Retour Discussions on the draft legal framework for establishment of the non-conviction based confiscation in Montenegro

During the meeting of the Working group for establishment of legal framework for combating illicit enrichment, held on December 6-7, 2021 in Podgorica, Montenegro, analysis of the draft legal framework for non-conviction based confiscation and recommendations for its improvement were presented and discussed.

The participants discussed aspects of the proposed legal framework that could be clarified in order to strengthen the draft law to be submitted to the Parliament: definition of the property liable to non-conviction based confiscation, thresholds for triggering financial investigations, institutional framework for the implementation of the legal provisions and appeal mechanisms. Recommendations on amendments, developed within the Action, were carefully considered and mostly adopted by the Working group.

The meeting was organized within the framework of the EU/Council of Europe Horizontal Facility for Western Balkans and Turkey Phase II – Action against Economic Crime in Montenegro (AEC-MNE), was presented during the session of the working group.
