Albanian institutions supported in harmonisation of national practices on property compensation

The Agency for the Treatment of Property (ATP), the Supreme Court of Albania, and the State Advocate’s Office have joined efforts to strengthen cooperation and unify administrative and judicial practices in Albania. Their key representatives convened in Tirana for a meeting organised with the support of the European Union and the Council of Europe, to identify the bottlenecks in the implementation practices of the Law 133/2015, on the Treatment and Compensation of Property.

Discussions centred on ensuring the fair and consistent application of the law, particularly in the financial assesment of citizens' property compensation claims. Particular emphasis was placed on addressing challenges in the application of the Law due to the lack of harmonised practices, the backlog of pending compensation cases, and the developement of strategies to fill the gap, especially in light of the limited legal mandate of the ATP to deal exhaustively with remaining compensation claims until the end of 2024.

The workshop yielded significant outcomes, including fostering more effective dialogue between the ATP and members of the judicial institutions, streamlining communication among all stakeholders, and laying the foundation for improved coordination. These efforts are aimed at promoting a unified approach to property compensation and enhancing the efficiency, transparency, and fairness of the process going forward.

This activity is organised in the framework of the action Improving the protection of the right to property and facilitating the execution of ECtHR judgments in Albania (D-REX III), under the joined European Union and the Council of Europe programme, the Horizontal Facility for the Western Balkans and Türkiye.
