Retour Report on corruption risk assessment within the Public Prosecution Service of the Republic of Moldova

Following the assessment of the corruption risks within the Moldovan public prosecution service, the Human Rights National Implementation Division (Directorate General Human Rights and Rule of Law) has issued a Report on corruption risk assessment. It has been prepared upon the assessment carried out in October-December 2015 within the framework of the Council of Europe project “Support to Criminal Justice Reforms in the Republic of Moldova”, funded by the Danish government.

On 5 April 2016, the Council of Europe presented a draft Report by organising a public discussion on its findings. Later the Report was finalised, taking into account comments by the Moldovan stakeholders.

The Report notes that problems in the Republic of Moldova are not necessarily a consequence of a poor legislation; they are rather related to a certain culture of corruption tolerance and acceptance. Given an improper influence on the prosecution service, there is need to intensify efforts for optimising criminal prosecution in corruption cases.

The Report contains a number of recommendations concerning the need for a substantive and comprehensive reform of the prosecution system, referring mainly to the establishment of a single body with exclusive competences in handling cases of corruption, enhancing transparency and accountability of the actors involved, systematic reliance on research and property confiscation, strengthening the legislation on unjustified possession of wealth and, not least important, increasing the wages of those involved in combating corruption, in particular, prosecutors.
