Les principaux principes introduits par la première loi sur la bioéthique de 1994 ont été confirmés par les suivantes.
Les questions de bioéthique font l’objet de débats sociétaux permanents (via notamment les états généraux de la bioéthique) et sont régulièrement relayées par les médias. Nous pouvons citer l’ouverture de l’AMP aux couples de femmes et aux femmes non mariées (réalisée par la loi n°2021-1017 du 2 août 2021 susmentionnée), l’AMP post mortem, la gestation pour autrui.
L’interdiction de ces deux dernières techniques a été maintenue.

La loi de 2008 a reçu l'approbation royale le 13 novembre 2008. Elle est entrée en vigueur en trois étapes :
Phase 1 : le 6 avril 2009, la partie 2 de la Loi, contenant les définitions révisées de la parentalité, est entrée en vigueur.
Phase 2 : en octobre 2009, les amendements à la législation de 1990 sont entrés en vigueur. Ils englobent la recherche sur les embryons hybrides et la suppression de la « nécessité d’un père ».
Phase 3 : depuis avril 2010, les couples homosexuels et les couples non mariés peuvent demander l’autorisation d’être considérés comme les parents d’enfants nés de mère porteuse.
Phase 4 : en janvier 2019, les célibataires peuvent demander des ordonnances leur permettant d'être traités comme des parents d'enfants nés de mères porteuses.

Titre de la législation :
- Wet houdende regels inzake handelingen met geslachtscellen en embryo’s (Embryowet) (projet de Loi énonçant les règles d’utilisation des gamètes et des embryons) (projet de Loi sur les embryons). Par ailleurs, une directive de la Société néerlandaise d’obstétrique et de gynécologie définit les critères médicaux et indique les pratiques à respecter, notamment en matière de fécondation in vitro, de conservation des embryons ou de don d’ovocyte.
- Wet Bijzondere Medische Verrichtingen (Loi sur les opérations médicales spéciales). Conformément à cette loi et aux dispositions de degré inférieur qui en découlent, les centres doivent obtenir une autorisation du ministre de la Santé pour pouvoir pratiquer la fécondation in vitro.

Un couple gay qui a amené un enfant de la mère porteuse aux États-Unis a été reconnu par la Cour suprême comme un pères à part entière. La raison était l'intérêt supérieur de l'enfant. Néanmoins, en décembre 2020, une proposition visant à modifier la formulation de la loi autorisant l'adoption pour les couples homosexuels a été rejetée.

Les dons sont codés. L’autorité compétente tient un registre des dons de gamètes et d’embryons pour la PMA.
Si un enfant né par PMA souhaite connaître l’identité du donneur, il aura l’accès à l’information à l’âge de 18 ans.
17. Est-il possible d’obtenir des informations sur l’origine biologique d’un enfant né à la suite d’un don de gamètes ou d’embryon Pour l’enfant lui-même Oui/pour les parents Oui/pour un tribunal ? Non.
Si un enfant né sous PMA désire connaitre l’identité du donneur, il ou elle pourra avoir accès à l’information après ses 18 ans.
Lorsque la PMA a été proposée à une femme qui n’est pas mariée ou en couple comparable à un mariage hétérosexuel (après avril 2019 ; une femme qui n’est pas mariée, vivant en partenariat enregistré ou en relation comparable à celles-ci ; n’importe du fait si son partenaire est du sexe opposite ou pas) et que le donneur a donné son consentement à être inscrit en tant que père de l’enfant, la mère et l’enfant peuvent obtenir auprès du centre de PMA le code du donneur qui leur permettra de connaître l’identité de celui-ci en consultant le registre des dons. Conformément au Code de procédure judiciaire, les tribunaux n’ont pas accès aux données sensibles en matière de santé, à moins que la personne qui bénéficie du secret médical n’y donne son consentement ou en cas de décès de cette dernière, si des raisons impérieuses l’exigent. Font exception à cette règle les cas dans lesquels le procureur a engagé des poursuites pour une infraction passible d’une peine d’emprisonnement d’au moins six ans.

7. Des mesures de compensation sont-elles prévues pour de tels dons ? Oui. Les dépenses engagées par le patient, une éventuelle perte de salaire et tout autre désagrément occasionné par la PMA peuvent donner lieu à compensation. En ce qui concerne le don d’ovules, une somme maximale de 250 euros peut être remboursée pour les désagréments occasionnés. Tout autre type de rémunération ou de règlement est interdit.
8. Des critères spécifiques sont-ils définis pour effectuer un don de sperme ? Oui d’ovocyte ? Oui d’embryon ? Oui
Sperme, ovocyte: la Loi sur les traitements de l’infertilité (laki hedelmöityshoidoista ; 1237/2006) exige que le donneur soit âgé d’au moins 18 ans. Dans la pratique, des limites d’âge à ne pas dépasser ont été définies par les centres de traitement et peuvent varier de l’un à l’autre. Le don de gamètes ne doit pas comporter de risque pour la santé du donneur et ce dernier ne doit pas présenter de maladie héréditaire grave ou de maladie transmissible susceptible de provoquer une pathologie grave chez la femme qui bénéficie du traitement de l’infertilité ou de l’enfant pouvant être issu de ce traitement. Un examen de santé du donneur permet de veiller au respect de ces critères. Le consentement éclairé est requis. Un donneur peut donner son consentement spécifique à l’utilisation du sperme pour des procédures de PMA concernant des femmes célibataires.
embryon: Seuls les embryons surnuméraires issus d’une procédure de PMA peuvent faire l’objet d’un don, avec le consentement éclairé des deux donneurs.
9. Existe-t-il des critères non médicaux spécifiques pour la sélection des gamètes/de l’embryon devant être utilisé(s) pour une procédure de PMA? Oui. En ce qui concerne l’utilisation de gamètes issus de dons, la section 5 de la Loi sur les traitements de l’infertilité (laki hedelmöityshoidoista ; 1237/2006) exige du médecin responsable qu’il sélectionne les gamètes d’un donneur dont l’apparence physique correspond à celle du parent de l’enfant à naître, sauf demande contraire du bénéficiaire du traitement.
10. Des mesures particulières sont-elles prises pour prévenir le risque de consanguinité ? Oui. Les gamètes d’un même donneur ne peuvent être utilisés pour permettre à plus de cinq receveurs bénéficiant d’une PMA de procréer.
11. Dans un couple homosexuel, un lien juridique est-il possible entre un enfant et le/la partenaire de son parent légal ? Oui. Si les membres d’un couple homosexuel ont enregistré leur partenariat, l’un peut adopter les enfants de l’autre. Selon la nouvelle Loi sur la Maternité, qui est entrée en vigueur le 1er avril 2109, la maternité d’une partenaire dans un couple homosexuel femme peut être reconnue sur la base d’un consentement valide aux traitements de fertilité.

Conformément à la loi sur l’assurance santé (sairausvakuutuslaki ; 1224/2004), l’assurance santé prend en charge le coût des soins médicaux nécessaires lorsque l’infertilité est due à une pathologie. L’infertilité est également assimilée à une pathologie lorsque la grossesse ne débute pas dans un délai d’un an au sein d’une relation permanente. La prise en charge concerne également les hommes.
4. Cette prise en charge est-elle soumise à des critères particuliers (par exemple, infertilité, limite d’âge) ? Oui. Conformément aux recommandations de pratique du Comité consultatif socio-médical de l’institution d’assurance maladie de Finlande, les procédures de PMA sont accessibles aux femmes jusqu’à 40 ans dans le système public de santé. Les femmes de plus de 40 ans sont également traitées si le pronostic est bon. Les frais sont remboursés par le régime d’assurance maladie jusqu’à l’âge de 43 ans. Pour les femmes plus âgées, la couverture d’assurance maladie est examinée au cas par cas compte tenu des données médicales de la patiente en question.
5. Le nombre de procédures de PMA prises en charge est-il limité (par exemple, uniquement trois tentatives de FIV) ?
La prise en charge des frais n’est pas limitée dans la loi. Le nombre de procédures de PMA est toutefois limité à trois dans la pratique de l’institution d’assurance sociale de Finlande, car selon les statistiques, les chances de réussite diminuent au-delà.
L’infertilité découlant d’une diminution du nombre de gamètes liée à l’âge n’est pas considérée comme une pathologie et ne bénéficie donc pas d’une prise en charge par l’assurance maladie dans le cadre des soins médicaux indispensables. Les procédures de PMA après stérilisation ne sont généralement pas couvertes. Les coûts éventuels supportés par un donneur ne sont pas pris en charge car ils ne sont pas liés au traitement de la pathologie du donneur.
Pour les demandeurs de plus de 43 ans, la prise en charge des procédures de PMA fait l’objet d’une décision au cas par cas. Une demande de remboursement des frais encourus pour les médicaments et la procédure elle-même doit être adressée à l’institution d’assurance sociale de Finlande. Elle doit être accompagnée d’une certificat médical établi par le médecin qui met en œuvre le traitement.

Les raisons médicales servent de critères pour l’accès à la PMA dans le système public de santé. Dans la pratique, les raisons de l’infertilité ne sont pas toujours connues et cela n’empêche pas les centres spécialisés du secteur public de donner accès au traitement, en particulier aux couples hétérosexuels (autrement dit, l’accès au traitement ne repose pas toujours sur un état pathologique diagnostiqué). Un autre motif invoqué pour refuser l’accès à la PMA aux couples de lesbiennes et aux femmes célibataires est le manque de gamètes disponibles issus de dons. Ces critères ne sont toutefois pas prévus dans la législation.

La PMA ne peut être pratiquée si la grossesse pose un risque élevé pour la santé de la femme ou de l’enfant en raison de l’âge ou de l’état de santé de celle-ci. Le donneur ne peut donner de gamètes s’il présente une maladie héréditaire grave ou toute maladie transmissible susceptible de provoquer une pathologie grave chez la femme qui bénéficie d’une procédure de traitement de l’infertilité ou de l’enfant pouvant être issu de cette procédure.

En ce qui concerne la question de savoir si les dons de sperme à des fins de PMA peuvent rester anonymes, il est fait appel à l'arrêt de la Cour constitutionnelle fédérale selon lequel le droit général de la personnalité (article 2, paragraphe 1, en liaison avec l'article 1, paragraphe 1, de la loi fondamentale [Grundgesetz - GG]) s'applique également à la connaissance de la filiation de l'enfant et protège contre la dissimulation d'informations accessibles sur la filiation (décisions antérieures cohérentes depuis l'arrêt de la Cour constitutionnelle fédérale du 31 janvier 1989 - 1 BvL 17/87 - BVerfGE 79, 256). C'est pourquoi la loi sur le registre des donneurs de sperme prévoit que le médecin qui supervise le don de sperme doit s'assurer que l'enfant pourra plus tard connaître l'identité de son père. L'anonymisation du don de sperme ou l'utilisation d'un pool de sperme pour la fécondation artificielle n'est pas autorisée. Selon les directives types de l'Ordre des médecins allemands sur la réalisation de la procréation assistée, le médecin doit informer le donneur de sperme qu'il est tenu de divulguer le nom du donneur à l'enfant sur demande et qu'il ne peut pas, à cet égard, invoquer le secret médical.
En janvier 2015, la Cour fédérale de justice (arrêt du 28 janvier 2015 - XII ZR 201/13, BGHZ 204, 54) a statué que les enfants ont le droit de demander au médecin traitant ou à la banque de sperme de divulguer le nom du donneur de sperme dans l'accord de traitement médical conclu entre les parents et la clinique.
Ces principes ont été mis en œuvre dans la loi sur le registre des donneurs de sperme.
Les mêmes règles s'appliquent au don d'embryons, dans la mesure où la loi sur la santé le permet. L'accord de coalition prévoit la possibilité de soumettre des informations sur les dons d'embryons au registre des donneurs de sperme, sous réserve de la législation en cours.
En ce qui concerne les ovocytes, la loi allemande n'autorise aucun don d'ovocytes. Il n'existe donc aucune règle permettant d'identifier la mère génétique d'un enfant né d'une autre femme. L'article 1591 du code civil détermine la maternité légale en termes de gestation uniquement, la femme qui a la gestation étant la mère de l'enfant. La question de savoir si un tribunal peut exiger d'une mère qu'elle informe l'enfant de sa mère génétique n'a pas encore été examinée par la jurisprudence.

En vertu de l'article 10, paragraphe 1, de la loi sur le registre des donneurs de sperme, une personne qui prétend avoir été conçue grâce à un don de sperme a le droit d'obtenir des informations sur le registre des donneurs de sperme (limité à l'enfant qui demande des informations ou à ses parents en tant que représentants légaux de l'enfant mineur).

Le droit allemand ne prévoit pas de contestation de la maternité. La mère d'un enfant est - même en cas de PMA - la femme qui lui a donné naissance (article 1591 du code civil). Dans de rares cas, la femme enregistrée comme mère n'est en fait pas la mère biologique de l'enfant ; dans ces cas, cependant, la correction du registre des naissances (pour remplacer cette femme par la femme qui a porté cet enfant) est effectuée par l'autorité de l'état civil en dehors d'une procédure de contestation.
En revanche, il est en principe possible de contester la paternité des enfants nés d'une procréation assistée (articles 1599 et suivants du code civil). Les personnes habilitées à le faire sont le père légal, l'homme qui déclare sous serment avoir eu des relations sexuelles avec la mère de l'enfant pendant la période de conception, la mère et l'enfant (article 1600, paragraphe 1, du code civil). Toutefois, la contestation de la paternité par le père et la mère est exclue s'ils ont tous deux consenti à la fécondation artificielle (article 1600, paragraphe 4, du code civil). L'action en contestation de paternité du donneur de sperme échoue parce qu'il ne peut pas affirmer sous serment qu'il a eu des rapports sexuels avec la mère. L'enfant a toutefois le droit de contester la paternité s'il y a eu une PMA avec donneur.
Géorgie - Don de sperme/d'ovocyte/d'embryo

Le don de gamètes et d’embryons est en principe autorisé à la fois par la Loi sur les soins de santé et par le projet de Loi sur la santé reproductive et les droits en matière de procréation.
Cependant, la Loi sur les soins de santé ne prévoit aucune disposition spécifique en la matière. Elle ne contient qu’une disposition générale selon laquelle les gamètes des donneurs ou les embryons peuvent être utilisés à des fins de PMA.
Le projet de loi sur la santé reproductive et les droits en matière de procréation est plus précis. Il consacre un chapitre distinct au don de gamètes, et en définit les conditions et les procédures.
7. Des mesures de compensation sont-elles prévues pour de tels dons ?
LHC : Non
DL-RHRR : Non. Conformément à l’article 20 du DR-RHRR, « le don de gamète n’est pas remboursé. Un donneur recevra une compensation pour le temps passé et les autres frais engendrés par le don (par exemple, le transport, l’absence au travail, etc.) ».

Un donneur de gamètes doit être un homme ou une femme capable, âgé(e) de 18 ans au moins et ne présentant aucune des maladies définies par la loi.
La fusion du sperme ou de l’ovule de parents génétiques dans le cadre de techniques de procréation médicalement assistée est interdite.
Un gamète ne peut être prélevé sur un homme décédé que si ce dernier a rédigé une directive anticipée spécifiant qu’il acceptait que ses gamètes soient utilisés après sa mort pour une insémination artificielle homologue ou une fécondation in vitro de l’ovule de son épouse, avec laquelle il s’est marié conformément aux règles définies par la législation de Géorgie. En revanche, il est interdit de prélever un ovule ou un ovaire sur une femme décédée pour une procédure de procréation médicalement assistée.

En vertu de l'article 3a, paragraphe 2, de la loi sur la protection de l'embryon, un diagnostic génétique préimplantatoire est exceptionnellement autorisé lorsque les prédispositions génétiques de la femme sur laquelle l'ovule a été prélevé, ou celles de l'homme produisant le spermatozoïde, ou les deux, suggèrent que leur progéniture sera très probablement atteinte d'une maladie génétique grave ou qu'elle présentera une anomalie très probablement à l'origine d'une mortinaissance ou d'une fausse-couche. En ce qui concerne les autres exigences relatives à un diagnostic génétique préimplantatoire, il est fait référence à l'article 3a, paragraphes 2 et 3, de la loi sur la protection de l'embryon (Embryo Protection Act). Dans ces cas, l'exécution de la PMA dépend du résultat du diagnostic génétique préimplantatoire.
c. Autres
Conformément à l'article 6, paragraphe 2, de la loi sur la réglementation des tissus et des cellules, l'utilisation de spermatozoïdes pour la fécondation hétérologue, en tant que technique de procréation médicalement assistée, exige que le donneur de sperme soit jugé médicalement apte au don de sperme, eu égard à son âge, à son état de santé et à ses antécédents médicaux, et que l'utilisation du sperme donné ne présente pas de risques pour la santé d'autrui. Les donneurs de sperme sont sélectionnés selon les critères et les tests de laboratoire définis à l'annexe 4, numéros 2 et 3, du règlement sur les tissus et les cellules de la loi sur la transplantation. L'annexe 4 a transposé en droit national les critères de sélection et les tests de laboratoire pour les donneurs de cellules reproductrices définis à l'annexe III de la directive 2006/17/CE du 8 février 2006 relative à certaines exigences techniques concernant le don, l'obtention et le contrôle de tissus et de cellules d'origine humaine. À cette fin, les échantillons de sérum ou de plasma des donneurs doivent notamment être testés et s'avérer négatifs pour le VIH 1 et 2, le VHC, le VHB et la syphilis. En outre, les échantillons d'urine des donneurs de sperme doivent être testés et déclarés négatifs pour la chlamydia par la technique d'amplification de l'acide nucléique (NAT).
D'autres aspects sont exposés dans les lignes directrices de l'Association médicale allemande, paragraphe 2.7.
Grèce - Réglementation ou pratique et accès à la PMA
Deux lois sont maintenant en vigueur en Grèce :
La Loi réglemente pour l’essentiel la question de l’établissement de la filiation de l’enfant à naître à la suite d’une procédure de procréation médicalement assistée (PMA). De plus, elle légalise l’insémination post-mortem et la maternité de substitution, sous certaines conditions spécifiées dans les articles pertinents.

La loi 3305 relative à la procréation médicalement assistée en Grèce a été adoptée en 2005. Cette loi, qui régit principalement le fonctionnement des unités de PMA, vient en complément de la précédente loi 3089, laquelle réglemente pour l’essentiel la question de l’établissement de la filiation de l’enfant à naître. Elle porte sur les méthodes de PMA, les conditions de demande, les questions de consentement éclairé, la cryoconservation des gamètes, le don de gamètes, la recherche sur les embryons, la maternité de substitution, la traçabilité, etc. La loi prévoit par ailleurs des sanctions administratives et pénales pour ceux qui n’en respecteraient pas les dispositions. Elle met également en place le mécanisme de contrôle compétent, à savoir L’autorité Nationale pour la PMA. Aux termes de cette loi, les méthodes de PMA sont appliquées de manière à garantir le respect de la liberté de l’individu et du droit au développement de la personnalité (un droit protégé par la Constitution grecque), ainsi que la satisfaction du désir d’enfant, conformément aux principes de la bioéthique. La loi dispose en outre que l’application de ces méthodes doit toujours tenir compte du bien-être de l’enfant à naître. |

Il convient de noter que la PMA n’est actuellement pas réglementée au Luxembourg. Toutefois :
- l’article 312 du Code civil dispose que le désaveu d’un enfant en justice par le conjoint de la mère n’est pas recevable « s’il est établi, par tous moyens de preuve, que l’enfant a été conçu par voie d’insémination artificielle, soit des œuvres du mari, soit des œuvres d’un tiers du consentement écrit du mari ».
- le plan hospitalier national adopté en 2001 par voie réglementaire prévoit la création d’un service de PMA dans un hôpital général disposant d’un service d’obstétrique.
Entre-temps, la création d’un service de PMA a effectivement été autorisée au Centre Hospitalier de Luxembourg. Ce service est opérationnel. Les données fournies en réponse au questionnaire correspondent aux pratiques de ce service.
Un projet de loi en matière de PMA est actuellement devant le Parlement. Ce dernier avait prévu de mener un large débat d’orientation, mais il n’a pas encore eu lieu à ce jour.
La Commission nationale d’éthique a émis un avis très complet sur tous les aspects de la PMA.

L'article 19 comporte deux dispositions :
19(1) : Que tout enfant issu d'une procréation médicalement assistée, y compris les cas où l'enfant est né de cellules germinales données ou d'un embryon donné, sera considéré comme l'enfant du ou des futurs parents qui ont exprimé leur consentement à la procédure. La loi stipule également qu'à toutes fins utiles, l'enfant sera considéré comme étant "né naturellement du ou des mêmes parents potentiels". L'enfant sera inscrit dans tout acte d'état civil en tant que descendant direct de ce ou ces futurs parents, qui ont alors les droits et les devoirs prévus par la loi à l'égard de l'enfant.
L'article 19(2) stipule explicitement qu'il n'existe aucun lien de filiation entre l'enfant né de cellules germinales données ou d'embryons adoptés et les personnes dont proviennent les cellules germinales données ou les embryons adoptés.
Note : (Il est intéressant de noter que, d'un point de vue scientifique, cette disposition reconnaît également que la mère gestationnelle est plus importante que la mère génétique dans ces circonstances).
La loi ne mentionne pas explicitement les cas cochés "NON" ci-dessus, mais l'article 22 de la loi oblige le titulaire de l'autorisation qui pratique la PMA à "tenir un registre confidentiel contenant tous les détails de chaque procédure de procréation médicalement assistée, don de lignée germinale, cryoconservation de cellules germinales et cryoconservation d'embryons en vertu de la présente loi et à transmettre ces informations à l'Autorité sans délai".
Note : On peut donc supposer que l'Autorité peut, dans certaines circonstances, par exemple pour des raisons de santé, donner l'autorisation de révéler les identités. Ce n'est cependant pas explicitement indiqué, mais tenir le registre signifie implicitement disposer d'un filet de sécurité.

L’HFEA autorise les centres de soins agréés au Royaume-Uni à verser une indemnité aux donneuses d’ovocytes à hauteur de 750 £ par cycle de don et jusqu’à 35 £ par visite au centre pour les donneurs de sperme. L’HFEA autorise également les avantages en nature, par exemple les conventions de partage d’ovocytes par lesquelles une femme ayant besoin d’une FIV accepte de partager des ovocytes avec une autre femme ayant besoin d’un don d’ovocytes en échange de la gratuité du traitement ou d’une diminution de son coût. Les cliniques se référeront aux lignes directrices professionnelles applicables en ce qui concerne les limites d’âge avant d’accepter des gamètes pour le traitement d’autres patients. Les gamètes destinés au traitement d’autres patients ne doivent pas être prélevés sur un donneur de moins de 18 ans. Un donneur ne doit pas être sélectionné en raison d’une anomalie génétique, chromosomique ou mitochondriale particulière qui, si elle était héritée par l’enfant né à la suite du don, entraînerait chez cet enfant :
a) un handicap physique ou mental grave,
b) une maladie grave,
c) toute autre affection grave.
L’utilisation de gamètes issus de donneurs dont il est établi qu’ils présentent une telle anomalie doit faire l’objet d’une évaluation tenant compte du bien-être de tout enfant à naître et doit recueillir l’approbation d’une commission d’éthique.
9. Existe-t-il des critères non médicaux spécifiques pour la sélection des gamètes/de l’embryon devant être utilisé(s) pour une procédure de PMA (par exemple, correspondance entre l’apparence physique du (des) donneur(s) et des futurs parents) ? Oui. Les centres n’ont aucune obligation d’assurer la compatibilité entre receveur et donneur sur le plan de l’origine ethnique. Lorsqu’un receveur potentiel est disposé à accepter un don d’un donneur d’une origine ethnique différente, le centre peut proposer le traitement sous réserve d’une évaluation du bien-être de l’enfant.
10. Des mesures particulières sont-elles prises pour prévenir le risque de consanguinité ? Oui. L’HFEA tient un registre des donneurs et des patients qui ont eu un enfant en faisant appel à un don de gamètes. Une personne née d’un don qui souhaite avoir des relations physiques intimes avec une autre personne née d’un don peut présenter, avec celle-ci, une demande conjointe à l’HFEA afin de déterminer si elles sont génétiquement liées. De même, les personnes qui souhaitent se marier ou conclure un partenariat civil peuvent soumettre une demande conjointe pour établir si elles sont génétiquement liées. Les dons d’un même donneur ne peuvent être utilisés que pour un maximum de 10 familles. Le donneur en question ne peut plus faire de dons une fois que cette limite est atteinte, notamment pour réduire le risque de consanguinité.
11. Dans un couple homosexuel, un lien juridique est-il possible entre un enfant et le/la partenaire de son parent légal ? Oui.
Les dispositions juridiques relatives aux conditions à remplir pour qu’une personne soit le parent légal d’un enfant figurent dans la Loi sur l’HFEA.
Lorsqu’une femme ayant conclu un partenariat civil demande à bénéficier d’un don de sperme ou à recevoir un embryon créé à partir d’un don de sperme, le partenaire civil de la femme sera considéré comme le parent légal de tout enfant né du traitement, sauf si, au moment du transfert d’embryon ou de gamètes ou de l’insémination :
a) une ordonnance de séparation était en vigueur ou
b) il est démontré que le partenaire n’avait pas donné son consentement au transfert d’embryon ou de gamètes ou à l’insémination.
Lorsqu’une femme en couple (mais pas en partenariat civil) avec une femme bénéficie d’un traitement au moyen d’un don de sperme, ou d’un embryon créé à partir d’un don de sperme, sa partenaire sera considérée comme l’autre parent légal de l’enfant éventuel si les conditions suivantes sont remplies au moment du transfert d’embryon ou de gamètes ou de l’insémination :
a) la femme et sa partenaire ont informé le centre par notification écrite et signée (exceptions en cas de maladie, de lésions ou de handicap physique) du consentement de la partenaire à être considérée comme le parent de tout enfant éventuel,
b) aucune des deux partenaires n’a retiré son consentement (ou envoyé une notification écrite annulant et remplaçant le consentement) avant l’insémination/le transfert, et
c) la patiente et sa partenaire ne sont pas en parenté proche (les degrés de parenté interdits étant définis à l’article 58(2), partie 2, de la Loi 2008 sur HFE).
Slovénie - Don de sperme/d’ovocyte/d’embryon
6. Est-il possible, dans votre pays, de procéder à un don de sperme ? Oui d’ovocyte ? Oui c. d’embryon ? Non. Le don d’embryon, ainsi que les procédures de PMA avec double don de gamètes sont interdits (articles 13 et 7), sur la base du principe selon lequel l’enfant issu d’une procédure de PMA devrait avoir des liens génétiques avec l’un au moins de ses parents.
7. Des mesures de compensation sont-elles prévues pour de tels dons ? Non. Les rémunérations financières sont formellement interdites. Les dépenses engendrées par le don sont toutefois remboursées (article 10).

Une personne ne peut donner ses gamètes qu’à un seul centre (article 11).
