Initiative for Legal Certainty and Efficient Judiciary in Bosnia and Herzegovina
The main partners and beneficiaries of the Project are the Ministry of Justice of Bosnia and Herzegovina, Ministry of Justice Federation of Bosnia and Herzegovina, Ministry if Justice of Republika Srpska, Judicial Commission of Brcko District, Constitutional Court of Bosnian and Herzegovina; High Judicial and Prosecutorial Council of Bosnia and Herzegovina, Court of Bosnia and Herzegovina, Supreme Court of the Federation of Bosnia and Herzegovina, Supreme Court of Republika Srpska, Appellate Court of Brcko District; Judges’ and Prosecutors’ Training Centres of the Federation of Bosnia and Herzegovina and of Republika Srpska; Government Agent before the European Court of Human Rights, Law faculties of universities of Bosnia and Herzegovina.
The main objective is to support a more coherent application of case law in Bosnia Herzegovina, essential to ensure legal certainty for the people and contributing to a better functioning of, and more trust in the judiciary.
The following results are expected:
- Strengthen the case law departments within the highest judicial instances;
- Establish a permanent case law harmonisation tool at a national level;
- Building the capacity of judges and judicial assistants to adjudicate with the consideration of the case law of the European Court of Human Rights and the Constitutional Court of Bosnia and Herzegovina;
- Incorporation of the Council of Europe’s European Programme for Human Rights Education for Legal Professionals (HELP) methodology for human rights training into the extracurricular activities of law students
