At its 1075th meeting of 20 January 2010, the Committee of Ministers adopted the terms of reference of the CCJE for 2010 and 2011. These terms of reference contain also the adoption, in 2011, of an opinion (No. 14) on the non-materialisation of the judicial  process. The opinion has been adopted at the 12th plenary meeting of the CCJE on 9 November 2011.

In the framework of this theme, CCJE analysed the role of judges in the non-materialised process as well as the advantages and disadvantages ofr him and the court users of such a tendency.

Working party

The working party in charge of drafting the opinion has hold two meetings in Strasbourg, from 28 to 30 March and from 15 to 17 June 2011. Its composition wa as follows:
