Art. 18 : Tout enfant mentalement capable pourra demander des informations médicales importantes sur le donneur dès l’âge de 15 ans. Le représentant légal de l’enfant ne pourra obtenir ces informations que sur autorisation du tribunal, lorsque des raisons médicales exceptionnellement importantes l’exigent.
Le médecin de l’enfant a un droit d’accès aux informations contenues dans le registre des donneurs, pour des raisons de santé.

En principe, non.
- Art. 41 : La maternité ne peut être contestée si la mère avait donné son consentement à une procédure de PMA. Si un ovule provenant d’un don est utilisé, la donneuse ne peut revendiquer la maternité de l’enfant, et la maternité biologique ne peut être établie au bénéfice d’un tiers.
- Art. 42 : La paternité ne peut être contestée, sauf si le requérant soutient que l’enfant n’a pas été conçu par PMA. Dans ce cas, les articles 96-99 de la loi sur le mariage et les relations familiales s’appliquent.
Lorsque du sperme provenant d’un don est utilisé, le donneur ne peut revendiquer la paternité de l’enfant, et la paternité biologique ne peut être établie au bénéfice d’un tiers.

Les coordonnées et toute autre information figurant dans le dossier médical
Un enfant conçu à partir d’un don a le droit, à « l’âge de sa maturité » (environ 18 ans, selon l’interprétation qui en est faite) et sur demande, de connaître l’identité et les coordonnées du donneur en question. Ces informations sont conservées pendant une durée de 70 ans dans un registre spécial des donneurs. Les parents sont encouragés à informer leur enfant qu’il a été conçu à partir d’un don.
18. Est-il possible de contester la maternité et la paternité des enfants nés après PMA et sous quelles conditions (dispositions relevant du droit de la famille) ? Non.
La question de la paternité est réglementée par le Code parental.
La paternité d’un enfant peut être contestée s’il est improbable, eu égard aux circonstances, que l’enfant ait été conçu par une insémination ou une FIV.

3. Les procédures de PMA sont-elles prises en charge par le système de sécurité sociale ?
La situation peut varier selon le comté, mais de manière générale, un certain nombre de tentatives de PMA sont prises en charge ; actuellement, la plupart des cliniques publiques ou sous contrat proposent trois essais, conformément à une recommandation nationale (de l’Association suédoise des pouvoirs locaux et régionaux, SKL).
La PMA est considérée comme partie intégrait des soins de santé.
4. Cette prise en charge est-elle soumise à des critères particuliers (par exemple, infertilité, limite d’âge) ? Recommandations nationales : Si le couple/la femme est autorisé(e) à bénéficier d’une PMA conformément aux critères précités, il/elle pourra effectuer trois essais. De manière générale, une femme âgée de plus de 40 ans ne pourra bénéficier du traitement à moins qu’elle ne dispose d’embryons congelés avant l’âge de 40 ans, auquel cas ils devront être utilisés avant qu’elle atteigne l’âge de 45 ans. Ce principe s’applique indépendamment de la prise en charge financière. L’autre parent ne doit pas être âgé de plus de 56 ans.

Oui. Pour les gamètes, l’anonymat est la règle, mais la loi autorise le don non anonyme lorsqu’il résulte d’un accord entre le donneur et le ou les receveurs.
Est-il possible d’obtenir des informations sur l’origine biologique d’un enfant né à la suite d’un don de gamètes ou d’embryon ?
Pour l’enfant lui-même : non.
Pour les parents : non, la loi prévoit que dès l’implantation d’embryons surnuméraires ou de gamètes, les règles de filiation du Code civil jouent en faveur du ou des auteurs du projet parental. Aucune action relative à la filiation ne peut être intentée à l’encontre du donneur par le receveur ou par l’enfant né de l’insémination d’embryons surnuméraires ou de gamètes.
Pour un tribunal : il n’existe aucune disposition légale spécifique applicable aux tribunaux dans ce domaine. On ne peut exclure la possibilité qu’un juge puisse obtenir des informations sur l’origine biologique d’un enfant né à la suite d’un don de gamètes ou d’embryon, si cela est jugé nécessaire.

Le centre de fécondation est légalement tenu de rendre inaccessible toute donnée permettant l’identification du donneur d’embryons ou de gamètes. Toute personne travaillant pour ou dans un centre de fécondation, qui prend connaissance d’informations permettant d’identifier le donneur est tenue au secret professionnel (art. 458 du Code pénal). Cependant, le don non anonyme de gamètes résultant d’un accord entre le donneur et le ou les receveurs est autorisé.

Conformément à la loi, le centre enregistre certaines informations relatives au donneur, y compris les caractéristiques physiques des deux géniteurs d’embryons ou du donneur de gamètes. Les parents et l’enfant n’ont toutefois accès qu’aux données médicales nécessaires pour la santé de ce dernier.

Des mesures de compensation sont-elles prévues pour de tels dons (par exemple, une compensation financière, des frais réduits pour une procédure de PMA dans le cas de don d’ovocyte) ?
La loi de 2007 précise que seuls les dons d’embryons surnuméraires et de gamètes effectués à titre gratuit sont licites.
Cependant, la loi permet au Roi de fixer une indemnité qui couvre les frais de déplacement ou de perte de salaire de la personne sur laquelle on prélève des gamètes. Cette indemnité peut également couvrir les frais d’hospitalisation inhérents au prélèvement d’ovocytes chez la donneuse. Mais aucun arrêté n’a été pris dans ce sens jusqu’à présent.
En pratique, l’ensemble des frais liés aux examens et procédures médicales durant le traitement sont pris en charge par la receveuse. Il arrive également que le centre de fécondation exige que la receveuse d’ovocytes verse une « indemnité » à la donneuse, et qu’une modeste compensation soit offerte au donneur de sperme, par échantillon utilisable.
Des critères spécifiques sont-ils définis pour effectuer un don?
La loi de 2007 précise que le prélèvement de gamètes est ouvert aux femmes majeures jusque 45 ans. Cependant, un prélèvement de gamètes, d’embryons surnuméraires, de gonades ou de fragments de gonades pour cryoconservation peut être effectué, sur indication médicale, sur un mineur.
Sont interdits, les dons d’embryons surnuméraires ou de gamètes à caractère eugénique ou axés sur la sélection du sexe.
Il doit exister une convention écrite entre le donneur et le centre de fécondation agréé. La loi ne mentionne pas de critères médicaux pour le prélèvement.
Existe-t-il des critères non médicaux spécifiques pour la sélection des gamètes/de l’embryon devant être utilisé(s) pour une procédure de PMA (par exemple, correspondance entre l’apparence physique du (des) donneur(s) et des futurs parents) ?
Dans la pratique, les centres cherchent à éviter une dissemblance trop importante entre donneurs et receveurs.
La loi de 2007 précise que l’appariement entre donneur et receveur ne peut être considéré comme une pratique à caractère eugénique.
Des mesures particulières sont-elles prises pour prévenir le risque de consanguinité ? (par exemple, registre officiel, nombre de dons limité)
La loi de 2007 dispose que les embryons surnuméraires d’un même donneur ou couple de donneurs ou les gamètes d’un même donneur, ne peuvent conduire à la naissance d’enfants chez plus de 6 femmes différentes.
Dans un couple homosexuel, un lien juridique est-il possible entre un enfant et le/la partenaire de son parent légal ?
La loi du 18 mai 2006 a modifié certaines dispositions du Code civil pour permettre l’adoption par des personnes de même sexe.

Depuis la loi n°2021-1017 du 2 août 2021 relative à la bioéthique, l’enfant issu d’une AMP peut, à sa majorité, s’il le souhaite, accéder aux données non identifiantes (âge, état général, caractéristiques physiques, situation familiales et professionnelle, pays de naissance, motivation du don) et à l’identité du donneur.
A compter du 1e septembre 2022 le consentement du donneur à cette communication devient une condition sine qua non du don et les personnes nées de ces dons ont donc la garantie de pouvoir accéder à ces données à leur majorité si elles le souhaitent.
S’agissant des dons effectués avant le 1e septembre 2022, le législateur donne la possibilité au donneur de consentir a posteriori à cette communication soit sur simple manifestation spontanée soit par l’intermédiaire d’une procédure de contact du donneur. Ces donneurs gardent la possibilité de refuser la communication de leurs données.
L’anonymat du don entre donneurs et receveurs n’est pas remis en cause.

Depuis la loi n°2021-1017 du 2 août 2021 relative à la bioéthique, l’accès est réservé aux couples formés d’un homme et d’une femme ou de deux femmes ou à toute femme non mariée, vivants et consentant préalablement au transfert des embryons ou à l'insémination. Le recours à l’AMP est désormais conditionné à l’existence d’un projet parental. Les critères médicaux liés à l’infertilité pathologique médicalement constatée ou à la transmission d’une maladie d’une particulière gravité, qui conditionnaient auparavant l’accès à l’AMP, ont été supprimés. Font obstacle à l'insémination ou au transfert des embryons le décès de l'un des membres du couple, l’introduction d’une demande en divorce ou en séparation de corps, la signature d’une convention de divorce ou de séparation de corps par consentement mutuel, la cessation de la communauté de vie, ainsi que la révocation par écrit du consentement, auprès du médecin chargé de mettre en œuvre l'assistance médicale à la procréation ou du notaire qui a reçu le consentement.

Les tests nécessaires doivent être effectués pour s’assurer de la bonne santé du donneur et de sa fertilité, ainsi que pour prévenir la transmission de maladies par les gamètes. Si des gamètes importés sont utilisés, les exigences précitées doivent être respectées. Le médecin doit s’efforcer de répondre au souhait des personnes concernées de faire correspondre au mieux la corpulence, la taille, la couleur des yeux et des cheveux, ainsi que le groupe sanguin du donneur de gamètes avec ceux des parents. 10. Des mesures particulières sont-elles prises pour prévenir le risque de consanguinité ? Oui. Indirectement. Voir art. 18 reg. 568/1997. Si un donneur souhaite rester anonyme, le personnel de santé est tenu de s’assurer que ce souhait est respecté. Dans ce cas, le donneur ne peut recevoir d’information ni sur le couple qui bénéficiera du don de gamètes, ni sur l’enfant, de même que ni le couple ni l’enfant ne peuvent recevoir d’informations sur le donneur. Si le donneur ne souhaite pas rester anonyme, l’établissement conserve les informations le concernant dans un dossier spécial. Si le don de gamètes aboutit à la naissance d’un enfant, les informations concernant ce dernier et le couple qui a bénéficié du don seront conservées dans le même dossier. Un enfant né grâce aux gamètes d’un donneur qui ne souhaite pas rester anonyme peut, à l’âge de 18 ans, avoir accès au dossier conformément au paragraphe 2 afin d’obtenir des informations sur l’identité du donneur. Si l’établissement concerné communique à l’enfant des informations sur le donneur de gamètes, il doit, dès que possible, en informer le donneur.
11. Dans un couple homosexuel, un lien juridique est-il possible entre un enfant et le/la partenaire de son parent légal ? Oui. Art. 6, Loi n°87/1996 (les dispositions de la Loi sur l’adoption concernant les époux ne s’appliquent pas au partenariat enregistré. Une personne ayant conclu un partenariat enregistré peut adopter l’enfant de son partenaire dont celui-ci a la garde, à condition que l’enfant n’ait pas fait l’objet d’une procédure d’adoption internationale. Pour le don d’embryon, les embryons issus d’un même couple ne peuvent être implantés en PMA qu’à un maximum de deux personnes différentes. (Loi § 175 (4)).
10. Des mesures particulières sont-elles prises pour prévenir le risque de consanguinité ? Oui.
Un même donneur de gamètes ne peut avoir plus de quatre descendants avec des personnes différentes dans le cadre d’une procédure de PMA.
La PMA ne peut être demandée par des personnes présentant un lien de parenté qui les empêcherait de se marier légalement (Code civil § 4 :12 (1) a) et b), en l’occurrence, les frères et sœurs et parents linéaires).
Pour les autres degrés de consanguinité, le médecin proposant la PMA doit consulter au préalable le Centre régional de génétique (Décret §1 (3)).
Les embryons issus d’un même couple ne peuvent être implantés en PMA qu’à un maximum de deux personnes différentes (Loi § 175 (4)).

La réglementation hongroise considère l’infertilité comme un état pathologique touchant les familles ou même les femmes célibataires ayant un désir d’enfant. Au plan légal, la PMA est traitée comme toute autre pathologie (Loi et décret 49/1997 du ministre des Affaires sociales sur le financement des interventions médicales contre l’infertilité par le système de sécurité sociale).
4. Cette prise en charge est-elle soumise à des critères particuliers (par exemple, infertilité, limite d’âge) ? Oui. L’infertilité est la condition de prise en charge de la PMA. L’âge ne peut être pris en considération que pour ce qui est de l’état pathologique à l’origine de l’infertilité.

Comme mentionné précédemment, il est proposé d’inclure dans la législation une disposition selon laquelle les services de procréation assistée doivent être accessibles à tous indépendamment du genre, de l’état matrimonial ou de l’orientation sexuelle. Toutefois, dans l’intérêt de tout enfant issu de techniques de procréation assistée (ou des enfants des familles souhaitant bénéficier de ces techniques), la législation prévoira une évaluation du bien-être de l’enfant qui permettra de déterminer si le couple demandeur remplit les conditions requises pour un traitement de procréation assistée. Cette évaluation portera sur l’âge et l’état de santé du couple demandeur, ainsi que sur sa capacité à assurer un environnement stable et sain pour un des enfants.

La question de la maternité de substitution a été reportée en raison de la nature controversée de l'abus du corps féminin et des conséquences juridiques que la maternité de substitution peut entraîner dans certains cas. Cependant, il semblerait que la discussion sera soulevée à l'avenir pour les couples hétérosexuels et homosexuels. La loi sur la protection des embryons, telle qu'amendée, ne permet pas le recours à la maternité de substitution et n'est pas discutée.
Note : Ceci dit, comme l'indique l'article 19, discuté ci-dessus, le don de gamètes est un accord privé, de sorte que les couples homosexuels, par exemple, peuvent contourner les dispositions en se faisant donner du sperme dans le cas des couples homosexuels féminins, et les couples homosexuels masculins peuvent donner leur sperme par un accord privé à une femme, qui peut être la mère porteuse (en utilisant ses propres ovules par insémination artificielle par donneur) et ensuite abandonner l'enfant. L'article 19 de la loi semble l'interdire selon mon interprétation. Les procédures de PMA sont couvertes par le Système national de soins de santé, une part restant à la charge du patient. La policlinique où la procédure de PMA est mise en œuvre est financée comme suit :
- remboursement à l’acte par le Régime national d’assurance maladie sur la base du régime applicable aux procédures de FIV et d’injection intracytoplasmique de spermatozoïdes (ICSI) ;
- subventions forfaitaire de l’Etat
- ticket modérateur à la charge du patient : le couple/la femme paie un maximum de 18 800 NOK pour couvrir une partie du coût des médicaments et du traitement par FIV/ICSI. Trois cycles de traitement (trois procédures de FIV ou de ICSI, ou une combinaison) sont généralement proposés aux couples pour chaque enfant.

Tous les femmes/couples qui se voient proposer une bénéficient d’une prise en charge partielle des médicaments et des frais de traitement pour les traitements de FIV/ICSI. La décision de proposer ou non un traitement sera prise sur la base des critères suivants :
La première étape consistera pour la femme/ le couple à consulter le médecin de famille. Après évaluation médicale et psychosociale du couple, le médecin décidera d’orienter ou non la femme/le couple vers l’un des centres pratiquant la PMA.
Le médecin de la clinique décide si la femme/le couple se verra proposer la PMA ou non. Selon la loi sur la biotechnologie, une clinique proposant la PMA doit obtenir une autorisation ou un agrément de la direction de la santé.
Pour avoir accès à la PMA par le biais des cliniques financées par le système national de soins de santé, une évaluation de la rentabilité présumée du traitement pour la femme/le couple est effectuée.
De nombreux centres ont établi des lignes directrices pour l’évaluation des couples demandant à bénéficier d’une assistance médicale à la procréation.
Les femmes/couples peuvent également choisir de payer pour un traitement dans des cliniques privées, ce qui peut permettre de raccourcir le temps d'attente, et ces cliniques ne sont pas liées par les mêmes principes de rentabilité.
Une femme ne peut avoir plus de 46 ans au moment de l'insémination ou de l'implantation de l'embryon.

- la femme est porteuse de maladies graves liées au chromosome X. Dans ce cas, la loi autorise le recours à des procédures de sélection des spermatozoïdes pour assurer une descendance féminine. Ces procédures ne peuvent être acceptées qu'après une évaluation scientifique approfondie et doivent être approuvées par la Direction de la santé et des affaires sociales.
- le mari/conjoint est atteint ou porteur d'une maladie héréditaire grave
- s'il existe un risque de transmission d'une maladie grave et chronique sexuellement transmissible.
La loi ne prévoit pas de droit au traitement dans les cas où il existe un risque de transmission de maladies, par exemple entre la femme et son mari/conjoint.
En ce qui concerne la situation où l'un ou les deux partenaires sont atteints d'une infection sexuellement transmissible grave et chronique : Lorsque la femme est infectée, une évaluation du risque de transmission du virus à l'enfant doit être faite dans chaque cas avant de décider de poursuivre.
Une femme ne peut avoir plus de 46 ans au moment de l'insémination ou de l'implantation de l'embryon.
Les critères d'infertilité pour l'accès à la FIV ne s'appliquent pas dans les cas où un couple de même sexe se fait traiter par don de partenaire (l'une des femmes donne son ovule à l'autre qui porte l'enfant).

Il n’existe pas de dispositions légales spécifiques en la matière.
D’après les règles générales du droit de la filiation, il n’est pas possible de contester la paternité dans le cas d’une insémination avec sperme du conjoint (homologue).
En revanche, dans le cas d’une insémination hétérologue, la contestation de paternité ne serait possible que dans le cas où le conjoint de la femme inséminée n’aurait pas consenti à l’insémination avec le sperme d’un autre homme.

Certaines questions sont traitées dans l’Avis de l’Association polonaise des obstétriciens. Les règlements internes des centres de PMA définissent les critères médicaux applicables aux donneurs. Parmi ces critères figurent : l’âge : 30-45 ans (corrélation entre le risque de maladie génétique, par ex. trisomie 21 et l’âge), état de santé (absence de maladie mentale, systémique, tumorale ou infectieuse), dépistage de virus et de maladies sexuellement transmissibles. Lorsqu’une patiente présent un risque élevé de transmission d’une maladie génétique à sa descendance, le donneur de sperme doit passer les tests d’exclusion du même gène autosome récessif. Le groupe sanguin du donneur doit également être connu pour assurer sa compatibilité avec ceux des parents.
Les analyses de sperme sont effectuées conformément aux normes de l’OMS. Le sperme n’est conservé que si les tests bactériologiques sont négatifs. Le sperme doit être congelé pendant une période de 6 mois avant la première insémination.
9. Existe-t-il des critères non médicaux spécifiques pour la sélection des gamètes/de l’embryon devant être utilisé(s) pour une procédure de PMA? Non. Il n’existe pas de dispositions légales en la matière. Dans la pratique, les grands traits de ressemblance physique et ethnique (couleur de peau) sont pris en compte.

Le don de gamètes (sperme et ovocytes) et d’ovules fécondés (uniquement les ovules fécondés surnuméraires) n’est autorisé qu’avec le consentement du donneur.

Selon la Loi 3305/05 (article 8, paragraphe 1) « Toute rémunération ou indemnité pour un don de gamètes et d’ovule fécondé est interdite. Cependant, les frais médicaux, les soins ou les frais de laboratoire, les frais de déplacement et d’hébergement, ainsi que l’absence au travail, peuvent donner lieu à un dédommagement ».
L’Autorité nationale pour la PMA a adopté par la suite une décision (Décision n°36, Journal officiel 670 B’ 16.4.2008) qui prévoit une compensation pour les frais médicaux, les soins et les frais de laboratoire engagés avant et après le don. Les frais d’hébergement et de transport peuvent également faire l’objet d’une compensation. Ce montant ne doit pas dépasser 200 € pour un don de sperme et 600 € pour un don d’ovocyte. Une compensation pour absence au travail est également possible.

Les donneurs doivent avoir atteint l’âge de la majorité et être dotés de la pleine capacité juridique. Ils doivent être âgés de moins de 40 ans pour les dons de sperme et de moins de 35 ans pour les dons d’ovocytes. Sur autorisation de l’Autorité nationale pour la PMA, ces limites d’âge peuvent être étendues à 50 et 40 ans respectivement, dans le cas d’un don d’ovule fécondé ou s’il existe des motifs sérieux de le faire. Dans ce cas, des informations spécifiques doivent être fournies aux receveurs sur le risque accru de maladies génétiques, ainsi que sur la nécessité d’un examen prénatal.
Les donneurs sont soumis à des examens médicaux et de laboratoire spécifiques définis par l’Autorité nationale (eu égard aux évolutions scientifiques).

Aux termes de la loi, la sélection du donneur relève de la responsabilité de l’unité de PMA. La loi sur les embryons fixe des critères pour garantir le libre consentement du donneur. Également, la directive professionnelle indique que le don d'ovocytes est contre-indiqué pour

- les femmes qui présentent un risque plus élevé de complications comme le cas de stimulation ou de fonction ovocytaire;
- les femmes atteintes de maladies sexuellement transmissibles qui ne peuvent être guéries
- les femmes atteintes d'une maladie génétique au sein de leur famille.
Ces contre-indications sont absolues. De plus, certaines femmes ont une contre-indication relative au don d'ovocytes, par exemple les femmes qui n'ont pas d'enfants elles-mêmes et qui ont moins de 30 ans.
9. Existe-t-il des critères non médicaux spécifiques pour la sélection des gamètes/de l’embryon devant être utilisé(s) pour une procédure de PMA? Non.
10. Des mesures particulières sont-elles prises pour prévenir le risque de consanguinité ? Oui. Il existe une directive professionnelle qui limite le nombre de descendants d'un donneur à 25 enfants ou 12 familles. Étant donné que les cliniques n’ont désormais pas de base légale pour vérifier si un donneur fait également un don dans d’autres cliniques, il y a un changement juridique en préparation qui permet l’enregistrement national des donneurs, de sorte que le nombre limité de descendants puisse être surveillé.
11. Dans un couple homosexuel, un lien juridique est-il possible entre un enfant et le/la partenaire de son parent légal ? Oui. Lorsque deux femmes sont mariées, la deuxième mère peut facilement devenir la mère légale. Dans d'autres cas, une procédure d'adoption est nécessaire.

Lorsque des gamètes issus de dons sont utilisés, le couple ou la femme célibataire fera l’objet d’une évaluation portant sur son état de santé et sa situation socio-économique. Si le couple/la femme sont jugés inaptes, ils peuvent se voir refuser le traitement ; cette décision peut faire l’objet d’un recours devant la Rättsliga Rådet (Conseil juridique de la Commission nationale de la santé et des affaires sociales). Même lorsque le couple a recours à ses propres gamètes, le centre concerné peut refuser l’accès au traitement s’il considère que cela peut ne pas être dans l’intérêt de l’enfant pour des raisons médicales.
La femme doit être « fertile » au regard de son âge biologique ; en général, une limite d’âge de 40 ans est appliquée. Si la qualité ou la quantité des ovocytes ne sont pas suffisantes, elle peut se voir refuser l’accès au traitement même si elle est plus jeune.

Slovénie - Situations particulières relevant de ces questions dans votre pays
19. Ces questions ou des problèmes qui y sont liés font-ils actuellement l’objet d’un débat important dans votre pays ?
Pas actuellement, mais une loi modifiée sur la procréation médicalement assistée a été adopté en 2001, rendant entre autres les services de PMA librement accessibles aux femmes célibataires sans partenaire masculin et sans problème médical de fertilité, ce qui était impossible aux termes de la précédente loi (2000). Un groupe d’opposition au Parlement a appelé à un référendum législatif, ce qui a suscité un débat public animé. Le Comité national d’éthique médicale (NMEC) et le Conseil national de la santé ont déconseillé le recours arbitraire à la médecine pour les interventions susceptibles d’avoir de lourdes conséquences, lorsqu’il n’existe comme dans ce cas aucune indication médicale valable. Le NMEC a cité le rapport de 1989 du CAHBI (Comité ad hoc d’experts sur les progrès des sciences biomédicales) sur la procréation artificielle humaine, qui limite l’utilisation des procédures de PMA aux couples hétérosexuels et aux situations d’indications médicales strictes (infertilité, échec d’autres méthodes de traitement, nécessité d’éviter la transmission d’une maladie grave), comme le prévoyait la précédente loi.
Lors du référendum, la nouvelle loi a été rejetée avec une majorité écrasante de presque 3 contre 1. Par conséquent, la loi de 2000 décrite ci-dessus est restée en vigueur.
