Retour Webinar: Property Rights and the European Convention on Human Rights

On 19 February 2021, a webinar “Property Rights and the European Convention of Human Rights” was organised under the Project. It was facilitated by two international experts, Dr Maria Filatova, Professor at the Law School of University of Moscow, and Mr Ylli Peco, Lawyer at the Registry of the European Court of Human Rights (the Court). The program was prepared in close collaboration with legal advisors of the Constitutional Court, who were the main target audience for this online workshop.

The webinar brought very productive exchange on different aspects of the application of Article 1 of Protocol No. 1 to the European Convention through presentations, interactive discussion between facilitators and beneficiaries and analyses of the most recent case law of the Court in this area. The participants got information about States’ responsibilities and their positive obligations to protect property rights and access to property in different national contexts deriving from the European Convention and relevant case law of the Court in Strasbourg. In the practical part, participants exchanged on the application of the proportionality test through analyses of some landmark cases dealt with by the Court.

It was the final of thematic events dedicated to the case law under various articles of the European Convention. Though these events judges and legal advisers of the beneficiary institution have had the opportunities to interact and learn from the most prominent international experts in the relevant fields. The project “Improving the Protection of European Human Rights Standards by the Constitutional Court” is funded by Norway and implemented by the Council of Europe.
