A study visit of representatives of the Directorate of the Government Agent of the Republic of Moldova before the ECtHR took place in the Council of Europe HQ in Strasbourg. The study visit was organised within the Council of Europe project “Support to criminal justice reforms in the Republic of Moldova” funded by the Danish Government.The visit aimed at enhancing their knowledge on the procedures of the state representation at the ECtHR and procedure of execution of the Court’s judgments as supervised by the Committee of Ministers of the Council of Europe.
During the visit the participants, including the Interim Governmental Agent, had the opportunity to discuss with Moldovan lawyers at the ECtHR the evolving and complex issues emerging in the process of drafting observations on particular cases. The procedures related to the Council of Europe monitoring mechanism on execution of ECtHR judgments against the Republic of Moldova were thoroughly presented and discussed with the Execution Department of the Council of Europe. In this context, a training session on drafting action plans and reports was provided.
The Moldovan delegation had also the possibility to get acquainted with the procedures of the ECtHR by attending the hearing of the Grand Chamber in the case Lopes de Sousa Fernandes v. Portugal (no. 56080/13).
A meeting of the Interim Governmental Agent of the Republic of Moldova with Mr Stanley Naismith, Section Registrar, and with Mr Hasan Bakirci, Deputy Section Registrar of the Section 2 of the ECtHR, was organised.
The study visit has complemented other capacity building activities organised for the Office of the Government Agent of the Republic of Moldova before the ECtHR with the aim to strengthen its capacities and enhance its efficiency and effectiveness as regards representation before the ECtHR and execution of the ECtHR judgments in a long-term perspective.
Vizita de studiu a reprezentanților Direcției Agent Guvernamental al Republicii Moldova în fața CtEDO la sediul Consiliului Europei, Strasbourg, Franța
În perioada 14-16 noiembrie 2016 a avut loc vizita de studiu a Direcției Agent Guvernamental al Republicii Moldova în fața CtEDO, la Sediul Consiliului Europei, Strasbourg. Vizita de studiu a fost organizată în cadrul proiectului Consiliului Europei ”Susținerea reformei justiției penale în Republica Moldova” finanțat de Guvernul Danemarcei.
Vizita a avut drept scop consolidarea cunoștințelor participanților cu privire la procedurile reprezentării statului la CtEDO, precum și procedurile executării hotărîrilor CtEDO, care sunt supravegheate de Comitetul de Miniștri al Consiliului Europei.
În cadrul vizitei de studiu participanții, inclusiv Agentul Guvernamental Interimar, au avut oportunitatea de a discuta cu juriștii Republicii Moldova la CtEDO cu privire la problemele complexe care apar în procesul de elaborare a observațiilor pe anumite cauze. Procedurile Mecanismului de supraveghere a Consiliului Europei a executării hotărîrilor CtEDO împotriva Moldovei au fost prezentate și discutate în detaliu cu Departamentul de Executare al Consiliului Europei. În acest context, a fost oferită o sesiune de instruire cu privire la elaborarea de planuri de acțiuni și rapoarte. În cea de-a treia zi a vizitei de studiu, delegația Republicii Moldova a avut posibilitatea să facă cunoștință cu procedurile CtEDO, participînd la ședința Marii Camere în cauza Lopes de Sousa Fernandes v. Portugalia (nr. 56080/13).
O întrevedere bilaterală a fost organizată între Agentul Guvernamental Interimar al Republicii Moldova cu grefierul de secție, Stanley Naismith și grefierul de secție, adjunct al Secțiunii 2 a CtEDO, Hasan Bakirci.
Vizita de studiu face parte dintr-un șir de activități de consolidare a capacităților Agentului Guvernamental al Republicii Moldova în fața CtEDO, care au drept scop eficientizarea pe termen lung a reprezentării în fața CtEDO și a executării hotărârilor CtEDO
