Les amendements à la loi, autorisant les femmes célibataires à recourir à la procréation assistée, entreront en vigueur le 1er avril 2016. L’ovocyte doit venir de la femme qui a recours à la procréation assistée.
Les questions concernant a) l’exigence d’un lien génétique entre l’enfant et l’un de ses parents et b) la possibilité ou non d’autoriser la maternité de substitution à visée altruiste, ont récemment fait l’objet d’une évaluation. L’étude effectuée à la demande du gouvernement Olika vägar till föräldraskap (SOU 2016:11) a proposé dans une publication du 24 février 2016 de supprimer l’exigence d’un lien génétique entre l’enfant et l’un des parents, mais pas d’autoriser la maternité de substitution.

Au Royaume-Uni, l’accès au traitement dans le cadre du National Health Service (NHS) n’est pas le même partout, les différents clinical commissioning groups (CCG) locaux ou conseils de santé appliquant leurs propres niveaux de prestation et critères de sélection. Le National Institute of Clinical Health and Excellence (NICE) est l’organe du NHS qui a élaboré les lignes directrices générales que les CCG appliquent ensuite au niveau local. En tant qu’organisme de contrôle de la procréation assistée au Royaume-Uni, l’HFEA demande aux centres agréés pour le traitement de l’infertilité de suivre les prescriptions en matière de dépistage pour éviter la transmission de maladies. Les donneurs doivent subir un dépistage des maladies infectieuses telles que le VIH, l’hépatite B et C et le cytomégalovirus (CMV). Parmi les critères à prendre en considération figurent l’âge du patient, son état de santé et son aptitude à satisfaire les besoins du ou des enfants. Lorsque des gamètes issus de dons sont utilisés, le couple ou la femme célibataire fera l’objet d’une évaluation portant sur son état de santé et sa situation socio-économique. Si le couple/la femme sont jugés inaptes, ils peuvent se voir refuser le traitement ; cette décision peut faire l’objet d’un recours devant la Rättsliga Rådet (Conseil juridique de la Commission nationale de la santé et des affaires sociales). Même lorsque le couple a recours à ses propres gamètes, le centre concerné peut refuser l’accès au traitement s’il considère que cela peut ne pas être dans l’intérêt de l’enfant pour des raisons médicales.
La femme doit être « fertile » au regard de son âge biologique ; en général, une limite d’âge de 40 ans est appliquée. Si la qualité ou la quantité des ovocytes ne sont pas suffisantes, elle peut se voir refuser l’accès au traitement même si elle est plus jeune.

Pas actuellement, mais une loi modifiée sur la procréation médicalement assistée a été adopté en 2001, rendant entre autres les services de PMA librement accessibles aux femmes célibataires sans partenaire masculin et sans problème médical de fertilité, ce qui était impossible aux termes de la précédente loi (2000). Un groupe d’opposition au Parlement a appelé à un référendum législatif, ce qui a suscité un débat public animé. Le Comité national d’éthique médicale (NMEC) et le Conseil national de la santé ont déconseillé le recours arbitraire à la médecine pour les interventions susceptibles d’avoir de lourdes conséquences, lorsqu’il n’existe comme dans ce cas aucune indication médicale valable. Le NMEC a cité le rapport de 1989 du CAHBI (Comité ad hoc d’experts sur les progrès des sciences biomédicales) sur la procréation artificielle humaine, qui limite l’utilisation des procédures de PMA aux couples hétérosexuels et aux situations d’indications médicales strictes (infertilité, échec d’autres méthodes de traitement, nécessité d’éviter la transmission d’une maladie grave), comme le prévoyait la précédente loi.
Lors du référendum, la nouvelle loi a été rejetée avec une majorité écrasante de presque 3 contre 1. Par conséquent, la loi de 2000 décrite ci-dessus est restée en vigueur.

Conformément à la législation autrichienne, la mère d’un enfant est la femme qui lui a donné naissance. Le père est le mari de la mère, ou l’homme qui reconnaît sa paternité ou dont la paternité lui a été imposée par le tribunal. Le donneur de sperme/d’ovocytes est exclu de toute paternité/maternité en vertu de la loi.

La loi sur l'assistance médicale à la procréation (2016-09-14 n° XII-2608) légalise le don de cellules reproductrices lorsque l'un des époux ou partenaires a des cellules reproductrices endommagées ou insuffisantes qui ne peuvent pas être utilisées pour la fécondation assistée, ainsi que dans les cas où elles présentent un risque élevé de transmission d'une maladie susceptible d'entraîner un handicap important. La loi sur la procréation assistée autorise également le don d'embryons. Conformément à l'article 8, paragraphe 3, de la loi, le don d'embryons conservés dans la banque de cellules germinales est possible si les conjoints (partenaires) refusent l'embryon par écrit. Un tel refus n'est pas possible avant l'expiration d'un délai de deux ans après le début des procédures de PMA.

Conformément à la loi sur la PMA, il est interdit de procurer et/ou d’utiliser les gamètes d’une personne décédée pour la PMA. Si la personne dont les gamètes sont stockés dans une banque de gamètes, décède, ses gamètes doivent être détruits. Les gamètes de la personne décédée ne peuvent être utilisés pour la PMA d’une personne donnée que si la personne décédée avait donné de son vivant son consentement à l’utilisation de ses gamètes.
Le don d'embryons conservés dans la banque de cellules germinales est possible si les conjoints (partenaires) refusent l'embryon par écrit. Ce refus n'est pas possible avant l'expiration d'un délai de deux ans après le début des procédures de PMA.

L’assurance maladie prend en charge six inséminations et quatre cycles complets, c'est-à-dire se terminant par un transfert d'embryons. Un cycle de FIV qui est interrompu avant le transfert embryonnaire, quel que soit l'étape à laquelle le cycle est abandonné, n'est pas comptabilisé par l’assurance maladie. Le remboursement est soumis à une procédure d’entente préalable.
En cas de survenue de grossesse avec accouchement, le compteur est remis à zéro, et quatre nouvelles tentatives seront prises en charge. Ceci n'est pas valable pour les fausse-couches ou les grossesses extra-utérines.

Les articles 26 et 55, alinéa 2, de la loi, insérés par une loi du 10 avril 2014 et entrés en vigueur le 10 mai 2014, prévoient que si les deux auteurs du projet parental sont deux femmes, elles sont considérées comme une seule femme, dans le décompte du maximum de six femmes qui peuvent donner naissance à des enfants à partir de gamètes ou d'embryons surnuméraires provenant d'un donneur ou d'un couple de donneurs.

1. L’accès à la procréation médicalement assistée (PMA) (insémination artificielle, fécondation in vitro (FIV)) est-il :
La législation nationale repose sur les notions de « couple » (un homme et une femme mariés ou vivant dans une relation comparable au mariage ou deux femmes vivant ensemble dans le mariage, le partenariat enregistré ou dans une relation comparable à mariage) et de « bénéficiaire du traitement » (un couple ou une femme ne vivant pas dans un mariage, une relation comparable au mariage, un partenariat enregistré ou avec une personne de sexe opposé). Les dispositions de certains articles de la loi varient selon que le traitement est proposé à un couple ou à une femme célibataire.
Les centres de santé du service public refusent la PMA aux couples de lesbiennes et aux femmes célibataires au motif que ces services ne sont fournis que sur indication médicale. C’est pourquoi les couples de lesbiennes et les femmes célibataires se tournent vers le secteur privé pour bénéficier de tels services.
Le Médiateur de la non-discrimination a demandé au Tribunal national de non-discrimination et d'égalité de décider si la directive du médecin en chef du district hospitalier universitaire d'Helsinki selon laquelle les couples de femmes sont exclus de l'aide traitements de fertilité est discriminatoire. Dans la décision du Tribunal, la directive a été considérée comme une discrimination directe. Le tribunal administratif d'Helsinki a rendu une décision sur la question 6.3.2019 selon laquelle le Tribunal national de la discrimination et de l'égalité a été autorisé à interdire cette discrimination fondée sur la Loi sur la non-discrimination (paragraphe 8, paragraphe 2 de la loi, 1325/2014).

Comme indiqué précédemment, en vertu de la loi de 2015 sur l’enfant et les liens de parenté, le don de gamètes et d’embryon est autorisé mais n’est pas anonyme. Les donneurs de gamètes et d’embryons devront fournir les informations suivantes : nom, date et lieu de naissance, nationalité, date et lieu du don, ainsi que leurs coordonnées. Un enfant conçu d’un don peut demander, à l’âge de 18 ans, le nom, la date de naissance et les coordonnées du donneur concerné, inscrites au registre national des personnes conçues grâce à un don.
17. Est-il possible d’obtenir des informations sur l’origine biologique d’un enfant né à la suite d’un don de gamètes ou d’embryon Pour l’enfant lui-même Oui/pour les parents Oui /pour un tribunal ? -
Conformément à la Loi de 2015 sur l’enfant et les liens de parenté, un enfant conçu à partir d’un don qui a atteint l’âge de 18 ans, ou ses parents s’il n’a pas encore 18 ans, peuvent demander auprès du registre :
(a) les informations autres que le nom, la date de naissance et les coordonnées du donneur, qui figurent dans le registre ;
(b) le nombre de personnes nées de l’utilisation de gamètes du donneur en question dans le cadre d’une procédure d’assistance à la procréation, ainsi que le sexe et l’année de naissance de chacune d’entre elles.
La loi dispose également qu’un enfant conçu à partir d’un don peut, à l’âge de 18 ans, demander le nom, la date de naissance et les coordonnées du donneur, telles qu’elles figurent dans le registre. Le donneur doit être informé qu’une demande a été faite par un enfant conçu à partir de son don. Les informations requises sont fournies dans un délai de 12 semaines à compter de la date à laquelle la notification est envoyée au donneur (avec des exceptions très restrictives).

En vertu du projet de loi sur la procréation assistée, les informations médicales relatives au donneur peuvent être communiquées à un médecin afin d'éviter un risque imminent et grave pour la santé d'une personne ou pour permettre au médecin de fournir un avis médical à une personne concernant l'existence d'une maladie génétique ou héréditaire.

18. Est-il possible de contester la maternité et la paternité des enfants nés après PMA et sous quelles conditions (dispositions relevant du droit de la famille) ? Oui et non
En vertu de la Constitution irlandaise, la femme qui donne naissance à l’enfant est toujours considérée comme sa mère légale. Ce principe a été contesté devant les tribunaux irlandais mais a été confirmé par la Cour suprême en 2014 dans l’affaire MR and Anor – v- An tArd Chlaraitheoir & Ors (maternité de substitution).

Si un donneur souhaite rester anonyme, le personnel de santé doit veiller à ce que ce souhait soit respecté. Dans ce cas, le donneur ne peut recevoir d’information ni sur le couple qui bénéficiera du don de gamètes, ni sur l’enfant, de même que ni le couple ni l’enfant ne peuvent recevoir d’informations sur le donneur. Si le donneur ne souhaite pas rester anonyme, l’établissement conserve les informations le concernant dans un dossier spécial. Si le don de gamètes aboutit à la naissance d’un enfant, les informations concernant ce dernier et le couple qui a bénéficié du don seront conservées dans le même dossier. Un enfant né grâce aux gamètes d’un donneur qui ne souhaite pas rester anonyme peut, à l’âge de 18 ans, avoir accès au dossier conformément au paragraphe 2 afin d’obtenir des informations sur l’identité du donneur. Si l’établissement concerné communique à l’enfant des informations sur le donneur de gamètes, il doit, dès que possible, en informer le donneur.

Voir art. 6 de la Loi sur l’enfance, N°76/2003. (Un homme qui consent à ce que sa femme bénéficie d’une insémination artificielle conformément à la loi est considéré comme le père de l’enfant conçu. La même règle s’applique à un homme et une femme qui ont officiellement fait une déclaration de vie commune auprès du Registre national. En vertu des dispositions de la Loi sur l’insémination artificielle, un homme qui effectue un don de sperme pour que celui-ci soit utilisé pour l’insémination artificielle d’une femme autre que son épouse ou sa concubine (cf. paragraphe 1) ne sera pas considéré comme le père de l’enfant conçu avec son sperme. Un homme qui effectue un don de sperme à d’autres fins que celles énoncées au paragraphe 2 est considéré comme le père de l’enfant conçu avec son sperme sauf si le sperme est utilisé à son insu ou après son décès.)
