On 3 October, the Department for the Execution of Judgments participated in Chișinău at the fourth meeting of the Advisory Council of the Government Agent of the Republic of Moldova. The Advisory Council is composed of the Government Agent and representatives of the relevant national authorities, the Ombudsperson, academia and civil society. Its main goal is to contribute to timely and effective implementation of the European Court’s judgments concerning the Republic of Moldova, through co-ordinated action of all national actors concerned and by ensuring the necessary support at the highest political level.
At its fourth meeting, the members of the Advisory Council discussed a number of issues pending before the Committee of Ministers, notably domestic violence and the Committee of Ministers’ last examination of this issue at its Human Rights meeting in September 2024 (T.M and C.M. group), various violations of the right to liberty and security (Sarban), the reopening of criminal proceedings following the finding of a violation by the European Court (Repesco and Repescu), unjustified extension of time-limits for different types of appeals resulting in the quashing of final domestic judgments in breach of the principle of legal certainty (Popov no. 2), detention of minors without legal basis in migration context (Minasian and Others), the arrest of persons on the territory controlled by the Republic of Moldova and their subsequent transfer to the Transnistrian region (Filin and Negruta), as well as the lack of investigation into deaths and ill-treatment inflicted by private individuals (Railean).
The event took place within the framework of the Council of Europe Project “Strengthening the Human Rights Compliant Criminal Justice System in the Republic of Moldova” implemented by the Co-operation Programmes Division of the Council of Europe.
