Limitations of Rights and Freedoms of Judges Conference of the Judges’ Association of Serbia

The Conference on limitations of rights and freedoms of judges was organised by the Association of Judges of Serbia with the support of the joint CoE/EU project “Support for the implementation of the Judicial Reform in Serbia. The event took place following the regular annual assembly of the Judges’ Association and brought together over 100 judges, as well as representatives of the international community.

As a part of the panel of freedom of expression and electoral rights of judges, international CoE experts presented European standards, relevant practices and experiences in particular states. CCJE Opinion No.25 on the freedom of expression of judges was discussed in depth, particularly in terms of a balanced approach and a guideline for some of the potential ethical dilemmas. The panellists addressed some of the restrictions on the freedom of expression of judges, as a result of their specific social position and an obligation to be seen as objective and impartial and to show restraint in public appearances. Concurrently, the rights of judges to sign petitions, participate in social actions, criticize the judiciary or publicly discuss various concerns that arise in the society, were assessed in light of Serbian new legal framework, ethical rules and international standards.

The conference was an effective forum for exchange of views and professional discussion on some of the important topics in the field of justice reform. Joint CoE/EU project “Support for the implementation of the Judicial Reform in Serbia” will continue to support the activities aimed at strengthening the rule of law and independence of the judiciary.
