La loi sur la PMA dispose que l’accès à la PMA est ouvert aux couples infertiles lorsque l’infertilité ne peut pas être traitée par d’autres méthodes.
Conformément à la loi susmentionnée, le recours à la PMA est également possible lorsqu’existe une forte probabilité de transmission d’une maladie pouvant entraîner chez l’enfant un handicap grave.

3. Are MAP procedures covered by the social security system? Yes. In Lithuania infertility considered as a disease therefore MAP services are paid for in accordance with the Law on Health Insurance of the Republic of Lithuania. The compensation is available to people who have entered into a marriage or registered partnership agreement in accordance with the law and have been diagnosed with infertility (female, male or both). Age limit of woman for compensation - 42 years old.
4. Are there specific criteria for such coverage? Yes. Infertility is the condition for the coverage of MAP. Woman age limit for treatment of infertility with MAP is 42 years.
5. Is the financial coverage limited to a number of MAP procedures? Yes. A maximum of 2 treatment cecles per couple is reimbursed.

Oui. La question de la maternité de substitution a été reportée en raison de la nature controversée de l'abus du corps féminin et des conséquences juridiques que la maternité de substitution peut entraîner dans certains cas. Cependant, il semblerait que la discussion sera soulevée à l'avenir pour les couples hétérosexuels et homosexuels. La loi sur la protection des embryons, telle qu'amendée, ne permet pas le recours à la maternité de substitution et n'est pas discutée.
Note : Ceci dit, comme l'indique l'article 19, discuté ci-dessus, le don de gamètes est un accord privé, de sorte que les couples homosexuels, par exemple, peuvent contourner les dispositions en se faisant donner du sperme dans le cas des couples homosexuels féminins, et les couples homosexuels masculins peuvent donner leur sperme par un accord privé à une femme, qui peut être la mère porteuse (en utilisant ses propres ovules par insémination artificielle par donneur) et ensuite abandonner l'enfant. L'article 19 de la loi semble l'interdire selon mon interprétation. En tout cas, la loi ne parle pas de la Gestation pour autrui donc tout au plus elle peut être tolérée mais pas protégée par la loi en matière de filiation.

If no legal instrument please describe the practice: In view of the lack of specific legal provisions, MAP may be practised under the general rules of medical law and in particular those governing the practice of medicine (duty to inform patients of the medical and legal consequences, confidentiality with regard to the MAP itself and the identity of the donor of the gametes, due care in the choice of the donor and examination of the genetic material to be used, the duty to obtain free and informed consent, etc), the corresponding rights of patients, the general laws on families, descent and registration, and the Medical Code of Ethics (which does not address this issue specifically). Some questions are addressed in the Opinion of the Polish Association of Obstetricians concerning the MAP techniques used in the treatment of infertility, and others by the internal regulations of the clinics practising MAP (practice may therefore vary from one place or establishment to another).

Au Royaume-Uni, l’accès au traitement dans le cadre du National Health Service (NHS) n’est pas le même partout, les différents clinical commissioning groups (CCG) locaux ou conseils de santé appliquant leurs propres niveaux de prestation et critères de sélection. Le National Institute of Clinical Health and Excellence (NICE) est l’organe du NHS qui a élaboré les lignes directrices générales que les CCG appliquent ensuite au niveau local. S’ils le désirent, les patients affiliés à une assurance privée (ne relevant pas du National Health Service (NHS)) peuvent demander un traitement pour des raisons non médicales.
En tant qu’organisme de contrôle de la procréation assistée au Royaume-Uni, l’HFEA demande aux centres agréés pour le traitement de l’infertilité de suivre les prescriptions en matière de dépistage pour éviter la transmission de maladies. Les donneurs doivent subir un dépistage des maladies infectieuses telles que le VIH, l’hépatite B et C et le cytomégalovirus (CMV). Parmi les critères à prendre en considération figurent l’âge du patient, son état de santé et son aptitude à satisfaire les besoins du ou des enfants. C’est aux centres de PMA qu’il appartient en dernier ressort de prendre en toute impartialité la décision de proposer ou de refuser le traitement. Article 28 (paragraphe 1-3) régularise l’interdiction de profit issue des procédures de la PMA
Les interdictions visées aux paragraphes 1 à 3 ci-dessus ne sont pas applicables aux:
1) l'indemnisation des donneurs vivants pour la perte de revenus ou d'autres ressources financières pour le temps passé dans un établissement médical ou pendant le rétablissement, ou pendant l'incapacité temporaire de travailler, ou la compensation pour d'autres dépenses admissibles que le donneur a subies, hébergement, frais de nourriture, etc.);
2) indemnisation admissible en rapport avec le paiement de services médicaux ou autres liés à la récupération de cellules reproductrices;

Les dons de sperme, d'ovocyte, embryon sont-ils anonymes ?
Oui. Pour les gamètes, l’anonymat est la règle, mais la loi autorise le don non anonyme lorsqu’il résulte d’un accord entre le donneur et le ou les receveurs.
Est-il possible d’obtenir des informations sur l’origine biologique d’un enfant né à la suite d’un don de gamètes ou d’embryon ?
Pour l’enfant lui-même : non.
Pour les parents : non, la loi prévoit que dès l’implantation d’embryons surnuméraires ou de gamètes, les règles de filiation du Code civil jouent en faveur du ou des auteurs du projet parental. Aucune action relative à la filiation ne peut être intentée à l’encontre du donneur par le receveur ou par l’enfant né de l’insémination d’embryons surnuméraires ou de gamètes.
Pour un tribunal : il n’existe aucune disposition légale spécifique applicable aux tribunaux dans ce domaine. On ne peut exclure la possibilité qu’un juge puisse obtenir des informations sur l’origine biologique d’un enfant né à la suite d’un don de gamètes ou d’embryon, si cela est jugé nécessaire.

Le centre de fécondation est légalement tenu de rendre inaccessible toute donnée permettant l’identification du donneur d’embryons ou de gamètes. Toute personne travaillant pour ou dans un centre de fécondation, qui prend connaissance d’informations permettant d’identifier le donneur est tenue au secret professionnel (art. 458 du Code pénal). Cependant, le don non anonyme de gamètes résultant d’un accord entre le donneur et le ou les receveurs est autorisé.

La loi précise que le centre enregistre certaines données relatives au donneur, dont les caractéristiques physiques des deux géniteurs dans le cas d’un embryon ou du donneur de gamètes, mais prévoit que les parents et l’enfant ne pourront avoir accès qu’aux données médicales nécessaires revêtant de l’importance pour la santé de l’enfant.
Est-il possible d’obtenir d'autres informations sur l’origine biologique d’un enfant né à la suite d’un don de gamètes ou d’embryon ?
Conformément à la loi, le centre enregistre certaines informations relatives au donneur, y compris les caractéristiques physiques des deux géniteurs d’embryons ou du donneur de gamètes. Les parents et l’enfant n’ont toutefois accès qu’aux données médicales nécessaires pour la santé de ce dernier.
Est-il possible de contester la maternité et la paternité des enfants nés après PMA et sous quelles conditions (dispositions relevant du droit de la famille) ?
Non, la loi prévoit que dès l’implantation d’embryons surnuméraires ou de gamètes, les règles de filiation du Code civil jouent en faveur du ou des auteurs du projet parental.

La loi de 2007 précise que seuls les dons d’embryons surnuméraires et de gamètes effectués à titre gratuit sont licites.
Cependant, la loi permet au Roi de fixer une indemnité qui couvre les frais de déplacement ou de perte de salaire de la personne sur laquelle on prélève des gamètes. Cette indemnité peut également couvrir les frais d’hospitalisation inhérents au prélèvement d’ovocytes chez la donneuse. Mais aucun arrêté n’a été pris dans ce sens jusqu’à présent.
En pratique, l’ensemble des frais liés aux examens et procédures médicales durant le traitement sont pris en charge par la receveuse. Il arrive également que le centre de fécondation exige que la receveuse d’ovocytes verse une « indemnité » à la donneuse, et qu’une modeste compensation soit offerte au donneur de sperme, par échantillon utilisable.
Des critères spécifiques sont-ils définis pour effectuer un don?
La loi de 2007 précise que le prélèvement de gamètes est ouvert aux femmes majeures jusque 45 ans. Cependant, un prélèvement de gamètes, d’embryons surnuméraires, de gonades ou de fragments de gonades pour cryoconservation peut être effectué, sur indication médicale, sur un mineur.
Sont interdits, les dons d’embryons surnuméraires ou de gamètes à caractère eugénique ou axés sur la sélection du sexe.
Il doit exister une convention écrite entre le donneur et le centre de fécondation agréé. La loi ne mentionne pas de critères médicaux pour le prélèvement.
Existe-t-il des critères non médicaux spécifiques pour la sélection des gamètes/de l’embryon devant être utilisé(s) pour une procédure de PMA (par exemple, correspondance entre l’apparence physique du (des) donneur(s) et des futurs parents) ?
Dans la pratique, les centres cherchent à éviter une dissemblance trop importante entre donneurs et receveurs.
La loi de 2007 précise que l’appariement entre donneur et receveur ne peut être considéré comme une pratique à caractère eugénique.
Des mesures particulières sont-elles prises pour prévenir le risque de consanguinité ? (par exemple, registre officiel, nombre de dons limité)
La loi de 2007 dispose que les embryons surnuméraires d’un même donneur ou couple de donneurs ou les gamètes d’un même donneur, ne peuvent conduire à la naissance d’enfants chez plus de 6 femmes différentes.
Dans un couple homosexuel, un lien juridique est-il possible entre un enfant et le/la partenaire de son parent légal ?
La loi du 18 mai 2006 a modifié certaines dispositions du Code civil pour permettre l’adoption par des personnes de même sexe.

(L’insémination artificielle avec don de sperme ne doit être réalisée que si l’homme souffre d’infertilité, s’il est porteur d’une maladie héréditaire grave ou s’il existe d’autres raisons médicales justifiant le recours à un don de sperme (article 8)).
(Une fécondation in vitro ne peut être réalisée qu’avec les gamètes du couple. Il est toutefois autorisé d’avoir recours à un don de gamètes si l’homme ou la femme souffrent d’infertilité, si l’un des deux est porteur d’une maladie héréditaire grave ou s’il existe d’autres raisons médicales justifiant le recours à un don de gamètes. Il est interdit de réaliser une fécondation in vitro sans utilisation des gamètes de l’un des deux partenaires. Le don d’embryon et la maternité de substitution sont interdits (article 9)).
9. Existe-t-il des critères non médicaux spécifiques pour la sélection des gamètes/de l’embryon devant être utilisé(s) pour une procédure de PMA? Oui. Si des gamètes provenant d’un don sont utilisés, le médecin responsable du traitement doit sélectionner le donneur approprié. Un donneur de gamètes doit être en bonne santé et ne pas avoir de maladie héréditaire. Les tests nécessaires doivent être effectués pour s’assurer de la bonne santé du donneur et de sa fertilité, ainsi que pour prévenir la transmission de maladies par les gamètes. Si des gamètes importés sont utilisés, les exigences précitées doivent être respectées. Le médecin doit s’efforcer de répondre au souhait des personnes concernées de faire correspondre au mieux la corpulence, la taille, la couleur des yeux et des cheveux, ainsi que le groupe sanguin du donneur de gamètes avec ceux des parents. (art. 17 reg. 568/1997)
10. Des mesures particulières sont-elles prises pour prévenir le risque de consanguinité ? Oui. Indirectement. Voir art. 18 reg. 568/1997. Si un donneur souhaite rester anonyme, le personnel de santé est tenu de s’assurer que ce souhait est respecté. Dans ce cas, le donneur ne peut recevoir d’information ni sur le couple qui bénéficiera du don de gamètes, ni sur l’enfant, de même que ni le couple ni l’enfant ne peuvent recevoir d’informations sur le donneur. Si le donneur ne souhaite pas rester anonyme, l’établissement conserve les informations le concernant dans un dossier spécial. Si le don de gamètes aboutit à la naissance d’un enfant, les informations concernant ce dernier et le couple qui a bénéficié du don seront conservées dans le même dossier. Un enfant né grâce aux gamètes d’un donneur qui ne souhaite pas rester anonyme peut, à l’âge de 18 ans, avoir accès au dossier conformément au paragraphe 2 afin d’obtenir des informations sur l’identité du donneur. Si l’établissement concerné communique à l’enfant des informations sur le donneur de gamètes, il doit, dès que possible, en informer le donneur.
11. Dans un couple homosexuel, un lien juridique est-il possible entre un enfant et le/la partenaire de son parent légal ? Oui. Art. 6, Loi n°87/1996 (les dispositions de la Loi sur l’adoption concernant les époux ne s’appliquent pas au partenariat enregistré. Une personne ayant conclu un partenariat enregistré peut adopter l’enfant de son partenaire dont celui-ci a la garde, à condition que l’enfant n’ait pas fait l’objet d’une procédure d’adoption internationale. Les dispositions législatives sur l’insémination artificielle ne s’appliquent pas aux personnes en partenariat enregistré, ni les dispositions législatives énonçant des règles spécifiquement applicables aux époux de l’un ou l’autre sexe. 1). Les dispositions des accords internationaux auxquels l’Islande est Partie ne s’appliquent pas au partenariat enregistré sauf approbation par l’autre partie).

Pour a. et b. Dans une intervention avec don de gamètes, il ne peut y avoir qu’un seul et même donneur.
Le don est interdit (Loi § 171 (7)) :
a) si le donneur présente une pathologie excluant le don (Décret, annexe n°3) ;
b) si le donneur refuse de fournir les données à caractère personnel requises (Loi § 171 (3)) ;
c) si le donneur ne se présente pas en personne au centre.
La limite d’âge est de 35 ans (Loi § 171 (1)).
Le don d’embryon est anonyme.
Les conditions du don d’embryon sont précisées dans la Loi § 176.
9. Existe-t-il des critères non médicaux spécifiques pour la sélection des gamètes/de l’embryon devant être utilisé(s) pour une procédure de PMA? Oui. Pour les gamètes, l’apparence, ainsi qu’une éventuelle maladie du donneur, sont des données enregistrées.
Pour le don d’ovocytes, le statut parental éventuel doit être pris en compte (Loi § 171 (4)).
Pour le don d’embryon, les embryons issus d’un même couple ne peuvent être implantés en PMA qu’à un maximum de deux personnes différentes. (Loi § 175 (4)).
10. Des mesures particulières sont-elles prises pour prévenir le risque de consanguinité ? Oui.
Un même donneur de gamètes ne peut avoir plus de quatre descendants avec des personnes différentes dans le cadre d’une procédure de PMA.
La PMA ne peut être demandée par des personnes présentant un lien de parenté qui les empêcherait de se marier légalement (Code civil § 4 :12 (1) a) et b), en l’occurrence, les frères et sœurs et parents linéaires).
Pour les autres degrés de consanguinité, le médecin proposant la PMA doit consulter au préalable le Centre régional de génétique (Décret §1 (3)).
Les embryons issus d’un même couple ne peuvent être implantés en PMA qu’à un maximum de deux personnes différentes (Loi § 175 (4)).
11. Dans un couple homosexuel, un lien juridique est-il possible entre un enfant et le/la partenaire de son parent légal ? Non. L’accès à la PMA est réservé aux couples hétérosexuels.

Le père ne peut contester la présomption de paternité, sauf dans le cas où le conjoint ou le compagnon en union libre n’a pas donné son consentement à la procédure de PMA (Code civil § 4 :108 a)).
Le donneur de sperme ou d’embryon est exclu de toute paternité en vertu de la loi (Code civil § 4 : 103 (5)).
La donneuse d’ovocyte ou d’embryon est exclue de toute maternité en vertu de la loi (Code civil § 4 : 115 (4)).
La femme qui donne naissance à l’enfant est considérée comme sa mère.

Le père ne peut contester la présomption de paternité, sauf dans le cas où le conjoint ou le compagnon en union libre n’a pas donné son consentement à la procédure de PMA (Code civil § 4 :108 a)).
Le donneur de sperme ou d’embryon est exclu de toute paternité en vertu de la loi (Code civil § 4 : 103 (5)).
La donneuse d’ovocyte ou d’embryon est exclue de toute maternité en vertu de la loi (Code civil § 4 : 115 (4)).
La femme qui donne naissance à l’enfant est considérée comme sa mère.
3. Les procédures de PMA sont-elles prises en charge par le système de sécurité sociale ? Non. Bien que le traitement par FIV ne soit pas assuré par le service public de santé irlandais, les patients qui ont accès à un traitement par FIV dans un centre privé peuvent demander une réduction d’impôt pour les dépenses engagées, conformément au programme de réduction d’impôts pour les dépenses médicales. Par ailleurs, les médicaments figurant sur la liste des médicaments nécessaires au traitement de l’infertilité sont remboursés dans le cadre du programme de haute technologie géré par le Health Service Executive (HSE). Ces médicaments doivent être prescrits par un médecin spécialiste et approuvés par les High Tech Liaison Officers du HSE. Les frais correspondants sont alors pris en charge, selon le cas par la Medical Card ou le programme de remboursement des médicaments (Drugs Payment Scheme).

Les services de procréation assistée sont proposés dans le secteur privé et il n’existe actuellement pas de limites bien établies liées à l’âge ou à l’infertilité. Toutefois, la plupart des centres prestataires de services de procréation assistée adhèrent aux lignes directrices de la société irlandaise de fertilité (Irish Fertility Society)

Comme mentionné précédemment, il est proposé d’inclure dans la législation une disposition selon laquelle les services de procréation assistée doivent être accessibles à tous indépendamment du genre, de l’état matrimonial ou de l’orientation sexuelle. Toutefois, dans l’intérêt de tout enfant issu de techniques de procréation assistée (ou des enfants des familles souhaitant bénéficier de ces techniques), la législation prévoira une évaluation du bien-être de l’enfant qui permettra de déterminer si le couple demandeur remplit les conditions requises pour un traitement de procréation assistée. Cette évaluation portera sur l’âge et l’état de santé du couple demandeur, ainsi que sur sa capacité à assurer un environnement stable et sain pour un des enfants.

Pour les couples sans enfant commun, lorsqu’il s’agit d’un premier traitement, environ la moitié des frais sont couverts.
Pour le second et jusqu’au quatrième traitement, environ 70 %. Aucune prise en charge pour les traitements suivants.
Pour les couples avec un enfant. Du premier jusqu’au quatrième traitement, environ 20 %. Aucune prise en charge pour les traitements suivants. Aucune prise en charge pour les couples ayant plus d’un enfant.

La Bosnie-Herzégovine n'a toujours pas de législation spécifique sur la PMA couvrant l'ensemble du pays. Actuellement, la PMA est régie par les statuts de la législation sur l'assurance maladie (dans les deux entités de Bosnie-Herzégovine: la Fédération de Bosnie-Herzégovine et la République serbe de Bosnie et le district de Brcko), réglementant principalement les droits du couple au remboursement des frais de FIV pour deux procédures.

Actuellement (janvier 2017), le nouveau projet de loi sur la PMA (proposé par le parti démocrate socialiste MS) fait actuellement l'objet d'une procédure parlementaire dans la Fédération des entités de Bosnie-Herzégovine, tandis que le projet de loi sur la PMA élaboré par le ministère de la Santé compétent sera à l'ordre du jour du Parlement en 2017, aussi.
