A training on legal reasoning and legal drafting in criminal cases with the consideration of the European Human Rights Court’s case law and decisions of the Constitutional Court of Bosnia and Herzegovina is taking place in Tuzla, from 5-6 March 2020, for judges and judicial assistants.
The training, organised in cooperation with the Judicial and Prosecutorial Training Centres of the Federation of Bosnia and Herzegovina and Republika Srpska (JPTCs), is focused on how to give thorough arguments for factual and legal conclusions. An important part of the training is also the personalisation of the decisions on pre-trial detention, where general conditions that are provided for by the law should be elaborated considering individual circumstances. Examples of direct application of the European Convention on Human Rights were discussed.
The objective of the training is to improve the competences of the judges since the capacity of the judges to interpret the legal provisions in the light of the decisions of the higher courts, the Constitutional Court and the European Court of Human Rights is a condition for insurances of the coherence of judicial practice.
The training was held by an experienced judge-trainer and a certified trainer, who completed the Training of Trainers course held in 2019 within the project.
The training is organised under the project: “Initiative for Legal Certainty and Efficient Judiciary in Bosnia and Herzegovina” funded by the Kingdom of Norway.
