6. Est-il possible, dans votre pays, de procéder à un don de sperme ? Oui / d’ovocyte ? Oui / c. d’embryon ? Oui
En vertu de la loi de 2015 sur l’enfant et les liens de parenté, le don de gamètes et d’embryon est autorisé sur une base non anonyme. La législation prévoit aussi la mise en place d’un registre national des personnes conçues grâce à un don qui permettra aux enfants issus de donneurs d’avoir accès à certaines informations concernant le donneur de gamètes/d’embryon qui a permis leur conception. Il est prévu que le projet de législation relatif à la procréation assistée traite des questions générales liées à la conception par donneur (par ex. limites d’âge, dépistage, périodes de conservation, interdiction de la consanguinité et dons à des fins de recherche).
7. Des mesures de compensation sont-elles prévues pour de tels dons ? Oui. En vertu de la loi de 2015 sur l’enfant et les liens de parenté, le don de gamètes et d’embryon à visée commerciale est interdit. Le don de gamètes et d’embryons ne peut être qu’un don altruiste, mais le remboursement des dépenses raisonnables engagées dans le cadre du processus de don est possible. On entend par « dépenses raisonnables », aux fins de la loi, les frais de déplacement, les dépenses médicales et éventuels frais juridiques ou de consultant engagés par le donneur.
8. Des critères spécifiques sont-ils définis pour effectuer un don de sperme ? Oui/ d’ovocyte ? / Oui d’embryon ? Oui
La loi de 2015 sur l’enfant et les liens de parenté définit un certain nombre de critères pour le consentement des donneurs de gamètes/d’embryon. Ainsi, le donneur – homme ou femme – doit être âgé de plus de 18 ans et avoir donné son consentement écrit ainsi que la confirmation qu’il a bien été informé qu’il ne sera pas le parent d’un enfant issu du don. Le consentement doit être signé en présence d’un témoin. Lors du consentement, le donneur doit donner son accord à la publication d’informations le concernant dans le Registre National des Personnes Conçues grâce à un Donneur. Le consentement doit également indiquer que le donneur a été informé qu’un enfant issu de son don peut chercher à le contacter. Les centres de PMA doivent s’assurer que lorsque des gamètes/embryons issus de dons sont importés d’un autre pays, le processus de consentement en vigueur dans ce pays est conforme aux exigences précitées. Le projet de législation sur la procréation assistée prévoit que les donneurs subiront des examens médicaux conformes aux exigences figurant dans le Texte réglementaire n°158/2006 – Réglementation 2006 des Communautés européennes (qualité et sécurité des tissus et cellules humains).
9. Existe-t-il des critères non médicaux spécifiques pour la sélection des gamètes/de l’embryon devant être utilisé(s) pour une procédure de PMA? Non
10. Des mesures particulières sont-elles prises pour prévenir le risque de consanguinité ? L’Irlande a une population relativement faible, ce qui pourrait augmenter le risque de consanguinité par inadvertance entre individus conçus au moyen des gamètes du même donneur. Il est proposé que la législation sur la procréation assistée fixe une limite maximale de quatre familles auxquelles des gamètes / embryons d’un même donneur pourront être donnés.
11. Dans un couple homosexuel, un lien juridique est-il possible entre un enfant et le/la partenaire de son parent légal ? Oui.
Aux termes de la Loi de 2015 sur l’enfant et les liens de parenté, les parents d’un enfant conçu grâce à un don dans le cadre d’une procédure de procréation assistée sont :
(a) la mère,
(b) l’époux, le partenaire civil ou le concubin de la mère, selon le cas.
La loi de 2015 n'inclut pas la gestation pour autrui.
