In 2015 a new compensation mechanism was adopted in Albania by Law No. 133 on the treatment of property and finalisation of the process of compensation of property. The Law No. 133 was positively assessed by the Venice Commission and accepted by the Albanian Constitutional Court and recognised as successfully working by the Committee of Ministers decision in September 2018.
To ensure effective functioning of the compensation mechanism in practice, it is of prime importance that Albanian judiciary and legal professionals apply the Law in a harmonised manner. In this context, the Action “Supporting effective domestic remedies and facilitating the execution of judgments in Albania” has supported representatives of Albanian judiciary and legal professionals with development of a comprehensive commentary on the Law no.133/2015. The commentary had as objective to ease comprehension of the Law and its harmonised implementation at the national level. The commentary was developed in cooperation with the State Advocate and the Agency for Treatment of Property.
The Action “Supporting effective domestic remedies and facilitating the execution of judgments in Albania” is funded by the European Union and the Council of Europe Horizontal Facility programme and implemented by the Council of Europe.
