Freedom of expression is one of the foundations of a democratic and pluralistic society. Its corollary is access for everyone to accurate, reliable and timely information, a key precondition for informed public participation. The role of the media and journalists in seeking out, verifying and distributing information is crucial.

States have the responsibility to provide adequate safeguards, both through law and practice, for the effective enjoyment and protection of freedom of expression, including by creating an enabling environment for free and responsible media to flourish and play their essential role in democracy.

The Council of Europe is well placed to help prevent and address the threats to the exercise of the rights and freedoms guaranteed by Article 10 of the European Convention on Human Rights, both offline and in the online environment.

The Council of Europe launches a new initiative to strengthen standards on freedom of expression and the media in South-East Europe

A new regional programme entitled “Reinforcing Judicial Expertise on Freedom of Expression and the Media in South-East Europe (JUFREX)” is officially launched on 13 October 2016 in Sarajevo at the first Regional Conference focusing on cooperation of the judicial sector on the application of standards relevant to Article 10 of the European Convention on Human Rights (ECHR), right to freedom of expression.

The JUFREX Programme is co-financed by the European Union and the Council of Europe. It is implemented by the Council of Europe in six locations of the region, for a three-year duration.

During the opening remarks M. Patrick Penninckx, Head of Information Society Department, Directorate General Human Rights and Rule of Law of the Council of Europe, highlighted the relevance of the application of established and evolving case-law of the European Court of Human Rights within the Council of Europe Member States as a key requirement for the functioning of a democratic society and noted the importance of the justice sector in this regard.

The overall Programme objective is to promote freedom of expression and freedom of the media in line with Council of Europe standards, with a specific focus on the judiciary in South-East Europe. Hence, the target groups of the Programme are judges, prosecutors, lawyers, but also media regulatory authorities, journalists and other media actors.

M. David Hudson, Senior Expert at the Centre of Thematic Expertise on Rule of Law/Fundamental Rights and Democracy, Directorate General for Neighbourhood and Enlargement Negotiations (DG NEAR), European Commission, stated that “the standards of the Council of Europe on freedom of expression and the media are the standards of the European Union and will as such be observed for each country within Chapter XXIII of the EU accession process”.

Ms. Valerija Galic, judge of the Constitutional Court of Bosnia and Herzegovina, the host country of the event, concluded the opening session with a detailed analysis of the scope of Article 10 ECHR and its application within the BiH judiciary, including the legislative environment as well as the judicial application of standards set by the European Court of Human Rights.

A two-day event, which ends tomorrow, will focus on the needs of the Region regarding the application of standards of Article 10 and will validate or modify country-level needs assessments and the activities that will take place.

In time of conflict

The right to freedom of expression and information constitutes one of the essential foundations of democratic society. In conflict situations and wars, the role of the media is critical in providing the public with accurate and timely information. Trustworthy news and images can contribute to the protection of civilians and conflict prevention, bring to the attention of the international community the horrors and reality of conflict and expose violations of human rights and international humanitarian law.
