La situation peut varier selon le comté, mais de manière générale, un certain nombre de tentatives de PMA sont prises en charge ; actuellement, la plupart des cliniques publiques ou sous contrat proposent trois essais, conformément à une recommandation nationale (de l’Association suédoise des pouvoirs locaux et régionaux, SKL).
La PMA est considérée comme partie intégrait des soins de santé.

Un enfant conçu à partir d’un don a le droit, à « l’âge de sa maturité » (environ 18 ans, selon l’interprétation qui en est faite) et sur demande, de connaître l’identité et les coordonnées du donneur en question. Ces informations sont conservées pendant une durée de 70 ans dans un registre spécial des donneurs. Les parents sont encouragés à informer leur enfant qu’il a été conçu à partir d’un don.

La question de la paternité est réglementée par le Code parental.

Depuis la loi n°2021-1017 du 2 août 2021 relative à la bioéthique, l’enfant issu d’une AMP peut, à sa majorité, s’il le souhaite, accéder aux données non identifiantes (âge, état général, caractéristiques physiques, situation familiales et professionnelle, pays de naissance, motivation du don) et à l’identité du donneur.
A compter du 1e septembre 2022 le consentement du donneur à cette communication devient une condition sine qua non du don et les personnes nées de ces dons ont donc la garantie de pouvoir accéder à ces données à leur majorité si elles le souhaitent.
S’agissant des dons effectués avant le 1e septembre 2022, le législateur donne la possibilité au donneur de consentir a posteriori à cette communication soit sur simple manifestation spontanée soit par l’intermédiaire d’une procédure de contact du donneur. Ces donneurs gardent la possibilité de refuser la communication de leurs données.
L’anonymat du don entre donneurs et receveurs n’est pas remis en cause.

Certaines questions sont traitées dans l’Avis de l’Association polonaise des obstétriciens. Les règlements internes des centres de PMA définissent les critères médicaux applicables aux donneurs. Parmi ces critères figurent : l’âge : 30-45 ans (corrélation entre le risque de maladie génétique, par ex. trisomie 21 et l’âge), état de santé (absence de maladie mentale, systémique, tumorale ou infectieuse), dépistage de virus et de maladies sexuellement transmissibles. Lorsqu’une patiente présent un risque élevé de transmission d’une maladie génétique à sa descendance, le donneur de sperme doit passer les tests d’exclusion du même gène autosome récessif. Le groupe sanguin du donneur doit également être connu pour assurer sa compatibilité avec ceux des parents.
Les analyses de sperme sont effectuées conformément aux normes de l’OMS. Le sperme n’est conservé que si les tests bactériologiques sont négatifs. Le sperme doit être congelé pendant une période de 6 mois avant la première insémination.

Il n’y a pas de restrictions légales à l’accès à la procréation médicalement assistée. Toutefois, la loi de 2007 précise que les centres de fécondation peuvent refuser de donner suite à une demande de PMA, en indiquant soit les raisons médicales du refus, soit l’invocation de la clause de conscience.

Il est important de noter que la PMA n’est actuellement pas réglementée au Luxembourg. Toutefois :
Indiquer si une révision est en cours et, dans vos réponses, fournir des informations sur les dispositions du projet de loi : Il existe une proposition de loi, en l’occurrence un projet de loi d’initiative parlementaire, en matière de PMA. Le Parlement avait prévu de mener un large débat d’orientation sur cette question, mais il n’a pas encore eu lieu à ce jour.
S’il n’existe pas d’instrument juridique, décrire la pratique Il n’existe pas de loi réglementant les techniques de procréation assistée, mais ces méthodes sont généralement permises. La Loi de Santé publique (Sanitary Order Law) réglemente en partie la prise en charge de la PMA par l’assurance maladie ; elle définit notamment les indications et contre-indications pour le remboursement de la PMA : âge supérieur à 38 ans, stérilité tubaire ou interruption de grossesse antérieure pour des raisons sociales ou personnelles. Seuls deux cycles de PMA sont remboursés.

Oui. La question de la maternité de substitution a été reportée en raison de la nature controversée de l'abus du corps féminin et des conséquences juridiques que la maternité de substitution peut entraîner dans certains cas. Cependant, il semblerait que la discussion sera soulevée à l'avenir pour les couples hétérosexuels et homosexuels. La loi sur la protection des embryons, telle qu'amendée, ne permet pas le recours à la maternité de substitution et n'est pas discutée.
Note : Ceci dit, comme l'indique l'article 19, discuté ci-dessus, le don de gamètes est un accord privé, de sorte que les couples homosexuels, par exemple, peuvent contourner les dispositions en se faisant donner du sperme dans le cas des couples homosexuels féminins, et les couples homosexuels masculins peuvent donner leur sperme par un accord privé à une femme, qui peut être la mère porteuse (en utilisant ses propres ovules par insémination artificielle par donneur) et ensuite abandonner l'enfant. L'article 19 de la loi semble l'interdire selon mon interprétation. En tout cas, la loi ne parle pas de la Gestation pour autrui donc tout au plus elle peut être tolérée mais pas protégée par la loi en matière de filiation.

Les procédures de PMA sont couvertes par le Système national de soins de santé, une part restant à la charge du patient. La policlinique où la procédure de PMA est mise en œuvre est financée comme suit :
4. Cette prise en charge est-elle soumise à des critères particuliers (par exemple, infertilité, limite d’âge) ? Oui.
Tous les femmes/couples qui se voient proposer une bénéficient d’une prise en charge partielle des médicaments et des frais de traitement pour les traitements de FIV/ICSI. La décision de proposer ou non un traitement sera prise sur la base des critères suivants :
La première étape consistera pour la femme/ le couple à consulter le médecin de famille. Après évaluation médicale et psychosociale du couple, le médecin décidera d’orienter ou non la femme/le couple vers l’un des centres pratiquant la PMA.
Le médecin de la clinique décide si la femme/le couple se verra proposer la PMA ou non. Selon la loi sur la biotechnologie, une clinique proposant la PMA doit obtenir une autorisation ou un agrément de la direction de la santé.
Pour avoir accès à la PMA par le biais des cliniques financées par le système national de soins de santé, une évaluation de la rentabilité présumée du traitement pour la femme/le couple est effectuée.
De nombreux centres ont établi des lignes directrices pour l’évaluation des couples demandant à bénéficier d’une assistance médicale à la procréation.
Les femmes/couples peuvent également choisir de payer pour un traitement dans des cliniques privées, ce qui peut permettre de raccourcir le temps d'attente, et ces cliniques ne sont pas liées par les mêmes principes de rentabilité.
Une femme ne peut avoir plus de 46 ans au moment de l'insémination ou de l'implantation de l'embryon.
5. Le nombre de procédures de PMA prises en charge est-il limité (par exemple, uniquement trois tentatives de FIV) ? Oui. La prise en charge financière est limitée à trois procédures de PMA (trois procédures de FIV ou d’ICSI - ou une combinaison, lorsqu’une procédure inclut le prélèvement d’ovules). Le transfert d’embryons congelés (TEC) n’est pas comptabilisé comme une « procédure de PMA ».

Les critères d'accès à la FIV sont l'infertilité ou le fait que la femme soit atteinte ou porteuse d'une maladie héréditaire grave.
Les couples lesbiens et les femmes célibataires ont accès à la PMA par insémination ou à la FIV. Les critères d'accès à la procréation assistée par insémination pour les couples hétérosexuels sont l'infertilité ou le fait que l'homme soit atteint ou porteur d'une maladie héréditaire grave :
La loi ne prévoit pas de droit au traitement dans les cas où il existe un risque de transmission de maladies, par exemple entre la femme et son mari/conjoint.
En ce qui concerne la situation où l'un ou les deux partenaires sont atteints d'une infection sexuellement transmissible grave et chronique : Lorsque la femme est infectée, une évaluation du risque de transmission du virus à l'enfant doit être faite dans chaque cas avant de décider de poursuivre.
Une femme ne peut avoir plus de 46 ans au moment de l'insémination ou de l'implantation de l'embryon.
Les critères d'infertilité pour l'accès à la FIV ne s'appliquent pas dans les cas où un couple de même sexe se fait traiter par don de partenaire (l'une des femmes donne son ovule à l'autre qui porte l'enfant).
16. Les dons suivants sont-ils anonymes ? sperme Oui / d'ovocyte Oui /d'embryon Oui. Il n’y a pas de dispositions légales spécifiques en la matière. L’anonymat des dons découle du secret médical. L’Avis de l’association polonaise des obstétriciens recommande le double anonymat (du donneur et du receveur). Les règlements internes des centres de traitement peuvent en disposer autrement.
17. Est-il possible d’obtenir des informations sur l’origine biologique d’un enfant né à la suite d’un don de gamètes ou d’embryon Pour l’enfant lui-même Non/pour les parents Non/pour un tribunal ? Non. Il n’existe pas de dispositions juridiques spécifiques en la matière. Le médecin est par conséquent lié par le secret médical aussi bien envers le donneur que le receveur des gamètes. Les informations concernant le donneur ne pourront être révélées que pour des questions médicales, lorsque la vie ou la santé de l’enfant sont mises en péril.

18. Est-il possible de contester la maternité et la paternité des enfants nés après PMA et sous quelles conditions (dispositions relevant du droit de la famille) ?
Il n’existe pas de dispositions légales spécifiques en la matière.
D’après les règles générales du droit de la filiation, il n’est pas possible de contester la paternité dans le cas d’une insémination avec sperme du conjoint (homologue).
En revanche, dans le cas d’une insémination hétérologue, la contestation de paternité ne serait possible que dans le cas où le conjoint de la femme inséminée n’aurait pas consenti à l’insémination avec le sperme d’un autre homme.

Art. 62 du Code de la famille et de la tutelle :
« 1. L’enfant né pendant le mariage ou dans les trois cents jours suivant sa dissolution ou son annulation, est présumé avoir pour père le mari de la mère.
2. L’enfant né dans les trois cents jours suivant la dissolution ou l’annulation du mariage, mais après que la mère en ait contracté un second, est présumé avoir pour père le second mari.
3. Ces présomptions ne peuvent être réfutées que par une action en désaveu de paternité ».
Art. 63 du Code de la famille et de la tutelle :
« Le mari de la mère peut engager une action en désaveu de paternité dans les six mois à compter de la date à laquelle il a appris la naissance ».
Art. 85 du Code de la famille et de la tutelle :
« 1. L’homme ayant eu des relations avec la mère de l’enfant entre les trois centièmes jours et le cent quatre-vingt-unième jour avant sa naissance, est présumé en être le père.
2. Le fait que la mère ait également entretenu pendant cette période des rapports avec un autre homme ne peut faire tomber cette présomption que s’il résulte des circonstances que la paternité de l’autre homme est plus probable ».
Abus de droit et clause de l’ordre public :
Art. 5 du Code Civil :
« Nul ne peut faire usage de son droit d’une manière contraire au but social et économique de ce droit ou aux règles de la vie en société. Un usage ou non-usage abusif d’un droit n’est pas considéré comme un exercice de ce droit et ne bénéficie pas de la protection par la loi ».
Art. 58 par. 2 du Code Civil :
« Tout acte juridique contraire aux règles de la vie en société est nul et de nul effet ».
3. Les procédures de PMA sont-elles prises en charge par le système de sécurité sociale ? Oui. Auparavant, l’infertilité a été considérée comme une pathologie. Maintenant, depuis juillet 2016, selon le principe d’égalité, défini par la loi ; toutes les femmes, mariées ou célibataires, ayant ou pas des problèmes d’infertilité, peuvent demander d’être inséminées.
4. Cette prise en charge est-elle soumise à des critères particuliers (par exemple, infertilité, limite d’âge) ? Oui. Il y a seulement un minimum d’âge, à 18 ans (loi 32/2006, art 6º, nº2,), pour l’ensemble du pays. 40 ans pour le Système National de Santé – NHS.
5. Le nombre de procédures de PMA prises en charge est-il limité (par exemple, uniquement trois tentatives de FIV) ? Oui. Dans ce moment-là, le numéro des inséminations artificielles pour une femme célibataire ou homosexuelle dans le NHS n’est pas clair.

Les amendements à la loi, autorisant les femmes célibataires à recourir à la procréation assistée, entreront en vigueur le 1er avril 2016. L’ovocyte doit venir de la femme qui a recours à la procréation assistée.
Les questions concernant a) l’exigence d’un lien génétique entre l’enfant et l’un de ses parents et b) la possibilité ou non d’autoriser la maternité de substitution à visée altruiste, ont récemment fait l’objet d’une évaluation. L’étude effectuée à la demande du gouvernement Olika vägar till föräldraskap (SOU 2016:11) a proposé dans une publication du 24 février 2016 de supprimer l’exigence d’un lien génétique entre l’enfant et l’un des parents, mais pas d’autoriser la maternité de substitution.

Ces contre-indications sont absolues. De plus, certaines femmes ont une contre-indication relative au don d'ovocytes, par exemple les femmes qui n'ont pas d'enfants elles-mêmes et qui ont moins de 30 ans.
9. Existe-t-il des critères non médicaux spécifiques pour la sélection des gamètes/de l’embryon devant être utilisé(s) pour une procédure de PMA? Non.
10. Des mesures particulières sont-elles prises pour prévenir le risque de consanguinité ? Oui. Il existe une directive professionnelle qui limite le nombre de descendants d'un donneur à 25 enfants ou 12 familles. Étant donné que les cliniques n’ont désormais pas de base légale pour vérifier si un donneur fait également un don dans d’autres cliniques, il y a un changement juridique en préparation qui permet l’enregistrement national des donneurs, de sorte que le nombre limité de descendants puisse être surveillé.
11. Dans un couple homosexuel, un lien juridique est-il possible entre un enfant et le/la partenaire de son parent légal ? Oui. Lorsque deux femmes sont mariées, la deuxième mère peut facilement devenir la mère légale. Dans d'autres cas, une procédure d'adoption est nécessaire.
