Visit to Armenia on the execution of the European Court's judgments

On 4-5 September, the Department for the Execution of Judgments carried out a mission to Yerevan, organised in cooperation with the Office of the Representative on International Legal Matters of Armenia.

During the meetings, Armenia’s good relations with the Department and the generally positive record in terms of closure of cases was highlighted. Detailed discussions focused on the status of execution, current obstacles and future perspectives in the pending cases, both under enhanced and standard supervision, in particular concerning:

  • property rights of the persons forced to flee from their homes during the active military phase of the Nagorno-Karabakh conflict (1992-94) (Chiragov and Others)
  • non-combat deaths and ill-treatment in the army and ineffective investigation thereof (Muradyan group and Zalyan and Others case)
  • ill-treatment by police and ineffective investigation thereof (Virabyan group)
  • lack of adequate medical care in detention (Shirkhanyan group)
  • poor conditions of detention (Volodya Avetisyan case)
  • disproportionate dispersal of protests (Mushegh Saghatelyan group)
  • lack of protection against homophobic attacks and hate speech (Oganezova case)
  • various violations of Article 5 (Poghosyan group)
  • delayed enforcement of domestic court decisions (Avakemyan group)
  • unfair proceedings related to deprivation of legal capacity (Nikolayn case)
  • ineffective proceedings on medical malpractice and lack of domestic remedies (Botoyan group).

Meetings were held with representatives from the Ministry of Foreign Affairs, the Ministry of Defence, the Prosecutor General’s Office, the Investigative Committee, the Ministry of Justice, Prison Administration, the Ministry of Internal Affairs, the Ministry of Health, the Ministry of Labor and Social Affairs and with the Representative on International Legal Matters.

Further, an exchange of views took place with the Supreme Judicial Council on the status of execution of the Mnatsakanyan case concerning the lack of judicial review of the decision to dismiss a judge, as well as with the judges of the Court of Cassation on the Poghosyan group of cases and, more generally, on the domestic remedies.

The Department’s delegation also met the Ombudsperson and several NGOs to discuss the cases under supervision.
