La Loi réglemente pour l’essentiel la question de l’établissement de la filiation de l’enfant à naître à la suite d’une procédure de procréation médicalement assistée (PMA). De plus, elle légalise l’insémination post-mortem et la maternité de substitution, sous certaines conditions spécifiées dans les articles pertinents.

La loi 3305 relative à la procréation médicalement assistée en Grèce a été adoptée en 2005. Cette loi, qui régit principalement le fonctionnement des unités de PMA, vient en complément de la précédente loi 3089, laquelle réglemente pour l’essentiel la question de l’établissement de la filiation de l’enfant à naître. Elle porte sur les méthodes de PMA, les conditions de demande, les questions de consentement éclairé, la cryoconservation des gamètes, le don de gamètes, la recherche sur les embryons, la maternité de substitution, la traçabilité, etc. La loi prévoit par ailleurs des sanctions administratives et pénales pour ceux qui n’en respecteraient pas les dispositions.
Elle met également en place le mécanisme de contrôle compétent, à savoir L’autorité Nationale pour la PMA. Aux termes de cette loi, les méthodes de PMA sont appliquées de manière à garantir le respect de la liberté de l’individu et du droit au développement de la personnalité (un droit protégé par la Constitution grecque), ainsi que la satisfaction du désir d’enfant, conformément aux principes de la bioéthique. La loi dispose en outre que l’application de ces méthodes doit toujours tenir compte du bien-être de l’enfant à naître.
