Powrót Portugal: Recent good practices in the field of the execution of the European Court’s judgments

On 13 March, the Plenary of the High Council of the Judiciary (Conselho Superior de Magistratura) adopted an Action Plan aimed at disseminating within the judiciary rulings of the European Court of Human Rights. The initiative intends to select and share judgments in which Portugal was found to have breached the European Convention on Human Rights, as well as judgments confirming that Portugal has aligned its domestic legal system with the Convention.

The Action Plan seeks to raise awareness among judges regarding potential shortcomings in the domestic practice while reinforcing the protection of human rights in line with the European Court’s case law. This structured dissemination is expected to contribute to preventing future violations and enhance the application of the Convention by domestic courts.

The Action Plan also envisages the establishment of a working group including judges and the Government Agent’s Office. Over the next nine months, this group will identify key judgments for dissemination and develop a systematic approach of sharing them, including through continuous trainings of judges.

The adoption of this Action Plan follows the Department for the Execution of Judgment’s mission to Lisbon in November 2024 and the discussions held during that visit, particularly with the High Council of the Judiciary.
