Judgments concerning extradition and deportation

On 07 December 2017, in a Chamber judgment handed down in the case of D.L. v. Austria (application no. 34999/16), concerning the proceedings for the extradition of a Serbian national from Austria to Kosovo, the Court found, unanimously, that there would be no violation of Article 2 (right to life) or Article 3 (prohibition of inhuman or degrading treatment) of the European Convention on Human Rights in the event of the applicant’s extradition to Kosovo.

 

On 19 December 2017, the Court handed down a Chamber judgment in the case of A. v. Switzerland (no. 60342/16), which concerned the decision of the Swiss authorities to deport an Iranian national after rejecting his application for asylum. The Court held, unanimously, that the applicant’s deportation to Iran would not give rise to a violation of Article 2 (right to life) or 3 (prohibition of inhuman or degrading treatment) of the European Convention on Human Rights.
