Retour Judicial dialogue on case-law harmonisation in Albania, a tool for a better justice

Harmonization of the Albanian High Court case-law was in the focus of the 3rd Regional Forum of dialogue organised in Vlora with relevant representatives of the Albanian judiciary. This forum builds upon the successful cooperation established with High Court and High Judicial Council, in organising similar harmonisation forums in Shkoder and Korça during 2022.

35 judges and legal advisors from the High Court as well as general and administrative courts of the first instance of Vlora, Gjirokaster, Saranda and Fieri exchanged on the importance of ensuring a coherent and consistent case-law application at all instances of the national courts. This is of a particular relevance since constitutional changes of 2016 have reshaped the role of the High Court in hearing cases related to the meaning and implementation of law and to ensure the unification and development of the judicial practice. All involved stressed the necessity of a continuous judicial dialogue among justice professionals as an effective tool in overcoming challenges faced by the Albanian judiciary and progressing towards a more effective justice system that safeguards the rights of all citizens.

 

The activity was organised in the framework of the action “Improving the protection of the right to property and facilitating executions of ECtHR judgements and facilitating the execution of ECtHR judgements in Albania” under “Horizontal Facility for the Western Balkans and Türkiye III”.
