16. Les dons suivants sont-ils anonymes ? sperme Oui / d'ovocyte Oui /d'embryon -. Voir art. 18 reg. 568/1997. Si un donneur souhaite rester anonyme, le personnel de santé doit veiller à ce que ce souhait soit respecté. Dans ce cas, le donneur ne peut recevoir d’information ni sur le couple qui bénéficiera du don de gamètes, ni sur l’enfant, de même que ni le couple ni l’enfant ne peuvent recevoir d’informations sur le donneur. Si le donneur ne souhaite pas rester anonyme, l’établissement conserve les informations le concernant dans un dossier spécial. Si le don de gamètes aboutit à la naissance d’un enfant, les informations concernant ce dernier et le couple qui a bénéficié du don seront conservées dans le même dossier. Un enfant né grâce aux gamètes d’un donneur qui ne souhaite pas rester anonyme peut, à l’âge de 18 ans, avoir accès au dossier conformément au paragraphe 2 afin d’obtenir des informations sur l’identité du donneur. Si l’établissement concerné communique à l’enfant des informations sur le donneur de gamètes, il doit, dès que possible, en informer le donneur.
17. Est-il possible d’obtenir des informations sur l’origine biologique d’un enfant né à la suite d’un don de gamètes ou d’embryon Pour l’enfant lui-même Oui. 18. Est-il possible de contester la maternité et la paternité des enfants nés après PMA et sous quelles conditions (dispositions relevant du droit de la famille) ? Non. Voir art. 6 de la Loi sur l’enfance, N°76/2003. (Un homme qui consent à ce que sa femme bénéficie d’une insémination artificielle conformément à la loi est considéré comme le père de l’enfant conçu. La même règle s’applique à un homme et une femme qui ont officiellement fait une déclaration de vie commune auprès du Registre national. En vertu des dispositions de la Loi sur l’insémination artificielle, un homme qui effectue un don de sperme pour que celui-ci soit utilisé pour l’insémination artificielle d’une femme autre que son épouse ou sa concubine (cf. paragraphe 1) ne sera pas considéré comme le père de l’enfant conçu avec son sperme.
