Specific legislation on cybercrime has been enacted through the Penal Code Act No. 1/95 of 22 April 2009 – Art. 467-470 (forgery, fraud, illegal access and system interference).
Droit matériel
In terms of substantive law, the Penal Code of Burundi contains elements of offences of illegal access, system interference, computer fraud and forgery.
Droit procédural
There are no specialised powers or definitions corresponding to procedural law requirements of the Budapest Convention in criminal procedure legislation of Burundi.
Garanties
The Constitution of Burundi of 2018 contains provisions on privacy of communication, regulation of evidence collection. However, under Law No 1/09 of May 11 2018 assented by Burundi’s president, which amends the Code of Criminal Procedure of 2013, according to art. 47 government agencies carrying out investigations can intercept electronic communications and seize computer data.
Institutions spécialisées
- The National Police of Burundi (PNB) is the primary law enforcement institution in Burundi, with responsibility for criminal investigations.
- Burundi does not have a dedicated organisation for investigating cybercrime, or a CERT.
- The Judicial Police investigate crimes, question suspects, and provide evidence to the prosecutor (Ministère Public).
