The Action against Corruption in the Republic of Moldova presented the results of the assessment on the review of the national framework on the disciplinary liability of prosecutors during an online workshop on 19th May 2021. The event brought together representatives of the Superior Council of Prosecutors, General Prosecution Office, Prosecutorial Inspection, Ministry of Justice, civil society organizations and cooperation partners.

In his opening speech, Mr Mustafa Ferati, Head of Economic Crime and Cooperation Division, Council of Europe, noted that the assessment aims to advise the national authorities on possible ways to consolidate the disciplinary liability framework in regard to prosecutors, considering that prosecutors play a crucial role in the administration of justice, and rules concerning the performance of their responsibilities should be closely monitored.

During the event, representatives of national authorities and Council of Europe experts exchanged views on possible mechanisms to further consolidate the national framework governing the disciplinary liability of prosecutors, in line with GRECO recommendations and international good practices of independence applicable to prosecutorial councils. The discussions and recommendations presented during the event addressed the following subjects:

  • Simplifying the disciplinary liability procedures in regard to prosecutors
  • Establishing clear disciplinary violations and sanctions applicable to prosecutors (including in regard to prosecutors that left the prosecutorial system)
  • Revising the status and competences of the Prosecutorial Inspection in view of consolidating its transparency and efficiency
  • Consolidating the legal reasoning of decisions issued in disciplinary matters and ensuring their proper publication
  • Advantages for setting up a confidential counselling system for prosecutors

In its Second Compliance Report of Fourth Evaluation Round on the Republic of Moldova, GRECO emphasized the need of strengthening the objectivity, efficiency and transparency of the disciplinary liability system in the Republic of Moldova, both in regard to judges and prosecutors, by revising the legal and operational frameworks.

This activity was organized within the framework of the project “Action against corruption in the Republic of Moldova”, funded by the Bureau of International Narcotics and Law Enforcement Affairs (INL) of the US Department of State and implemented by the Council of Europe.
