The complaint was registered on 14 February 2022. It relates to Articles 23 (the right of elderly persons to social protection) 15 (the right of persons with disabilities to independence, social integration and participation in the life of the community), 16 (the right of the family to social, legal and economic protection), 30 (the right to protection against poverty and social exclusion), 31 (the right to housing), E (non-discrimination) and G (restrictions) of the Revised Social Charter. FIAPA alleges that the legal and judicial protection of elderly persons is not ensured due to France's failure to implement its own legislation on the legal protection of adults, both in civil and criminal matters. FIAPA argues that this lack of enforcement is due to the fact that there is no effective control over the application of the existing regulations, as the legislation does not provide for sanctions. It also argues that recent reforms have not improved the situation of the elderly, in violation of the above-mentioned provisions of the Charter.
