The Working Group finalised the Draft Rulebook on Administration in Public Prosecutors’ Offices

The Working Group of the Ministry of Justice finalised the Draft Rulebook on Administration in Public Prosecutors’ Offices with the support of the project "Support for the Implementation of Judicial Reform in Serbia" at the meeting in Vrdnik. The representatives of the Supreme Public Prosecutors’ Office, members of the High Prosecutorial Council, representatives of the Ministry of Justice, Association of Prosecutors, and civil society took part in the meeting.

According to the new prosecutorial laws, the Rulebook on Administration in Public Prosecutors’ Offices will be adopted by the Minister of Justice with the prior opinion of the High Prosecutorial Council and the Supreme Public Prosecutors’ Office. This rulebook is the key document for the internal organisation and functioning of the public prosecution in Serbia. In line with the new legislative framework, the supervision over the implementation of this act will be performed by the High Prosecutorial Council and the Ministry of Justice. The High Prosecutorial Council is responsible for monitoring the internal arrangement and organization of the work of the public prosecutor's office; the relationship of the public prosecutor's office towards other state bodies, citizens, and the public; the use of public prosecution symbols, official language, and script; provision of information to the public about the work of the public prosecutor's office; uniform and timely handling of cases; monitoring public prosecutorial practice and case law and internship practice.

The Ministry of Justice will supervise the matters of data protection, the relationship of the staff in the public prosecutor's offices with the parties, and handling objects and things of value. Regarding acting on complaints about the work of the holder of the public prosecutor's office and staff in the public prosecutor's office; maintaining registers, auxiliary books, directories, and other records; keeping statistics; filing and other matters of importance for the work of the public prosecutor's office, the High Prosecutorial Council and the Ministry of Justice shall jointly perform monitoring of the implementation.

The project "Support for the Implementation of Judicial Reform in Serbia" will continue to support relevant justice stakeholders in the further process of the reform implementation.
