Conformément à la législation autrichienne, la mère d’un enfant est la femme qui lui a donné naissance. Le père est le mari de la mère, ou l’homme qui reconnaît sa paternité ou dont la paternité lui a été imposée par le tribunal. Le donneur de sperme/d’ovocytes est exclu de toute paternité/maternité en vertu de la loi.

La loi sur l'assistance médicale à la procréation (2016-09-14 n° XII-2608) légalise le don de cellules reproductrices lorsque l'un des époux ou partenaires a des cellules reproductrices endommagées ou insuffisantes qui ne peuvent pas être utilisées pour la fécondation assistée, ainsi que dans les cas où elles présentent un risque élevé de transmission d'une maladie susceptible d'entraîner un handicap important. La loi sur la procréation assistée autorise également le don d'embryons. Conformément à l'article 8, paragraphe 3, de la loi, le don d'embryons conservés dans la banque de cellules germinales est possible si les conjoints (partenaires) refusent l'embryon par écrit. Un tel refus n'est pas possible avant l'expiration d'un délai de deux ans après le début des procédures de PMA.

Conformément à la loi sur la PMA, il est interdit de procurer et/ou d’utiliser les gamètes d’une personne décédée pour la PMA. Les gamètes de la personne décédée ne peuvent être utilisés pour la PMA d’une personne donnée que si la personne décédée avait donné de son vivant son consentement à l’utilisation de ses gamètes.
Le don d'embryons conservés dans la banque de cellules germinales est possible si les conjoints (partenaires) refusent l'embryon par écrit. Ce refus n'est pas possible avant l'expiration d'un délai de deux ans après le début des procédures de PMA.

Il n’y a pas d’exceptions pour les enfants ou les parents d’enfants nés de procédures de PMA avec don de sperme, mais le donneur de sperme ne peut contester la paternité d’un enfant né d’une telle procédure.
- Le donneur n’a aucune responsabilité juridique envers l’enfant, ni aucun droit d’information sur les enfants nés grâce à l’utilisation de son sperme (sauf leur nombre, qui est limité).

France - Aspects financiers
3. Les procédures de PMA sont-elles prises en charge par le système de sécurité sociale ? Oui. L'assistance médicale à la procréation est considérée comme une activité de soin. La loi n°2021-1017 du 2 août 2021 prévoit la prise en charge de l’AMP par la sécurité sociale dans les mêmes conditions pour les femmes non mariées, les couples de femmes et les couples hétérosexuels.
Le parcours d’AMP est pris en charge par la solidarité nationale. Les bénéficiaires sont exonérés du ticket modérateur.
4. Cette prise en charge est-elle soumise à des critères particuliers (par exemple, infertilité, limite d’âge) ? Oui.
La loi du 2 août 2021 a supprimé le critère d’infertilité,
Les actes d'AMP sont pris en charge à 100 % par l'Assurance Maladie pour au maximum :

- 4 tentatives de fécondation in vitro pour obtenir une grossesse.

- le prélèvement d'ovocytes peut être réalisé chez la femme jusqu'à son 43e anniversaire ;
- le recueil de spermatozoïdes peut être réalisé chez l'homme jusqu'à son 60e anniversaire ;
Et pour la réalisation de l’AMP :
- jusqu'à son 45e anniversaire chez la femme, non mariée ou au sein du couple, qui va porter l'enfant ;
- jusqu'à son 60e anniversaire pour la personne du couple qui ne portera pas l'enfant.

L’assurance maladie prend en charge six inséminations et quatre cycles complets, c'est-à-dire se terminant par un transfert d'embryons. Un cycle de FIV qui est interrompu avant le transfert embryonnaire, quel que soit l'étape à laquelle le cycle est abandonné, n'est pas comptabilisé par l’assurance maladie. Le remboursement est soumis à une procédure d’entente préalable.
En cas de survenue de grossesse avec accouchement, le compteur est remis à zéro, et quatre nouvelles tentatives seront prises en charge. Ceci n'est pas valable pour les fausse-couches ou les grossesses extra-utérines.

La législation nationale repose sur les notions de « couple » (un homme et une femme mariés ou vivant dans une relation comparable au mariage ou deux femmes vivant ensemble dans le mariage, le partenariat enregistré ou dans une relation comparable à mariage) et de « bénéficiaire du traitement » (un couple ou une femme ne vivant pas dans un mariage, une relation comparable au mariage, un partenariat enregistré ou avec une personne de sexe opposé). Les dispositions de certains articles de la loi varient selon que le traitement est proposé à un couple ou à une femme célibataire.
Les centres de santé du service public refusent la PMA aux couples de lesbiennes et aux femmes célibataires au motif que ces services ne sont fournis que sur indication médicale. C’est pourquoi les couples de lesbiennes et les femmes célibataires se tournent vers le secteur privé pour bénéficier de tels services.
Le Médiateur de la non-discrimination a demandé au Tribunal national de non-discrimination et d'égalité de décider si la directive du médecin en chef du district hospitalier universitaire d'Helsinki selon laquelle les couples de femmes sont exclus de l'aide traitements de fertilité est discriminatoire. Dans la décision du Tribunal, la directive a été considérée comme une discrimination directe. Le tribunal administratif d'Helsinki a rendu une décision sur la question 6.3.2019 selon laquelle le Tribunal national de la discrimination et de l'égalité a été autorisé à interdire cette discrimination fondée sur la Loi sur la non-discrimination (paragraphe 8, paragraphe 2 de la loi, 1325/2014).

Les donneurs de gamètes et d’embryons devront fournir les informations suivantes : nom, date et lieu de naissance, nationalité, date et lieu du don, ainsi que leurs coordonnées. Un enfant conçu d’un don peut demander, à l’âge de 18 ans, le nom, la date de naissance et les coordonnées du donneur concerné, inscrites au registre national des personnes conçues grâce à un don.

Conformément à la Loi de 2015 sur l’enfant et les liens de parenté, un enfant conçu à partir d’un don qui a atteint l’âge de 18 ans, ou ses parents s’il n’a pas encore 18 ans, peuvent demander auprès du registre :
(a) les informations autres que le nom, la date de naissance et les coordonnées du donneur, qui figurent dans le registre ;
(b) le nombre de personnes nées de l’utilisation de gamètes du donneur en question dans le cadre d’une procédure d’assistance à la procréation, ainsi que le sexe et l’année de naissance de chacune d’entre elles.
La loi dispose également qu’un enfant conçu à partir d’un don peut, à l’âge de 18 ans, demander le nom, la date de naissance et les coordonnées du donneur, telles qu’elles figurent dans le registre. Le donneur doit être informé qu’une demande a été faite par un enfant conçu à partir de son don. Les informations requises sont fournies dans un délai de 12 semaines à compter de la date à laquelle la notification est envoyée au donneur (avec des exceptions très restrictives).

En vertu de la Constitution irlandaise, la femme qui donne naissance à l’enfant est toujours considérée comme sa mère légale. Ce principe a été contesté devant les tribunaux irlandais mais a été confirmé par la Cour suprême en 2014 dans l’affaire MR and Anor – v- An tArd Chlaraitheoir & Ors (maternité de substitution).
Islande - Droit à la connaissance de ses origines pour les enfants nés après PMA
16. Les dons suivants sont-ils anonymes ? sperme Oui / d'ovocyte Oui /d'embryon -. Voir art. 18 reg. 568/1997. Si un donneur souhaite rester anonyme, le personnel de santé doit veiller à ce que ce souhait soit respecté. Dans ce cas, le donneur ne peut recevoir d’information ni sur le couple qui bénéficiera du don de gamètes, ni sur l’enfant, de même que ni le couple ni l’enfant ne peuvent recevoir d’informations sur le donneur. Si le donneur ne souhaite pas rester anonyme, l’établissement conserve les informations le concernant dans un dossier spécial. Si le don de gamètes aboutit à la naissance d’un enfant, les informations concernant ce dernier et le couple qui a bénéficié du don seront conservées dans le même dossier. Un enfant né grâce aux gamètes d’un donneur qui ne souhaite pas rester anonyme peut, à l’âge de 18 ans, avoir accès au dossier conformément au paragraphe 2 afin d’obtenir des informations sur l’identité du donneur. Si l’établissement concerné communique à l’enfant des informations sur le donneur de gamètes, il doit, dès que possible, en informer le donneur.

La loi sur l’embryologie et la fécondation humaine, qui régit l’utilisation des traitements de l’infertilité au Royaume-Uni, a été modifiée de sorte que les personnes conçues à partir de dons et nées après le 1er avril 2005, peuvent, à l’âge de 18 ans, solliciter auprès de l’HFEA un accès aux informations relatives au donneur. Cela signifie toutefois que les droits d’accès à l’information dépendront de la date à laquelle la personne a été conçue. Ces différences sont expliquées ci-après.
Personnes conçues avant le 1er août 1991 :
La loi charge l’HFEA de tenir un registre contenant des informations sur les services d’assistance à la procréation réglementés au Royaume-Uni. L’HFEA enregistre ces informations depuis le 1er août 1991, date d’entrée en vigueur de la loi de 1990 sur l’embryologie et la fécondation humaine. Toutes les naissances issues d’un traitement, y compris celles provenant de dons de gamètes, figurent dans le registre, qui contient également des informations concernant les donneurs de gamètes : description physique, origine ethnique et toute autre information que le donneur souhaite ajouter, par exemple sa profession et ses centres d’intérêt. L’anonymat du don ayant été supprimé en avril 2005, le registre contient également le nom et l’adresse du donneur. Les donneurs ayant effectué un don avant le 1er avril 2005 peuvent demander que leur anonymat soit levé de manière rétroactive.
Certaines personnes conçues par dons avant 1991 peuvent trouver des informations sur le don et leurs frères et sœurs génétiques conçus par don.
Cela dit, avant la création de l’HFEA en 1991, il n’y avait pas de collecte centralisée des informations relatives aux donneurs. Autrement dit, les personnes conçues avant cette date auront sans doute beaucoup plus de difficultés à retrouver leur donneur. Le registre des personnes conçues par don a été mis en place le 1er avril 2013 pour remplacer le UK Donor Link (UKDL) et facilite le contact entre les donneurs et leurs enfants conçus avant le 1er août 1991. Ceux concernés par un don avant le 1er août 1991 ont la possibilité de s’inscrire dans un registre de contact.
Personnes conçues entre le 1er août 1991 et le 31 mars 2005 :
Les personnes conçues par don avant la modification de la loi intervenue le 1er avril 2015 n’ont pas accès aux données d’identification de leur donneur.
Néanmoins, celles âgées de plus de 16 ans peuvent présenter une demande à l’HFEA pour obtenir les informations anonymes fournies par le donneur.
Ils n’auront la faible possibilité d’entrer en contact avec le donneur qu’à l’âge de 18 ans, mais uniquement si ce dernier s’est réenregistré auprès du centre de PMA ou de l’HFEA en donnant les coordonnées qui étaient les siennes à ce moment-là.

Personnes conçues à partir du 1er avril 2005 :
En 2005, les lois sur l’accès aux informations relatives aux donneurs ont changé. L’identité de toute personne ayant fait un don de sperme ou d’ovocyte après le 1er avril 2005 peut être obtenue par les enfants nés de ce don, lorsque ceux-ci atteignent l’âge de 18 ans. Autrement dit, les coordonnées du donneur peuvent être transmises aux enfants nés de son don. En réponse à la demande d’information de ces derniers, l’HFEA leur fournit la dernière adresse connue, la date de naissance et le nom du donneur.
L’anonymat a été supprimé car la loi reconnaît le souhait et l’intérêt qu’ont de nombreuses personnes conçues grâce à un don de savoir d’où elles viennent. Elle reconnaît également l’intérêt des donneurs à obtenir des informations sur les enfants nés de leur don.
L’HFEA dispose d’un registre des frères et sœurs pour permettre aux personnes conçues grâce à un don de prendre contact avec leurs frères et sœurs issus du même donneur à partir de l’âge de 18 ans, sur la base d’un consentement mutuel.
Lorsqu’une personne conçue grâce à un don atteint l’âge de 18 ans, elle peut choisir d’inscrire ses coordonnées dans un registre volontaire de contact des frères et sœurs, le Donor Sibling Link, géré par l’HFEA. L’HFEA facilitera l’échange de coordonnées entre les frères et sœurs qui ont donné leur consentement à figurer sur ce registre.
Il est donc possible pour les adultes conçus grâce à un don de retrouver leurs frères et sœurs, sur la base du consentement mutuel, par l’intermédiaire de ce registre. En revanche, les parents n’ont pas la possibilité de retrouver les frères et sœurs de l’enfant via ce registre.

La loi HFE de 1990 (telle que modifiée) permet aux personnes conçues à partir d’un don de demander, lorsqu’elles atteignent l’âge de 16 ans, des informations non identifiantes concernant le donneur, si elles sont disponibles, par exemple : les antécédents médicaux familiaux, la couleur des cheveux et des yeux. Si elles ont été conçues après le 1er avril 2005, elles peuvent, dès qu’elles atteignent l’âge de 18 ans, demander à obtenir des informations identifiantes sur leur donneur, auprès de l’HFEA.
Les parents d’enfants conçus à partir d’un don ont accès aux données non identifiantes concernant le donneur, auprès de l’HFEA.
L’article 34 de la Loi HFE de 1990 autorise l’Autorité à divulguer les informations lorsque cela est nécessaire à l’exercice de poursuites en vertu de la Loi sur les handicaps congénitaux.

Dans le cadre d’un traitement de procréation assistée, que les gamètes soient ceux du couple ou proviennent d’un donneur, dès lors que le couple est marié ou en partenariat civil, les deux parents seront les parents légaux de tout enfant né du traitement, dès la naissance de l’enfant. La loi s’efforce de placer sur un pied d’égalité les couples qui ont eu recours à un traitement de procréation assistée et les couples qui conçoivent naturellement, pour ce qui est de la paternité et de la maternité légales et des responsabilités parentales. Il est toutefois possible pour le père ou le second parent (dans le cas d’un couple de lesbiennes en partenariat civil) de s’opposer à la paternité ou à la maternité légale mais uniquement s’il ou elle est en mesure de démontrer qu’il ou elle n’a pas donné son consentement au traitement de son partenaire (voir articles 35(1) et 42(1) de la Loi HFE de 2008).
Lorsque les gamètes d’un donneur sont utilisés pour le traitement et que le couple qui en bénéficie n’est ni marié, ni en partenariat civil, le second parent (qui n’est pas la mère ayant donné naissance à l’enfant) peut acquérir le statut de parent légal si les conditions requises sont remplies (voir articles 37 et 44 de la Loi HFE de 2008). À défaut, le statut de parent sera incertain et le couple devra demander une déclaration de paternité ou de maternité auprès d’un tribunal pour établir leur statut de parent légal.

Les définitions des termes « père » et « mère » dans la loi HFE de 2008 sont les suivantes :

Royaume-Uni - Situations particulières relevant de ces questions dans votre pays
19. Ces questions ou des problèmes qui y sont liés font-ils actuellement l’objet d’un débat important dans votre pays ? Comme indiqué dans la réponse à la question 18, lorsque les conditions de la paternité ou de la maternité prévues dans la loi HFE de 2008 ne sont pas remplies, le second parent n’acquiert pas automatiquement le statut de parent légal. Dans ce cas, l’un des seuls recours disponibles pour le second parent consiste à demander une déclaration de statut de parent légal à un tribunal. R (TT) c Greffier général de l'Angleterre et du Pays de Galles et Ors ((2019) EWHC 2384 (Fam))
L'affaire concerne un homme transgenre (TT) qui possède un certificat de reconnaissance de genre confirmant qu'il est un homme à toutes fins légales, à l'exception des exceptions limitées énoncées dans la loi de 2004 sur la reconnaissance du genre (Gender Recognition Act 2004). TT avait une insémination artificielle utilisant du sperme de donneur dans une clinique de fertilité agréée. Elle Il tomba enceinte et donna naissance à un enfant en 2017. Il tenta d'enregistrer la naissance en tant que père mais fut refusé par le registraire général (RG), qui était seulement capable d’enregistrer la naissance avec TT en tant que mère. La naissance est restée non enregistrée.
Le jugement a été rendu le 25 septembre 2019. Le juge a souscrit à la position du gouvernement selon laquelle une personne qui donne naissance à un enfant (c'est-à-dire, y compris un homme transsexuel tel que TT) sera la mère de l'enfant. Le Gouvernement estime que l’arrêt n’a aucun effet sur la disponibilité d’un traitement de fertilité réglementé au Royaume-Uni. Le gouvernement considère que les traitements de fertilité réglementés sont actuellement et resteront également accessibles à toutes les femmes (trans) et hommes (trans) au titre des lois sur la fertilisation humaine et l'embryologie.

Allemagne - Don de sperme/d’ovocyte/d’embryon
6. Est-il possible, dans votre pays, de procéder à un don de sperme ? Oui d’ovocyte ? Non c. d’embryon ? Le don d’embryon en tant que tel n’est pas réglementé par la loi. La loi relative à la protection de l’embryon prévoit toutefois qu’un ovocyte ne peut être fécondé artificiellement à des fins autres qu’une grossesse chez la femme qui a fourni l’ovocyte (article 1, paragraphe 1, n°2 de la Loi sur la protection de l’embryon) ; il est de plus interdit de prélever un embryon sur une femme avant la fin de la nidation pour le transférer à une autre femme (article 1, paragraphe 1, n° 6 de la Loi sur la protection de l’embryon). Enfin, la Loi contient des dispositions visant à empêcher la création d’embryons surnuméraires au cours d’une fécondation artificielle (notamment l’interdiction de procéder à la fécondation artificielle d’un plus grand nombre d’ovocytes qu’il n’est permis d’en transférer chez une femme au cours d’un cycle – article 1, paragraphe 1, n° 5 de la Loi sur la protection de l’embryon). Par conséquent, l’autorisation d’un don d’embryon est seulement envisageable dans le cas exceptionnel où un embryon créé artificiellement ne peut plus, contre toute attente, être transféré chez la femme qui avait fourni l’ovocyte.
7. Des mesures de compensation sont-elles prévues pour de tels dons ? Non

Les gamètes ne peuvent être utilisés en vue d’une procréation médicalement assistée qu’après une évaluation médicale complète, s’il y a une indication médicale et si la santé du receveur et celle de l’enfant sont garanties (article 6, paragraphe 1, de la réglementation relative aux tissus et aux cellules de la Loi sur la transplantation) En outre, l’utilisation de spermatozoïdes en vue d’une fécondation hétérologue dans le cadre de la procréation médicalement assistée passe nécessairement par une évaluation médicale du donneur de sperme, pour s’assurer qu’il satisfait aux critères relatifs à l’âge, à l’état de santé et aux antécédents médicaux et que l’utilisation de son sperme ne mettra pas en danger la santé d’autrui. Les renseignements nécessaires concernant le donneur doivent être recueillis au moyen d’un questionnaire, puis d’un entretien individuel entre le donneur et le médecin.
La prise en charge financière par la caisse d’assurance maladie est subordonnée à une limite d’âge (voir la réponse à la question 4).
9. Existe-t-il des critères non médicaux spécifiques pour la sélection des gamètes/de l’embryon devant être utilisé(s) pour une procédure de PMA? Non
10. Des mesures particulières sont-elles prises pour prévenir le risque de consanguinité ? Oui. Dans le cadre d'un engagement volontaire, les médecins, les banques de sperme et les laboratoires ont limité à 15 le nombre d'enfants issus d'un don de sperme (Richtlinien des Arbeitskreises für Donogene Insemination zur Qualitätssicherung der Behandlung mit Spendersamen in Deutschland).
11. Dans un couple homosexuel, un lien juridique est-il possible entre un enfant et le/la partenaire de son parent légal ? Oui.
Le droit allemand comprend les dispositions suivantes régissant la relation juridique entre l'enfant et le conjoint du parent légal :
- Le conjoint/partenaire enregistré d'un parent qui a la garde exclusive de l'enfant (autorité décisionnelle) a le droit de s'exprimer sur les questions de la vie quotidienne (ce qu'on appelle la "petite garde" - article 1687b(1) du code civil, article 9(1) de la loi sur le partenariat de vie enregistré). En cas de danger imminent, le conjoint/partenaire enregistré a également le droit d'accomplir tous les actes nécessaires au bien-être de l'enfant (article 1687b(2) du code civil, article 9(2) de la loi sur le partenariat de vie enregistré).
- Droit de contact avec l'enfant, si une "relation sociale de type familial" s'est développée entre le conjoint du parent et l'enfant (article 1685, paragraphe 2, du code civil),
- Si l'enfant a vécu dans un ménage avec l'un des parents qui décède ou n'est plus en mesure d'exercer l'autorité parentale ou dont l'autorité parentale a été suspendue, le tribunal peut rejeter la demande de l'autre parent de lui confier l'enfant et ordonner que l'enfant reste avec le conjoint/partenaire enregistré du premier parent (d'office ou à la demande de ce conjoint), à condition que l'enfant ait vécu dans ce ménage pendant une période plus longue (article 1682, phrase 2, du code civil). Des règles similaires s'appliquent pour le séjour avec le partenaire d'un parent décédé ou d'un parent qui ne peut pas exercer son autorité parentale.
Conformément à l'article 1741, paragraphe 2, phrase 4, du code civil et à l'article 9, paragraphe 7, phrase 1, de la loi sur le partenariat enregistré, un conjoint/partenaire enregistré a le droit d'adopter l'enfant biologique de son conjoint/partenaire enregistré. Conformément à l'article 1742 du code civil/à l'article 9(7), phrase 2, de la loi sur le partenariat enregistré, un conjoint/partenaire enregistré peut également adopter l'enfant adopté par son conjoint/partenaire enregistré. Il n'y a plus de distinction entre les couples mariés hétérosexuels et homosexuels, les partenaires enregistrés ou les couples stables mariés et non mariés lorsqu'ils souhaitent adopter l'enfant de leur partenaire (article 1766a du code civil). En outre, les couples mariés, quel que soit le sexe des conjoints, peuvent adopter tout autre enfant en tant que parents communs, alors que les couples non mariés et les partenaires enregistrés n'ont pas cette possibilité de devenir simultanément parents communs de l'enfant. Ils doivent adopter l'enfant successivement.

3. Les procédures de PMA sont-elles prises en charge par le système de sécurité sociale ? Oui.
La PMA est une thérapie médicale au sens de l'article 27a du livre V du code social.
Les prestations médicales couvertes par l'assurance maladie obligatoire comprennent également les interventions médicales visant à provoquer une grossesse. Les mesures de PMA doivent être médicalement diagnostiquées comme nécessaires et avoir des chances raisonnables de succès.
La loi de modernisation de l'assurance maladie légale (GKV-Modernisierungsgesetz) a raisonnablement limité le droit aux mesures de PMA à partir du 1er janvier 2004. Depuis lors, l'article 27a du livre V du code social précise que 50 % des coûts sont couverts par la caisse d'assurance maladie, de sorte que les assurés participent à parts égales aux coûts des interventions de MAP avec un co-paiement de 50 %.
Pour réduire la charge financière causée par la réduction en 2004 des coûts couverts par la caisse d'assurance maladie légale, le ministère fédéral des affaires familiales a lancé en 2012 l'initiative fédérale "Hilfe und Unterstützung bei ungewollter Kinderlosigkeit" (aide et soutien en cas d'absence involontaire d'enfants). Les fonds sont versés à la fois par le budget fédéral et par le budget des Länder dans lesquels les couples concernés ont leur résidence principale. Actuellement, douze des seize Länder participent à l'initiative. Le financement fédéral est généralement accordé pour les quatre premiers cycles de traitement de la fécondation in vitro (FIV) et de l'injection intracytoplasmique de spermatozoïdes (ICSI). Les couples peuvent se faire rembourser jusqu'à 25 % de la part qu'ils doivent payer en plus des coûts couverts par la caisse d'assurance maladie.
Jusqu'en 2015, seuls les couples mariés avaient droit à une aide financière fédérale supplémentaire. Aujourd'hui, les couples non mariés vivant dans une relation à long terme non maritale peuvent également bénéficier d'une aide financière fédérale en vertu des directives fédérales modifiées sur l'aide financière à la procréation assistée (Richtlinie über die Gewährung von Zuwendungen zur Förderung von Maßnahmen der assistierten Reproduktion), qui sont entrées en vigueur le 7 janvier 2016. Toutefois, en vertu de l'article 27a du livre V du code social, le droit aux prestations de la caisse d'assurance maladie légale est toujours limité aux seuls couples mariés.

La prise en charge d’une partie des frais par le régime obligatoire d’assurance maladie est subordonnée au respect des exigences suivantes :

- d’après le diagnostic médical, l’intervention doit avoir des chances raisonnables d’induire une grossesse
- la procédure peut être réalisée jusqu’à trois fois
- seuls les couples mariés peuvent en bénéficier (les couples non mariés sont exclus)
- seuls sont utilisés les ovules et le sperme des époux (système homologue)
- avant le traitement, les époux doivent être pleinement informés sur les conséquences médicales et psychosociales de la procédure, ainsi que des risques encourus, par un médecin autre que celui qui va réaliser le traitement.
- La PMA ne peut être pratiquée que par des médecins qualifiés ou des centres spécialisés ayant obtenu l’agrément de l’autorité compétente, conformément à la loi du Land concerné.
Toute méthode autre que la fécondation homologue est exclue de l'ensemble des prestations et services obligatoires du système d'assurance maladie légale.
La restriction de l'éligibilité aux couples mariés est conforme à la Constitution allemande (cf. jugement du 28 février 2007 - 1 BvL 5/03, BVerfGE 117, 316).
L'éligibilité est soumise à des limites d'âge comprises entre 25 et 40 ans pour les femmes et entre 25 et 50 ans pour les hommes.
Bien que les couples hétérosexuels non mariés n'aient pas droit aux prestations de la caisse d'assurance maladie légale conformément à l'article 27a du livre V du code social, ils peuvent bénéficier de l'aide financière volontaire offerte par l'initiative fédérale "Hilfe und Unterstützung bei ungewollter Kinderlosigkeit" (aide et assistance pour les enfants non mariés).
5. Le nombre de procédures de PMA prises en charge est-il limité (par exemple, uniquement trois tentatives de FIV) ? Oui. Conformément à l'article 27a du livre V du code social, les trois tentatives de grossesse sont partiellement prises en charge par les caisses d'assurance maladie. La prise en charge des frais par les caisses d'assurance maladie a été limitée à 50 % des coûts approuvés avec le programme de traitement.

La Loi 2472/1997 sur la protection des personnes à l’égard du traitement des données à caractère personnel qualifie les données médicales d’informations « sensibles » et attribue une compétence particulière à l’Autorité de protection des données (article 7).
Conformément à l’article 20, paragraphe 3 de la Loi 3305, l’accès au Registre national des donneurs et des receveurs n’est autorisé qu’à l’enfant et pour des raisons liées à sa santé, sous réserve de l’autorisation de l’Autorité de protection des données et du respect des conditions énoncées dans la Loi 2472/1997 concernant la protection des données à caractère personnel. Les parents ne peuvent avoir accès aux informations qu’à titre de représentants de l’enfant. Un tribunal peut ordonner l’accès aux informations.

Contestation de maternité et de paternité : la contestation de paternité n’est pas autorisée quand le père a donné son consentement au début du traitement.
De même, conformément à la Loi 3089/2002, le consentement de l’homme et de la femme vivant en union libre est donné devant notaire afin de garantir leur filiation avec l’enfant à naître. Par conséquent, toute contestation de la filiation librement consentie est interdite.
Dans le cas d’une maternité de substitution, selon la loi, la femme qui a obtenu l’approbation du tribunal est considérée comme la mère légale de l’enfant. A titre exceptionnel, la mère porteuse ou la personne ayant sollicité ses services peuvent contester la maternité devant un tribunal, dans les conditions prévues par la loi.

Le 12 juin 2005 a eu lieu un référendum populaire pour modifier plusieurs dispositions de cette loi. L’abrogation de ces dispositions a été rejetée, le taux d’abstention ayant été de 74 % (51 % de votes favorables auraient été nécessaires pour changer la loi).
Résumé
1. Protection des désirs de maternité/paternité et règles d’exercice des droits découlant de la loi n° 40/2004.
L’accès aux techniques de procréation assistée est réservé à des couples hétérosexuels majeurs, mariés ou menant une vie commune, dont les membres sont tous deux vivants et en âge de procréer.
Il est interdit aux personnes célibataires et aux homosexuels.
Le couple qui demande un accès aux techniques de procréation (médicalement) assistée doit produire un certificat médical attestant l’existence d’une stérilité ou d’une infertilité pour lesquelles il n’existe aucune autre solution possible.
Le consentement, écrit et librement révocable jusqu’au moment de la fécondation in vitro de l’ovocyte, est obligatoirement précédé d’une information sur le plan technique, juridique, et éthique ainsi que sur le coût des procédures et sur les conséquences possibles des techniques de procréation assistée pour l’enfant à naître.
Lors de l’entretien avec le responsable du centre médical, les couples sont également informés des possibilités d’adopter un enfant ou de devenir famille d’accueil d’un enfant en vue de son adoption (loi n° 184 du 4 mai 1983).
Un délai de réflexion de sept jours doit être respecté avant le début des procédures de procréation assistée.
Ces techniques sont appliquées de manière progressive en commençant par les moins invasives afin d’éviter de recourir à des interventions dont le caractère invasif, au plan technique et psychologique, les rend plus pénibles pour les personnes concernées.
Le médecin responsable du centre médical est en droit de prendre la décision de ne pas recourir aux techniques de procréation assistée, exclusivement pour des raisons médicales ou de santé.
La cryoconservation des gamètes masculins et féminins est autorisée, à condition que les personnes concernées aient été informées et y aient donné leur consentement écrit.
La loi, dans sa formulation d’origine, interdisait le recours à des techniques de type hétérologue (avec don de gamètes d’un tiers extérieur au couple). L’intervention de la Cour constitutionnelle (arrêt n° 162 de 2014) a supprimé cette interdiction.
2.Protection de l’enfant à naître
Le statut juridique de l’enfant né par techniques de procréation assistée est celui d’un enfant légitime ou reconnu par le couple. Le désaveu de paternité est exclu en cas de fécondation hétérologue. Le donneur de gamètes n’acquiert aucun lien juridique de parenté avec l’enfant né (aucun droit ni devoir).
La mère ne peut plus, au moment de l’accouchement, déclarer sa volonté de ne pas être connue, comme cela est autorisé pour la conception naturelle (Décret du Président de la République n° 396 du 3 novembre 2000).
3.Protection de l’embryon
Il est interdit de procéder à la cryoconservation ou à la suppression d’embryons, sous réserve des dispositions de la loi n° 194 du 22 mai 1978 (loi sur l’interruption volontaire de grossesse).
La loi, dans sa formulation d’origine, disposait que les techniques de production d’embryons, compte tenu de l’évolution technique et scientifique et de ce qui pourra être établi à l’avenir par des orientations juridiques du ministre de la Santé, ne peuvent conduire à la création d’un nombre d’embryons supérieur à celui strictement nécessaire à la réalisation d’un transfert unique et simultané, ce nombre ne pouvant en aucun cas être supérieur à trois.
Lorsque le transfert des embryons dans l’utérus se révèle impossible pour raison majeure grave et prouvée, ayant trait à l’état de santé de la femme et non prévisible au moment de la fécondation, la cryoconservation des embryons est autorisée jusqu’à la date du transfert, qui sera effectué aussitôt que possible. Depuis la décision n° 151/2009 de la Cour constitutionnelle, la détermination du nombre d’embryons à créer et à transférer dans le cadre d’une procédure d’implantation reste à l’appréciation du médecin qui tient compte de l’état de santé de la femme. Il ne doit pas être supérieur au nombre strictement nécessaire à la procréation.
En vertu de la loi sur la procréation médicalement assistée, il est interdit de procéder à la réduction embryonnaire de grossesses multiples, sauf dans les cas prévus par la loi n° 194 du 22 mai 1978 (loi sur l’interruption volontaire de grossesse).
Les sujets visés à l’article 5 sont informés du nombre et, s’ils le demandent, de l’évaluation des embryons produits à transférer dans l’utérus.
À la suite de la décision n° 96 du 5 juin 2015, la Cour constitutionnelle a levé l’interdiction qui était faite aux couples fertiles porteurs connus de maladies génétiques graves de recourir au diagnostic génétique préimplantatoire. Les maladies en question doivent répondre aux critères de gravité énoncés à l’article 6, paragraphe 1, lettre b) de la Loi n° 194 du 22 mai 1978 et être détectées par les prestataires publics de soins de santé compétents. Il appartient au Parlement de définir les critères d’agrément de ces structures.
Toute expérimentation sur l’embryon humain est interdite.
La recherche clinique et expérimentale sur l’embryon humain est autorisée à condition que les buts en soient exclusivement thérapeutiques et diagnostiques, en vue de la protection de la santé et du développement de l’embryon.
Sont interdites :
(a) la production d’embryons humains aux fins de recherche ou d’expérimentation ou à toutes fins autres que celles prévues par la loi. Interdiction des dons d’embryon à des fins de recherche : dans l’arrêt Parrillo c. Italie (requête n°46470/11) du 27 août 2015, la Cour européenne des droits de l’homme a reconnu que l’interdiction faite à une femme de donner à la recherche scientifique des embryons résultants d’une fécondation in vitro n’était pas contraire à son droit au respect de sa vie privée (il n’y avait pas de violation de l’article 8 (droit au respect de la vie privée) de la Convention européenne des droits de l’homme). Elle a également affirmé que les embryons humains ne sauraient être réduits à des « biens ». La Cour a considéré qu’il convenait de reconnaître à l’Italie une large marge d’appréciation dans cette affaire, qui mettait en jeu des questions morales et éthiques sensibles, d’autant plus qu’il n’y avait pas de consensus européen sur la question délicate du don d’embryons non destinés à l’implantation. La Cour constitutionnelle a rejeté un recours récent sur ces questions, affirmant qu’il appartenait au législateur de modifier la loi.
(b) toute forme de sélection dans un but eugénique, des embryons et des gamètes, ou des interventions qui, au moyen de techniques de sélection, de manipulation, ou par des procédés artificiels, visent à altérer le patrimoine génétique de l’embryon ou du gamète, ou à en prédéterminer les caractéristiques génétiques, à l’exception des interventions à des fins diagnostiques et thérapeutiques. Cela dit, l’arrêt n° 229/2015 de la Cour constitutionnelle n’a supprimé l’interdiction de la sélection d’embryons que dans des circonstances particulières, considérant qu’il ne s’agissait pas d’une infraction lorsqu’elle vise à prévenir l’implantation d’embryons nés de couples présentant un risque de transmission de maladies génétiques graves, conformément à l’article 6, 1 B de la loi 194 (relative à l’interruption de grossesse) dans des structures publiques désignées. Une question de constitutionnalité concernant l’article 13 (paragraphes 3, alinéa b) et 4) de la Loi n° 40/2004 a été soulevée. Le jugement rendu est conforme à l’arrêt précité.
Il souligne toutefois la protection nécessaire a conférer à l’embryon humain à la protection nécessaire, rappelant que « l’enjeu est ici la nécessité de protéger la dignité de l’embryon, à laquelle aucune autre réponse que la cryoconservation ne peut actuellement être apportée. (c) des interventions de clonage par transfert de noyau ou de scission précoce de l’embryon ou d’ectogenèse, à des fins de procréation ou de recherche ;
(d) la fécondation d’un gamète humain par un gamète d’espèce différente et la production d’hybrides ou de chimères.
4. Sanctions
Le texte de la loi 40/2004 prévoit différentes sanctions progressives en cas de violation de la loi, qui s’appliquent aux médecins et aux Centres autorisés mettant en œuvre les techniques de procréation assistée.
L’homme ou la femme auxquels sont appliquées les techniques ne peuvent être sanctionnés que s’ils n’ont pas suivi les procédures prévues. La sanction pour insémination hétérologue a été supprimée. Les sanctions qui restent en vigueur sont définies à l’article 12 de la Loi n° 40/2004.
5. Autorisations
Un système d’autorisation régionale des structures jugées adéquates est prévu, sur la base :
(a) des données techniques, scientifiques et d’organisation de ces structures ;
(b) des qualifications du personnel.
Les conditions requises sont établies par actes des Régions.
Il existe un Registre obligatoire des structures autorisées, établi et tenu par l’Institut supérieur de la santé, qui suit l’application des techniques de procréation médicalement assistée, les embryons formés et les enfants nés à la suite de l’application de ces techniques.
L’Institut supérieur de la santé prépare le rapport annuel à présenter au Parlement.
Après la décision n° 162/2014, le ministère de la Santé a approuvé les Lignes directrices pour l’application des techniques de reproduction hétérologues au couple qui reçoit le gamète. En ce qui concerne le don de gamètes, l’Italie adoptera la Directive UE 2006/17, ALL.III, PAR.3,4 et ses modifications ultérieures. Le texte sera approuvé dans le système normatif (sous la forme d’un décret gouvernemental). L’un des éléments fondamentaux issus du système juridique Italien est le principe selon lequel le don de sperme et d’ovocyte doit être un acte volontaire, altruiste et non rémunéré.
Irlande - Réglementation ou pratique et accès à la PMA
En Irlande, jusqu’à une date récente, l’offre de services de procréation assistée était très peu réglementée. Cependant ; en avril 2015, le Parlement a adopté la Loi sur l’enfant et les liens de parenté (Children and Family Relationships Act), qui aborde le sujet de la filiation dans le cadre limité de la procréation assistée avec donneur. En vertu de la loi de 2015 sur l’enfant et les liens de parenté, le don de gamètes et d'embryons est autorisé sur une base non anonyme. En outre, cette législation prévoit la création d'un registre national des donneurs de gamètes / embryons, des receveurs et des enfants conçus par donneur (Registre national des personnes conçues par des donneurs), qui permettra aux enfants conçus par donneur d'accéder à certaines informations concernant le gamète / donneur d'embryons impliqué dans les procédures conduisant à leur conception.
De plus, bien que les services de procréation assistée ne soient pas réglementés par une législation spécifique relative à la santé, en février 2015, le ministre de la Santé a obtenu l’accord du gouvernement en vue de l’élaboration d’un ensemble de dispositions législatives sur un grand nombre de questions englobant toutes les phases du processus de procréation assistée. A la suite de l'achèvement du régime général, le gouvernement a approuvé sa publication et l'élaboration d'un projet de loi sur l’assistance médicalisée à la procréation basé sur le régime général. La rédaction de ce projet de loi est actuellement en cours.
Sous cette législation proposée, un certain nombre de pratiques seront réglementées parmi lesquelles le don de gamètes et le don d’embryon, la maternité de substitution et la filiation dans de tels cas, le dépistage/diagnostic génétique préimplantatoire, le choix du sexe à des fins médicales, et la procréation assistée post mortem ainsi que la recherche connexe. Il est également proposé d’établir dans la législation une instance de contrôle pour assurer la sécurité du patient et le respect des bonnes pratiques cliniques dans le domaine de la procréation assistée. Cette instance maintiendra le Registre national des personnes conçues par des donneur, établira le Registre National de la GPA et ainsi que tiendra un registre de tous les activités et les services de PMA.
En janvier 2018, le régime général a été soumis à la commission parlementaire compétente pour instruction dans le cadre du processus d'examen pré-législatif. Ce comité a publié le rapport de son examen en juillet 2019, en formulant des recommandations comprenant des propositions liées à la fois à des objectifs politiques généraux et à des modifications plus techniques. Ses recommandations sont examinées au cours du processus continu de rédaction du projet de loi sur la procréation assistée – AHR Bill.
Norvège - Réglementation ou pratique et accès à la PMA

Un amendement en vigueur depuis septembre 2004 autorise aussi le DGP dans les cas de maladies héréditaires graves pour lesquelles il n’y a pas de traitement disponible. Une nouvelle réglementation concernant le DGP et la recherche sur les embryons surnuméraires est entrée en vigueur en juillet 2008, permettant la recherche sur des embryons surnuméraires sous certaines conditions, et le DGP ou le DGP/ALH dans des situations de maladies héréditaires graves. Une nouvelle réglementation concernant l’accès à la PMA pour des couples de lesbiennes est entrée en vigueur en janvier 2009. En 2013, la loi a été modifiée pour autoriser l’accès à la PMA aux couples fertiles dont l’un des membres présente une infection sexuellement transmissible chronique grave. En 2020, les femmes célibataires vivant seules ont eu accès à la PMA, et à partir de 2021, le don d'ovocytes est autorisé. Le don d'ovocytes n'est accessible qu'aux couples qui peuvent utiliser leur propre sperme. Les couples de femmes homosexuelles peuvent se donner mutuellement des ovocytes (don entre partenaires) et utiliser le sperme d'un donneur.

L’insémination avec sperme du conjoint (homologue) n’a aucune incidence juridique : le conjoint de la mère devient le père biologique de l’enfant ; par ailleurs, ni le mode de conception (naturel ou artificiel) ni l’existence d’un consentement ou l’éventuelle absence de consentement n’ont d’incidence juridique.
L’insémination hétérologue, en revanche, soulève des questions juridiques touchant à la filiation. Bien que le donneur de sperme soit sans conteste le père biologique de l’enfant, il est impossible de prouver la paternité légale car l’identité du donneur est en principe inconnue de la mère et le médecin est lié par le secret médical. Aucune action en établissement de paternité ne peut être ouverte dans ce cas, car il faudrait pour cela rapporter la preuve de l’existence de relations sexuelles, en vertu de l’art. 85 par. 1 du Code de la famille et de la tutelle.
La question de la paternité légale de l’enfant reste donc ouverte. Dans le cas d’une femme non mariée, l’action en établissement de paternité est exclue, le donneur étant en droit de garder l’anonymat. Cela dit, si l’enfant est né durant le mariage ou dans les 300 jours suivant sa dissolution ou son annulation, la paternité du mari de la mère est présumée. Celui-ci peut engager une action en contestation de paternité dans les 6 mois suivant la date à laquelle il a eu connaissance de la naissance de l’enfant (art. 63). Il s’agit d’un délai de forclusion à l’échéance duquel seul le procureur est en droit d’engager une telle action.
La question se complique dans le cas d’une insémination hétérologue effectuée avec le consentement du mari. Etant donné l’absence de dispositions juridiques spécifiques en la matière, le mari garde le droit de contester sa paternité bien qu’il ait donné son consentement. Théoriquement, il suffit qu’il démontre que l’enfant est né par PMA. Cependant, selon l’arrêt de la Cour de Cassation du 27 octobre 1983 : « L’action de l’époux de la mère contestant la paternité d’un enfant conçu avec son consentement à la suite d’une PMA avec don de sperme (procédure hétérologue) peut être considérée comme contraire à l’ordre public ». Dans l’exposé des motifs, la Cour a souligné l’importance du bien-être de l’enfant, affirmant que si elle venait à accéder à une telle demande, l’enfant se retrouverait dans la pratique sans père, vu l’impossibilité de prouver la paternité du donneur en raison des règles protégeant son anonymat. D’ailleurs, le donneur n’aurait aucun intérêt à prouver sa paternité. Cette interprétation prend également en considération l’intérêt de la famille constituée suite à la décision des conjoints d’avoir recours à la PMA.

En 2015, la Cour suprême de Hongrie (Kúria) a examiné une affaire de contestation de paternité après une procédure de PMA au motif que le conjoint n’avait pas donné son consentement à l’intervention de PMA.
Le couple marié s’était séparé peu après la naissance de l’enfant. L’homme et la femme avaient décidé d’un commun accord d’avoir un enfant par PMA. Le mari séparé contestait sa paternité car un test ADN excluait sa paternité biologique mais confirmait la maternité biologique de la mère. La Cour a accepté la requête de l’ex-mari demandant à ne pas être reconnu comme le père car ce dernier avait donné son consentement à la procréation médicalement assistée mais pas à l’intervention proprement dite ; le document de consentement n’indiquait pas que le sperme pouvait venir d’un autre donneur. La base du jugement n’a pas été le fait qu’il ne pouvait pas être le père biologique mais l’absence d’une déclaration de consentement légalement valide. (Affaire EBH2015 P.8.)

Dans la récente publication Olika vägar till föräldraskap (SOU 2016:11), du 24 février 2016, une enquête publique a été lancée pour examiner différents moyens d’accroître les possibilités offertes aux personnes demeurant involontairement sans enfants, de devenir parents. Un changement à la législation entré en vigueur le 1er avril est l’accès à la PMA pour les femmes célibataires. L’enquête a proposé de ne plus exiger de lien génétique entre l’enfant et l’un des parents ; cela signifierait que le don d’embryon serait possible. L’enquête portait également sur l’opportunité d’autoriser la maternité de substitution à visée altruiste en Suède. Elle a conclu que ni la maternité de substitution à visée altruiste, ni la maternité de substitution dans un but lucratif ne devaient être autorisées et que la société devait également combattre ce type de pratiques. Le rapport final a été présenté à un grand nombre d’acteurs, d’organisations et d’autorités, qui rendront leurs commentaires pour le 23 juin 2016.
Dans une nouvelle enquête gouvernementale suivie par une proposition de loi du gouvernement le 15 mars 2018 intitulée « Modernare regler om assisterad befruktning och föräldraskap » (proposition 2017/18:155), qui est entrée en vigueur le 1 er janvier 2019, le législateur a rendu le don d'embryon possible. Un couple ou une femme célibataire peut donner des œufs fécondés s'ils ont déjà des enfants et si l'œuf est génétiquement lié à l'un d'entre eux (ou à la femelle célibataire). Les enfants issus d'un don d'embryons ont le droit de saisir leurs informations personnelles dans le registre spécial et de les conserver pendant 70 ans, afin que tous les frères et sœurs génétiques puissent être retrouvés sur demande.

Dans les cas où le(la) donneur(se) (sperme ou ovocyte) a plus de douze descendants, il(elle) peut tout de même effectuer un don dans le cadre d’une procédure de PMA en vue de la naissance d’un frère ou d’une sœur, si une femme seule ou un membre du couple a déjà un enfant grâce à un don de ce(tte) même donneur(se).
Les embryons congelés, fertilisés résultant d’un don d’ovocyte d’une même donneuse, dont les dons ont conduits à plus de douze grossesses viables, peuvent continuer à être utilisés.

11. Dans un couple homosexuel, un lien juridique est-il possible entre un enfant et le/la partenaire de son parent légal ? Oui.
En décembre 2013, la loi sur les enfants a été amendée avec des règles sur la co-maternité. La co-maternité peut être établie quand la mère a fait l’objet d’un traitement de procréation médicalement assistée et a une épouse ou une partenaire qui a consenti au traitement.
Dans d’autre cas, les couples homosexuels ont les mêmes droits à l’adoption que les couples hétérosexuels, qui incluent aussi la possibilité d’adoption de l’enfant de son partenaire.

Les procédures de PMA sont-elles prises en charge par le système de sécurité sociale ?
Les coûts liés à l’ensemble des activités de laboratoire requises pour l’insémination d’ovules par FIV/ICSI ne sont pas facturés à la patiente si elle est âgée de moins de 43 ans, pour un maximum de 6 cycles par femme (Arrêté royal du 25 avril 2002, relatif à la fixation et à la liquidation du budget des moyens financiers des hôpitaux, art. 74 bis). La logique qui sous-tend cette réglementation est de considérer qu’à partir de 43 ans, il existe peu de chances que la PMA aboutisse.
Depuis 2008 (Arrêté royal du 6 octobre 2008 instaurant un remboursement forfaitaire pour les traitements de l’infertilité féminine), l’assurance-maladie invalidité octroie également un remboursement forfaitaire pour les spécialités pharmaceutiques prescrites par un gynécologue et délivrées dans un hôpital, qui sont utilisées dans le cadre d’une insémination intra-utérine ou d’une stimulation ovarienne. La femme doit être âgée de moins de 43 ans et le remboursement n’est possible que pour un maximum de 6 cycles/traitements menés à terme. Une partie des coûts reste à charge de la patiente.
En ce qui concerne les autres prestations dans le cadre d’une procréation médicalement assistée, elles sont partiellement couvertes par l’assurance maladie-invalidité (ex. transfert d’embryon après fécondation in vitro) : Une partie des coûts reste à charge de la patiente.
Cette prise en charge est-elle soumise à des critères particuliers ?
L'âge maximum de la femme fixé à 42 ans en raison des très faibles chances de succès au-delà.
Le nombre de procédures de PMA prises en charge est-il limité ?
La limite est fixée à quatre procédures de FIV, mais si une grossesse se produit, il est possible de bénéficier à nouveau de quatre procédures de FIV.

Le consentement écrit du donneur est nécessaire. Le don ne peut être réalisé que dans un hôpital dûment autorisé. Limite d’âge pour le don d’ovocyte : 30 ans (donneur), 45 ans (receveur).
9. Existe-t-il des critères non médicaux spécifiques pour la sélection des gamètes/de l’embryon devant être utilisé(s) pour une procédure de PMA? Non.
10. Des mesures particulières sont-elles prises pour prévenir le risque de consanguinité ? Oui. Le sperme d’un donneur ou les ovocytes d’une donneuse ne pourront être utilisés que par trois couples. Un donneur ne pourra faire un don que dans un seul centre.
11. Dans un couple homosexuel, un lien juridique est-il possible entre un enfant et le/la partenaire de son parent légal ? Oui. La partenaire de la mère légale est automatiquement l’autre parent de l’enfant si cette partenaire a donné son consentement écrit pour la PMA avec un don de sperme.
Belgique - Situation particulière
Le sujet des mères porteuses revient régulièrement au Parlement. Plusieurs propositions ont été faites, dont certaines ne traitent que de la maternité de substitution dans le cadre de la procréation médicalement assistée.
Royaume-Uni - Don de sperme/d’ovocyte/d’embryon

L’HFEA autorise les centres de soins agréés au Royaume-Uni à verser une indemnité aux donneuses d’ovocytes à hauteur de 750 £ par cycle de don et jusqu’à 35 £ par visite au centre pour les donneurs de sperme. L’HFEA autorise également les avantages en nature, par exemple les conventions de partage d’ovocytes par lesquelles une femme ayant besoin d’une FIV accepte de partager des ovocytes avec une autre femme ayant besoin d’un don d’ovocytes en échange de la gratuité du traitement ou d’une diminution de son coût. Les cliniques se référeront aux lignes directrices professionnelles applicables en ce qui concerne les limites d’âge avant d’accepter des gamètes pour le traitement d’autres patients. Les gamètes destinés au traitement d’autres patients ne doivent pas être prélevés sur un donneur de moins de 18 ans. Un donneur ne doit pas être sélectionné en raison d’une anomalie génétique, chromosomique ou mitochondriale particulière qui, si elle était héritée par l’enfant né à la suite du don, entraînerait chez cet enfant :
a) un handicap physique ou mental grave,
b) une maladie grave,
c) toute autre affection grave.
L’utilisation de gamètes issus de donneurs dont il est établi qu’ils présentent une telle anomalie doit faire l’objet d’une évaluation tenant compte du bien-être de tout enfant à naître et doit recueillir l’approbation d’une commission d’éthique.
9. Existe-t-il des critères non médicaux spécifiques pour la sélection des gamètes/de l’embryon devant être utilisé(s) pour une procédure de PMA (par exemple, correspondance entre l’apparence physique du (des) donneur(s) et des futurs parents) ? Oui. Les centres n’ont aucune obligation d’assurer la compatibilité entre receveur et donneur sur le plan de l’origine ethnique. Lorsqu’un receveur potentiel est disposé à accepter un don d’un donneur d’une origine ethnique différente, le centre peut proposer le traitement sous réserve d’une évaluation du bien-être de l’enfant.
10. Des mesures particulières sont-elles prises pour prévenir le risque de consanguinité ? Oui. L’HFEA tient un registre des donneurs et des patients qui ont eu un enfant en faisant appel à un don de gamètes. Une personne née d’un don qui souhaite avoir des relations physiques intimes avec une autre personne née d’un don peut présenter, avec celle-ci, une demande conjointe à l’HFEA afin de déterminer si elles sont génétiquement liées. De même, les personnes qui souhaitent se marier ou conclure un partenariat civil peuvent soumettre une demande conjointe pour établir si elles sont génétiquement liées. Les dons d’un même donneur ne peuvent être utilisés que pour un maximum de 10 familles. Le donneur en question ne peut plus faire de dons une fois que cette limite est atteinte, notamment pour réduire le risque de consanguinité.
11. Dans un couple homosexuel, un lien juridique est-il possible entre un enfant et le/la partenaire de son parent légal ? Oui.
Les dispositions juridiques relatives aux conditions à remplir pour qu’une personne soit le parent légal d’un enfant figurent dans la Loi sur l’HFEA.
Lorsqu’une femme ayant conclu un partenariat civil demande à bénéficier d’un don de sperme ou à recevoir un embryon créé à partir d’un don de sperme, le partenaire civil de la femme sera considéré comme le parent légal de tout enfant né du traitement, sauf si, au moment du transfert d’embryon ou de gamètes ou de l’insémination :
a) une ordonnance de séparation était en vigueur ou
b) il est démontré que le partenaire n’avait pas donné son consentement au transfert d’embryon ou de gamètes ou à l’insémination.
Lorsqu’une femme en couple (mais pas en partenariat civil) avec une femme bénéficie d’un traitement au moyen d’un don de sperme, ou d’un embryon créé à partir d’un don de sperme, sa partenaire sera considérée comme l’autre parent légal de l’enfant éventuel si les conditions suivantes sont remplies au moment du transfert d’embryon ou de gamètes ou de l’insémination :
a) la femme et sa partenaire ont informé le centre par notification écrite et signée (exceptions en cas de maladie, de lésions ou de handicap physique) du consentement de la partenaire à être considérée comme le parent de tout enfant éventuel,
b) aucune des deux partenaires n’a retiré son consentement (ou envoyé une notification écrite annulant et remplaçant le consentement) avant l’insémination/le transfert, et
c) la patiente et sa partenaire ne sont pas en parenté proche (les degrés de parenté interdits étant définis à l’article 58(2), partie 2, de la Loi 2008 sur HFE).
