La loi sur l’embryologie et la fécondation humaine, qui régit l’utilisation des traitements de l’infertilité au Royaume-Uni, a été modifiée de sorte que les personnes conçues à partir de dons et nées après le 1er avril 2005, peuvent, à l’âge de 18 ans, solliciter auprès de l’HFEA un accès aux informations relatives au donneur. Cela signifie toutefois que les droits d’accès à l’information dépendront de la date à laquelle la personne a été conçue. Ces différences sont expliquées ci-après.
Personnes conçues avant le 1er août 1991 :
La loi charge l’HFEA de tenir un registre contenant des informations sur les services d’assistance à la procréation réglementés au Royaume-Uni. L’HFEA enregistre ces informations depuis le 1er août 1991, date d’entrée en vigueur de la loi de 1990 sur l’embryologie et la fécondation humaine. Toutes les naissances issues d’un traitement, y compris celles provenant de dons de gamètes, figurent dans le registre, qui contient également des informations concernant les donneurs de gamètes : description physique, origine ethnique et toute autre information que le donneur souhaite ajouter, par exemple sa profession et ses centres d’intérêt. L’anonymat du don ayant été supprimé en avril 2005, le registre contient également le nom et l’adresse du donneur. Les donneurs ayant effectué un don avant le 1er avril 2005 peuvent demander que leur anonymat soit levé de manière rétroactive.
Certaines personnes conçues par dons avant 1991 peuvent trouver des informations sur le don et leurs frères et sœurs génétiques conçus par don.
Cela dit, avant la création de l’HFEA en 1991, il n’y avait pas de collecte centralisée des informations relatives aux donneurs. Autrement dit, les personnes conçues avant cette date auront sans doute beaucoup plus de difficultés à retrouver leur donneur. Le registre des personnes conçues par don a été mis en place le 1er avril 2013 pour remplacer le UK Donor Link (UKDL) et facilite le contact entre les donneurs et leurs enfants conçus avant le 1er août 1991. Ceux concernés par un don avant le 1er août 1991 ont la possibilité de s’inscrire dans un registre de contact.
Personnes conçues entre le 1er août 1991 et le 31 mars 2005 :
Les personnes conçues par don avant la modification de la loi intervenue le 1er avril 2015 n’ont pas accès aux données d’identification de leur donneur.
Néanmoins, celles âgées de plus de 16 ans peuvent présenter une demande à l’HFEA pour obtenir les informations anonymes fournies par le donneur.
Ils n’auront la faible possibilité d’entrer en contact avec le donneur qu’à l’âge de 18 ans, mais uniquement si ce dernier s’est réenregistré auprès du centre de PMA ou de l’HFEA en donnant les coordonnées qui étaient les siennes à ce moment-là.

Personnes conçues à partir du 1er avril 2005 :
En 2005, les lois sur l’accès aux informations relatives aux donneurs ont changé. L’identité de toute personne ayant fait un don de sperme ou d’ovocyte après le 1er avril 2005 peut être obtenue par les enfants nés de ce don, lorsque ceux-ci atteignent l’âge de 18 ans. Autrement dit, les coordonnées du donneur peuvent être transmises aux enfants nés de son don. En réponse à la demande d’information de ces derniers, l’HFEA leur fournit la dernière adresse connue, la date de naissance et le nom du donneur.
L’anonymat a été supprimé car la loi reconnaît le souhait et l’intérêt qu’ont de nombreuses personnes conçues grâce à un don de savoir d’où elles viennent. Elle reconnaît également l’intérêt des donneurs à obtenir des informations sur les enfants nés de leur don.
L’HFEA dispose d’un registre des frères et sœurs pour permettre aux personnes conçues grâce à un don de prendre contact avec leurs frères et sœurs issus du même donneur à partir de l’âge de 18 ans, sur la base d’un consentement mutuel.
Lorsqu’une personne conçue grâce à un don atteint l’âge de 18 ans, elle peut choisir d’inscrire ses coordonnées dans un registre volontaire de contact des frères et sœurs, le Donor Sibling Link, géré par l’HFEA. L’HFEA facilitera l’échange de coordonnées entre les frères et sœurs qui ont donné leur consentement à figurer sur ce registre.
Il est donc possible pour les adultes conçus grâce à un don de retrouver leurs frères et sœurs, sur la base du consentement mutuel, par l’intermédiaire de ce registre. En revanche, les parents n’ont pas la possibilité de retrouver les frères et sœurs de l’enfant via ce registre.

La loi HFE de 1990 (telle que modifiée) permet aux personnes conçues à partir d’un don de demander, lorsqu’elles atteignent l’âge de 16 ans, des informations non identifiantes concernant le donneur, si elles sont disponibles, par exemple : les antécédents médicaux familiaux, la couleur des cheveux et des yeux. Si elles ont été conçues après le 1er avril 2005, elles peuvent, dès qu’elles atteignent l’âge de 18 ans, demander à obtenir des informations identifiantes sur leur donneur, auprès de l’HFEA.
Les parents d’enfants conçus à partir d’un don ont accès aux données non identifiantes concernant le donneur, auprès de l’HFEA.
L’article 34 de la Loi HFE de 1990 autorise l’Autorité à divulguer les informations lorsque cela est nécessaire à l’exercice de poursuites en vertu de la Loi sur les handicaps congénitaux.

Dans le cadre d’un traitement de procréation assistée, que les gamètes soient ceux du couple ou proviennent d’un donneur, dès lors que le couple est marié ou en partenariat civil, les deux parents seront les parents légaux de tout enfant né du traitement, dès la naissance de l’enfant. La loi s’efforce de placer sur un pied d’égalité les couples qui ont eu recours à un traitement de procréation assistée et les couples qui conçoivent naturellement, pour ce qui est de la paternité et de la maternité légales et des responsabilités parentales. Il est toutefois possible pour le père ou le second parent (dans le cas d’un couple de lesbiennes en partenariat civil) de s’opposer à la paternité ou à la maternité légale mais uniquement s’il ou elle est en mesure de démontrer qu’il ou elle n’a pas donné son consentement au traitement de son partenaire (voir articles 35(1) et 42(1) de la Loi HFE de 2008).
Lorsque les gamètes d’un donneur sont utilisés pour le traitement et que le couple qui en bénéficie n’est ni marié, ni en partenariat civil, le second parent (qui n’est pas la mère ayant donné naissance à l’enfant) peut acquérir le statut de parent légal si les conditions requises sont remplies (voir articles 37 et 44 de la Loi HFE de 2008). À défaut, le statut de parent sera incertain et le couple devra demander une déclaration de paternité ou de maternité auprès d’un tribunal pour établir leur statut de parent légal.

R (TT) c Greffier général de l'Angleterre et du Pays de Galles et Ors ((2019) EWHC 2384 (Fam))
L'affaire concerne un homme transgenre (TT) qui possède un certificat de reconnaissance de genre confirmant qu'il est un homme à toutes fins légales, à l'exception des exceptions limitées énoncées dans la loi de 2004 sur la reconnaissance du genre (Gender Recognition Act 2004). TT avait une insémination artificielle utilisant du sperme de donneur dans une clinique de fertilité agréée. Elle Il tomba enceinte et donna naissance à un enfant en 2017. Il tenta d'enregistrer la naissance en tant que père mais fut refusé par le registraire général (RG), qui était seulement capable d’enregistrer la naissance avec TT en tant que mère. La naissance est restée non enregistrée.
Le jugement a été rendu le 25 septembre 2019. Le juge a souscrit à la position du gouvernement selon laquelle une personne qui donne naissance à un enfant (c'est-à-dire, y compris un homme transsexuel tel que TT) sera la mère de l'enfant. Le Gouvernement estime que l’arrêt n’a aucun effet sur la disponibilité d’un traitement de fertilité réglementé au Royaume-Uni. Le gouvernement considère que les traitements de fertilité réglementés sont actuellement et resteront également accessibles à toutes les femmes (trans) et hommes (trans) au titre des lois sur la fertilisation humaine et l'embryologie.

Conformément à la législation autrichienne, la mère d’un enfant est la femme qui lui a donné naissance. Le père est le mari de la mère, ou l’homme qui reconnaît sa paternité ou dont la paternité lui a été imposée par le tribunal. Les dispositions de certains articles de la loi varient selon que le traitement est proposé à un couple ou à une femme célibataire.
Les centres de santé du service public refusent la PMA aux couples de lesbiennes et aux femmes célibataires au motif que ces services ne sont fournis que sur indication médicale. C’est pourquoi les couples de lesbiennes et les femmes célibataires se tournent vers le secteur privé pour bénéficier de tels services.
Le Médiateur de la non-discrimination a demandé au Tribunal national de non-discrimination et d'égalité de décider si la directive du médecin en chef du district hospitalier universitaire d'Helsinki selon laquelle les couples de femmes sont exclus de l'aide traitements de fertilité est discriminatoire. Dans la décision du Tribunal, la directive a été considérée comme une discrimination directe. Le tribunal administratif d'Helsinki a rendu une décision sur la question 6.3.2019 selon laquelle le Tribunal national de la discrimination et de l'égalité a été autorisé à interdire cette discrimination fondée sur la Loi sur la non-discrimination (paragraphe 8, paragraphe 2 de la loi, 1325/2014).

L’enfant et son représentant légal ne peuvent avoir accès qu’aux données médicales qui sont gardées secrètes et conservées sous une forme codifiée dans les banques de cryoconservation.
La Loi 2472/1997 sur la protection des personnes à l’égard du traitement des données à caractère personnel qualifie les données médicales d’informations « sensibles » et attribue une compétence particulière à l’Autorité de protection des données (article 7).
Conformément à l’article 20, paragraphe 3 de la Loi 3305, l’accès au Registre national des donneurs et des receveurs n’est autorisé qu’à l’enfant et pour des raisons liées à sa santé, sous réserve de l’autorisation de l’Autorité de protection des données et du respect des conditions énoncées dans la Loi 2472/1997 concernant la protection des données à caractère personnel. Les parents ne peuvent avoir accès aux informations qu’à titre de représentants de l’enfant. Un tribunal peut ordonner l’accès aux informations.
En particulier :
a. Identité du (des) donneur(s): Pour l’enfant lui-même Non/pour les parents Non/pour un tribunal ? Non
La loi adopte le principe de l’anonymat pour tout don : par conséquent, l’identité du donneur ne peut en aucun cas être révélée. L’enfant et son représentant légal ne peuvent avoir accès qu’aux données médicales qui sont gardées secrètes et conservées sous une forme codifiée dans les banques de cryoconservation.
b. Certaines informations dans le domaine de la santé concernant le (les) donneur(s) Pour l’enfant lui-même Oui/pour les parents Oui/pour un tribunal ? Oui. L’enfant ou les parents (agissant comme les représentants de l’enfant) peuvent avoir accès aux informations de santé qui sont gardées secrètes et conservées sous une forme codifiée dans les banques de cryoconservation., mais pas à l’identité du donneur. Un tribunal peut également autoriser l’accès aux informations de santé.

18. Est-il possible de contester la maternité et la paternité des enfants nés après PMA et sous quelles conditions (dispositions relevant du droit de la famille) ? Oui.
Contestation de maternité et de paternité : la contestation de paternité n’est pas autorisée quand le père a donné son consentement au début du traitement.
De même, conformément à la Loi 3089/2002, le consentement de l’homme et de la femme vivant en union libre est donné devant notaire afin de garantir leur filiation avec l’enfant à naître. Par conséquent, toute contestation de la filiation librement consentie est interdite.
Dans le cas d’une maternité de substitution, selon la loi, la femme qui a obtenu l’approbation du tribunal est considérée comme la mère légale de l’enfant. A titre exceptionnel, la mère porteuse ou la personne ayant sollicité ses services peuvent contester la maternité devant un tribunal, dans les conditions prévues par la loi.
19. Ces questions ou des problèmes qui y sont liés font-ils actuellement l’objet d’un débat important dans votre pays ? Aucun processus de révision n’est actuellement prévu pour cette loi

6. Est-il possible, dans votre pays, de procéder à un don de sperme ? Oui / d’ovocyte ? Oui / c. d’embryon ? Oui
La loi sur l'assistance médicale à la procréation (2016-09-14 n° XII-2608) légalise le don de cellules reproductrices lorsque l'un des époux ou partenaires a des cellules reproductrices endommagées ou insuffisantes qui ne peuvent pas être utilisées pour la fécondation assistée, ainsi que dans les cas où elles présentent un risque élevé de transmission d'une maladie susceptible d'entraîner un handicap important. La loi sur la procréation assistée autorise également le don d'embryons. Conformément à l'article 8, paragraphe 3, de la loi, le don d'embryons conservés dans la banque de cellules germinales est possible si les conjoints (partenaires) refusent l'embryon par écrit. Un tel refus n'est pas possible avant l'expiration d'un délai de deux ans après le début des procédures de PMA.
7. Des mesures de compensation sont-elles prévues pour de tels dons ? Non. Conformément à la loi sur la PMA, le don de gamètes et d’embryons humains à visée commerciale est interdit.
8. Des critères spécifiques sont-ils définis pour effectuer un don de sperme ? Oui / d’ovocyte ? Oui / d’embryon ? Oui
Conformément à la loi sur la PMA, il est interdit de procurer et/ou d’utiliser les gamètes d’une personne décédée pour la PMA. Si la personne dont les gamètes sont stockés dans une banque de gamètes, décède, ses gamètes doivent être détruits. Les gamètes de la personne décédée ne peuvent être utilisés pour la PMA d’une personne donnée que si la personne décédée avait donné de son vivant son consentement à l’utilisation de ses gamètes.
Le don d'embryons conservés dans la banque de cellules germinales est possible si les conjoints (partenaires) refusent l'embryon par écrit. Ce refus n'est pas possible avant l'expiration d'un délai de deux ans après le début des procédures de PMA.
9. Existe-t-il des critères non médicaux spécifiques pour la sélection des gamètes/de l’embryon devant être utilisé(s) pour une procédure de PMA? Non
10. Des mesures particulières sont-elles prises pour prévenir le risque de consanguinité ? Oui. Toutes les informations concernant les gamètes déposés dans la banque des gamètes, y compris les informations sur les embryons humains stockés et utilisés et les enfants nés après la PMA doivent être enregistrées dans le système d’information PMA.
11. Dans un couple homosexuel, un lien juridique est-il possible entre un enfant et le/la partenaire de son parent légal ? Non

Les articles 26 et 55, alinéa 2, de la loi, insérés par une loi du 10 avril 2014 et entrés en vigueur le 10 mai 2014, prévoient que si les deux auteurs du projet parental sont deux femmes, elles sont considérées comme une seule femme, dans le décompte du maximum de six femmes qui peuvent donner naissance à des enfants à partir de gamètes ou d'embryons surnuméraires provenant d'un donneur ou d'un couple de donneurs.
