La législation nationale repose sur les notions de « couple » (un homme et une femme mariés ou vivant dans une relation comparable au mariage ou deux femmes vivant ensemble dans le mariage, le partenariat enregistré ou dans une relation comparable à mariage) et de « bénéficiaire du traitement » (un couple ou une femme ne vivant pas dans un mariage, une relation comparable au mariage, un partenariat enregistré ou avec une personne de sexe opposé). Les dispositions de certains articles de la loi varient selon que le traitement est proposé à un couple ou à une femme célibataire.
Les centres de santé du service public refusent la PMA aux couples de lesbiennes et aux femmes célibataires au motif que ces services ne sont fournis que sur indication médicale. C’est pourquoi les couples de lesbiennes et les femmes célibataires se tournent vers le secteur privé pour bénéficier de tels services.
Le Médiateur de la non-discrimination a demandé au Tribunal national de non-discrimination et d'égalité de décider si la directive du médecin en chef du district hospitalier universitaire d'Helsinki selon laquelle les couples de femmes sont exclus de l'aide traitements de fertilité est discriminatoire. Dans la décision du Tribunal, la directive a été considérée comme une discrimination directe. Le tribunal administratif d'Helsinki a rendu une décision sur la question 6.3.2019 selon laquelle le Tribunal national de la discrimination et de l'égalité a été autorisé à interdire cette discrimination fondée sur la Loi sur la non-discrimination (paragraphe 8, paragraphe 2 de la loi, 1325/2014).
