale est automatiquement l’autre parent de l’enfant si cette partenaire a donné son consentement écrit pour la PMA avec un don de sperme.
Le sujet des mères porteuses revient régulièrement au Parlement. Plusieurs propositions ont été faites, dont certaines ne traitent que de la maternité de substitution dans le cadre de la procréation médicalement assistée.

L’HFEA autorise les centres de soins agréés au Royaume-Uni à verser une indemnité aux donneuses d’ovocytes à hauteur de 750 £ par cycle de don et jusqu’à 35 £ par visite au centre pour les donneurs de sperme. L’HFEA autorise également les avantages en nature, par exemple les conventions de partage d’ovocytes par lesquelles une femme ayant besoin d’une FIV accepte de partager des ovocytes avec une autre femme ayant besoin d’un don d’ovocytes en échange de la gratuité du traitement ou d’une diminution de son coût. Les cliniques se référeront aux lignes directrices professionnelles applicables en ce qui concerne les limites d’âge avant d’accepter des gamètes pour le traitement d’autres patients. Les gamètes destinés au traitement d’autres patients ne doivent pas être prélevés sur un donneur de moins de 18 ans. Un donneur ne doit pas être sélectionné en raison d’une anomalie génétique, chromosomique ou mitochondriale particulière qui, si elle était héritée par l’enfant né à la suite du don, entraînerait chez cet enfant :
a) un handicap physique ou mental grave,
b) une maladie grave,
c) toute autre affection grave.
L’utilisation de gamètes issus de donneurs dont il est établi qu’ils présentent une telle anomalie doit faire l’objet d’une évaluation tenant compte du bien-être de tout enfant à naître et doit recueillir l’approbation d’une commission d’éthique.
9. Existe-t-il des critères non médicaux spécifiques pour la sélection des gamètes/de l’embryon devant être utilisé(s) pour une procédure de PMA (par exemple, correspondance entre l’apparence physique du (des) donneur(s) et des futurs parents) ? Oui. Les centres n’ont aucune obligation d’assurer la compatibilité entre receveur et donneur sur le plan de l’origine ethnique. Lorsqu’un receveur potentiel est disposé à accepter un don d’un donneur d’une origine ethnique différente, le centre peut proposer le traitement sous réserve d’une évaluation du bien-être de l’enfant.
10. Des mesures particulières sont-elles prises pour prévenir le risque de consanguinité ? Oui. L’HFEA tient un registre des donneurs et des patients qui ont eu un enfant en faisant appel à un don de gamètes. Une personne née d’un don qui souhaite avoir des relations physiques intimes avec une autre personne née d’un don peut présenter, avec celle-ci, une demande conjointe à l’HFEA afin de déterminer si elles sont génétiquement liées. De même, les personnes qui souhaitent se marier ou conclure un partenariat civil peuvent soumettre une demande conjointe pour établir si elles sont génétiquement liées. Les dons d’un même donneur ne peuvent être utilisés que pour un maximum de 10 familles. Le donneur en question ne peut plus faire de dons une fois que cette limite est atteinte, notamment pour réduire le risque de consanguinité.
11. Dans un couple homosexuel, un lien juridique est-il possible entre un enfant et le/la partenaire de son parent légal ? Oui.
Les dispositions juridiques relatives aux conditions à remplir pour qu’une personne soit le parent légal d’un enfant figurent dans la Loi sur l’HFEA.
Lorsqu’une femme ayant conclu un partenariat civil demande à bénéficier d’un don de sperme ou à recevoir un embryon créé à partir d’un don de sperme, le partenaire civil de la femme sera considéré comme le parent légal de tout enfant né du traitement, sauf si, au moment du transfert d’embryon ou de gamètes ou de l’insémination :
a) une ordonnance de séparation était en vigueur ou
b) il est démontré que le partenaire n’avait pas donné son consentement au transfert d’embryon ou de gamètes ou à l’insémination.
Lorsqu’une femme en couple (mais pas en partenariat civil) avec une femme bénéficie d’un traitement au moyen d’un don de sperme, ou d’un embryon créé à partir d’un don de sperme, sa partenaire sera considérée comme l’autre parent légal de l’enfant éventuel si les conditions suivantes sont remplies au moment du transfert d’embryon ou de gamètes ou de l’insémination :
a) la femme et sa partenaire ont informé le centre par notification écrite et signée (exceptions en cas de maladie, de lésions ou de handicap physique) du consentement de la partenaire à être considérée comme le parent de tout enfant éventuel,
b) aucune des deux partenaires n’a retiré son consentement (ou envoyé une notification écrite annulant et remplaçant le consentement) avant l’insémination/le transfert, et
c) la patiente et sa partenaire ne sont pas en parenté proche (les degrés de parenté interdits étant définis à l’article 58(2), partie 2, de la Loi 2008 sur HFE).
