En général tous les hommes peuvent donner leur sperme et toutes les femmes peuvent donner leurs ovocytes, si cela n’implique pas de risque génétique ou infectieux grave. Les établissements en charge des tests, du traitement, de la préservation, de la conservation ou de la distribution des tissues et des cellules d’origine humaine ont la responsabilité d’assurer la qualité du sperme et des ovocytes. Le don d’embryon n’est possible que pour la recherche, pas à des fins de procréation assistée.
7. Des mesures de compensation sont-elles prévues pour de tels dons ? Non. La vente ou toute forme d’assistance à la vente d’ovocytes non fertilisés ou fertilisés ne sont pas autorisées. La compensation du donneur pour un don d’ovocyte est donc limitée aux dépenses effectives impliquées et aux inconvénients directement liés au don.

Un donneur de sperme ne peut avoir plus de douze descendants.
Dans les cas où le(la) donneur(se) (sperme ou ovocyte) a plus de douze descendants, il(elle) peut tout de même effectuer un don dans le cadre d’une procédure de PMA en vue de la naissance d’un frère ou d’une sœur, si une femme seule ou un membre du couple a déjà un enfant grâce à un don de ce(tte) même donneur(se).
Les embryons congelés, fertilisés résultant d’un don d’ovocyte d’une même donneuse, dont les dons ont conduits à plus de douze grossesses viables, peuvent continuer à être utilisés.
Les embryons congelés fertilisés avec le sperme d’un même donneur, ayant déjà conduits à plus de douze grossesses viables, peuvent continuer à être utilisés.
11. Dans un couple homosexuel, un lien juridique est-il possible entre un enfant et le/la partenaire de son parent légal ? Oui.
En décembre 2013, la loi sur les enfants a été amendée avec des règles sur la co-maternité. La co-maternité peut être établie quand la mère a fait l’objet d’un traitement de procréation médicalement assistée et a une épouse ou une partenaire qui a consenti au traitement.
Dans d’autre cas, les couples homosexuels ont les mêmes droits à l’adoption que les couples hétérosexuels, qui incluent aussi la possibilité d’adoption de l’enfant de son partenaire.
16. Les dons de sperme/d'ovocyte/d'embryon sont-ils anonymes ? Non.
Les dons sont codés. L’autorité compétente tient un registre des dons de gamètes et d’embryons pour la PMA.
Si un enfant né par PMA souhaite connaître l’identité du donneur, il aura l’accès à l’information à l’âge de 18 ans.
17. Est-il possible d’obtenir des informations sur l’origine biologique d’un enfant né à la suite d’un don de gamètes ou d’embryon Pour l’enfant lui-même Oui/pour les parents Oui/pour un tribunal ? Non.
Si un enfant né sous PMA désire connaitre l’identité du donneur, il ou elle pourra avoir accès à l’information après ses 18 ans.
Lorsque la PMA a été proposée à une femme qui n’est pas mariée ou en couple comparable à un mariage hétérosexuel (après avril 2019 ; une femme qui n’est pas mariée, vivant en partenariat enregistré ou en relation comparable à celles-ci ; n’importe du fait si son partenaire est du sexe opposite ou pas) et que le donneur a donné son consentement à être inscrit en tant que père de l’enfant, la mère et l’enfant peuvent obtenir auprès du centre de PMA le code du donneur qui leur permettra de connaître l’identité de celui-ci en consultant le registre des dons. Conformément au Code de procédure judiciaire, les tribunaux n’ont pas accès aux données sensibles en matière de santé, à moins que la personne qui bénéficie du secret médical n’y donne son consentement ou en cas de décès de cette dernière, si des raisons impérieuses l’exigent. Font exception à cette règle les cas dans lesquels le procureur a engagé des poursuites pour une infraction passible d’une peine d’emprisonnement d’au moins six ans.

Aucune information spécifique concernant la santé du donneur n’est enregistrée.
18. Est-il possible de contester la maternité et la paternité des enfants nés après PMA et sous quelles conditions (dispositions relevant du droit de la famille) ?

19. Ces questions ou des problèmes qui y sont liés font-ils actuellement l’objet d’un débat important dans votre pays ? Oui. Conformément à la loi sur la paternité (isyyslaki ; 11/2015), l’homme qui a donné son consentement à la PMA sera le père de l’enfant né par PMA. Selon la Loi sur la maternité (en vigueur depuis le 1er avril 2019), cela s’applique également pour une femme dans un couple de femmes en ce qui concerne sa maternité. Si un don de sperme est utilisé pour une procédure de PMA chez une femme célibataire, le donneur peut donner son consentement à être potentiellement déclaré comme étant le père d’un futur enfant. Si le donneur de sperme n’a donné son consentement qu’aux fins du traitement de l’infertilité et non à la paternité d’un futur enfant, il ne peut être déclaré père de cet enfant.

Les Délégations sont invitées à évoquer, dans cette section, des cas particuliers rencontrés dans leur pays, en particulier des cas de jurisprudence, relatifs aux questions figurant dans les sections I et II de ce questionnaire. Tous les renseignements personnels relatifs au receveur de gamètes, au donneur de gamètes ou à l'enfant, conçu au cours de la PMA à l'aide de gamètes du donneur, sont confidentiels. Cependant, un Tribunal peut permettre la divulgation des informations sur le(s) donneur(s) et les enfants si cette information est nécessaire pour la santé de l’enfant ou du donneur ou pour des autres raisons valides. Quand un enfant né grâce à une procédure de MAP atteint l’âge de 18 ans, l’identité du donneur peut aussi être divulgué, si celui donne son consentement.

Conformément à l'article 10 de la loi sur la reproduction assistée de la République de Lituanie, des informations sur :
(1) le donneur (tiers) de gamètes, les donneurs d'embryons ou l'enfant né de l'utilisation des gamètes du donneur (tiers) de gamètes ou de l'embryon des donneurs d'embryons peuvent être fournies à un enfant né après la procréation assistée et au donneur (tiers) de gamètes ou aux donneurs d'embryons, avec l'autorisation du tribunal, si cette information est nécessaire pour la santé de l'enfant, du donneur de gamètes ou d'embryon ou des donneurs d'embryon ou pour d'autres raisons importantes ;
(2) l'identité du donneur de gamètes (tiers) ou des donneurs d'embryons peut, avec le consentement du donneur, être communiquée à une personne née après une procréation assistée lorsqu'elle a atteint l'âge de la majorité ou a acquis la pleine capacité juridique. Les modalités d'exercice du droit prévu au présent point sont déterminées par le gouvernement de la République de Lituanie ou par une institution autorisée par lui.

Un enfant né d'une procréation assistée utilisant les gamètes du donneur, ainsi qu'un donneur de gamètes, peuvent, avec l'autorisation du tribunal, recevoir des informations sur le donneur de gamètes concerné ou sur l'enfant né de l'utilisation des gamètes du donneur, si ces informations sont nécessaires pour la santé de l'enfant ou du donneur de gamètes, ou pour d'autres raisons impérieuses.

Non. Les personnes qui ont signé un consentement éclairé à la procréation assistée sont considérées comme les parents légaux de l'enfant né après la procréation assistée.

Le consentement écrit du donneur est nécessaire. Le don ne peut être réalisé que dans un hôpital dûment autorisé. Limite d’âge pour le don d’ovocyte : 30 ans (donneur), 45 ans (receveur).

10. Des mesures particulières sont-elles prises pour prévenir le risque de consanguinité ? Oui. Le sperme d’un donneur ou les ovocytes d’une donneuse ne pourront être utilisés que par trois couples. Un donneur ne pourra faire un don que dans un seul centre.
11. Dans un couple homosexuel, un lien juridique est-il possible entre un enfant et le/la partenaire de son parent légal ? Oui. La partenaire de la mère légale est automatiquement l’autre parent de l’enfant si cette partenaire a donné son consentement écrit pour la PMA avec un don de sperme.
